We discussed just redoing.pages;3 and 4, but I did all four pages just to be clear. I have attached a copy of theA page application' to this email and have pl,aced a.hard copy in " the mail addressed to you. 2) 1 attached the survey map with Zone 2.labeled and the addition labeled to the back of the application (page 5 of application). II' .3) 1 have disconnected the. downspout'drain that was hooked into an underground drain into the creek. He submitted an after -the -fact buffer authorization to me for approval. The fact that it was Zone 1 approval I sought more information from him. I do not know when the creek was daylighted. I think it was 10+ years ago. City of Raleigh Approved without telling homeowner to contact DWR. No Authorization from DWR was sought, homeowner believes this was because of how the buffers were measured. Homeowner expanded existing deck without authorization from DWR (from 38 — 238 SF in Zone 1) soon after the creek was daylighted by the City as part of another project (what date? — this may be a confounding issue we can look into: the city daylit the creek and homeowners didn't know their property was now subject to buffer rules...) Have both of these projects been completed? I'd have the homeowner provide a variance application for the deck and workshop addition (after the fact, I assume). In support of the application he can provide the permitting drawings submitted to the City for the workshop addition (April 2018) and the deck. We can look into how the buffers were shown on these drawings (i.e. if the home addition was out of Zone 1 base on an incorrect survey and submitted the City, but not caught by them ... we can consider that.) Bottom line, we need to authorize and account for the buffer impacts and we can work with him, but we need a variance application and supporting documents to process. The addition was never considered as issue with DWR. My guess is that this may have been because the distance from the creek was measured from the edge of the creek as instructed in the directions since the creek bed was planted with vegetation by the City of Raleigh. I attached the section from 15A NCAC 0213.0233 where it talks about the measurement for Zone 1 (in red). I was not involved with the discussions on the permit for the addition as the contracted handled those issues. As far I knew all necessary permits and authorizations were completed. As he mentioned the involvement of DWR only became as issue when the new survey was required and the deck was noted as being expanded from the original deck. The deck was expanded by myself soon after the creek was installed not realizing I needed anything from the DWR at the time. Just to put this into context, when we bought the property in 1981 there was no exposed creek, just a 52 inch pipe that was underground and served the purpose to move the creek water from Cedar Hills park to the lake on the south side on Mapleridge road. The City of Raleigh removed this pipe and opened the creek up to what we now have and I have been carefully maintaining the vegetation and monitoring the creek bank for 10+ years. If you have further questions about the addition we need to get Scott Bower involved about discussions on permits with and what was decided as I mentioned I was not involved with those discussions. (i) For intermittent and perennial streams, Zone 1 shall begin at the most landward limit of the top of bank or the rooted herbaceous vegetation and extend landward a distance of 30 feet on all sides of the surface water, measured horizontally on a line perpendicular to the surface water. I don't believe so. The permitting dept. did not bring up any issues with DWR when they issued the permits for the shop. DWR only came up when I applied for the deck permit. I will try to answer your questions as best I can, but please let me know if you need more explanation or more information. • The authorization that I need is for the deck, the addition was handled by the contractor (Scott Bower who I copied) and all the paperwork and approvals for the addition have been approved. The deck is entirely in Zone 1 if you measure from the top of the creek. In the directions on line it does state that the measurements can start from the edge of the creek if the bank is covered with vegetation, which is the case in my situation. However, based on your instructions, I have used the top of the creek for the Zone 1 measurements. • 1 have attached a survey map of my property where I have designated the 1) creek bed; 2) creek bank; and 3) Zone 1. Zone 2 would encompass most of the house so I did not include this to keep the map easier to read. You can see on the map that the entire deck and part of the house is actually in Zone 1 • The original deck on the house when the creek was engineered by the City of Raleigh was 38 sq feet which was expanded to 238 sq feet as shown now on the map. As explained in the application the expanded deck is larger, but no closer to the creek than the original deck. • The impact of issue here is Zone 1. What impact the larger deck has on the creek is the environmental concern but I would suggest that the impact may be minimal on the creek itself as there is grass and bank plantings that have successfully accommodated the run off over many years.
