Nature of Activity (Description of project, include all features) Permanent impacts associated with this Individual Permit application are requested in the amount of 557 LF for 6 road crossings, which are necessary for construction access to high ground and to support internal circulation of the master -planned Caleb's Creek community. Additionally, temporary impacts in the amount of 500 LF are requested for utility crossings in order to provide sanitary sewer service to the Caleb's Community. Additionally, several of the road crossings replace aging and/or damaged existing culverts, and several of the utility crossings are co -located within roads. The following permanent impacts associated with this overall project were requested under separate Nationwide Permits: Nationwide Permit 14, 360 LF permanent impacts to streams for road crossings and 0.046 acre riparian wetland impacts for a road crossing; Nationwide Permit 3: 350 LF permanent impacts to a stream for existing dam maintenance/repair and 0.75 acre permanent impact to open waters (ponds) for existing dam maintenance/repair. 19. Project Purpose (Describe the reason or purpose of the project, see instructions) The basic project purpose is to create access to high ground, construct internal circulation roads (both public and private), and construct sanitary sewer infrastructure, all of which will serve the Caleb's Creek community. The overall project purpose is to construct a master -planned mixed-use development, formally known as Caleb's Creek, located in the Piedmont -Triad in Forsyth County, NC. Features of this community include but are not limited to neo -traditionally styled low-density, medium -density, and high-density residential housing, commercial/office leasing space, mixed-use spaces, an amenity center, walking and biking trails, and common open space. The original Caleb's Creek concept included retaining the existing golf course of the proposed overall development. The proposed project has evolved to the current site design, which eliminates the golf course component and replaces it with passive recreational uses and open space, thereby reducing wetland impacts by over 4 acres. Additionally, the orientation and placement of commercial and residential development avoids impacts to jurisdictional features. Proposed impacts were minimized to those necessary for infrastructure (i.e. construction access to high ground, internal circulation roads, and sanitary sewer). 2. In order to design a development plan that would avoid impacts to the maximum extent practicable and to minimize and avoid impacts to the highest quality aquatic systems, the project area was assessed and delineated by the applicant's environmental consultants. These value and function assessments were later confirmed by the Corps by an onsite assessment and subsequent issuance of a Preliminary Jurisdictional Determination, dated August 4th, 2015, and included with this application (see Exhibit B). Maps provided within the application illustrate all aquatic resources within the project boundary. 3. The proposed project is designed with construction and mitigation concepts that allow for adaptive management to incorporate current technology and construction techniques that will minimize adverse impacts over the life of the permit. Internal circulation roads for the development are designed with headwalls that comply with NCDOT standards. At this time, the crossing top widths vary and allow for sidewalks, bike lanes and guardrails. The height of the head walls will vary based on topography and allowable construction design standards and technology. The applicant has assed each impact to be less than or equal to 120 feet based on a variety of factors and has committed to providing final NCDOT-approved designs to the Corps 90 days prior to their installation. Accordingly, the applicant has also committed to providing compensatory mitigation 30 days prior to their installation or by the phased mitigation schedule proposed, whichever date is sooner. In no case will impacts occur prior to the mitigation requirement being satisfied. 4. The applicant proposes that box culverts be sized in consideration of natural stream design protocols and will be constructed with sills that will maintain natural stream bed material that is a minimum of 12 inches deep. There are several existing culverts within the project boundary that are aging and incorrectly constructed; the applicant will replace these culverts and restore the ability for aquatic life passage during low -flow and drought conditions. Additionally, riprap will be pressed into streambanks instead of being placed directly into streambeds to prevent interference with aquatic life passage during low -flow and drought conditions. 5. Several of the proposed road and sanitary sewer crossings will utilize pre-existing crossing locations that have been previously impacted by road crossings or fairways from the former use of the property, and will be upfitted as appropriate. Additionally, as many of utility crossings as was practicable were designed to be co -located within roadway crossings. 6. Development will be completed in phases to limit the number of areas subject to impact at any one given time, and the limits of construction will be clearly demarcated for portions of the development under active construction. The overall project is anticipated to be constructed over a 10 to 20 -year period. The entirety of the project will be constructed under an approved Sediment and Erosion Control plan, and will conform to measures outlined in the Stormwater Master Plan. 7. Concrete used for the construction of crossings will not be allowed to come into contact with surface waters until cured. Coffer dams and pump arounds will be utilized to establish work-in- the -dry conditions. All contours will be restored to previous conditions and fill slopes will be re- seeded with appropriate bio -engineering practices and allowed to re -naturalize. 8. Riparian buffers will be preserved to the maximum extent practicable in order to minimize impacts to aquatic and terrestrial wildlife resources, water quality, and aquatic habitat within and downstream of the project area. The applicant has designed a site plan that minimizes riparian habitat fragmentation through the establishment of dispersal corridors along all remaining streams. 9. The developer will use Low Impact Development (LID) development practices for portions of the development, and will incorporate appropriate structural Best Management Practices and/or Stormwater Control Measures that meet the Town of Kernersville Watershed/Stormwater rules. The Caleb's Creek development has a Stormwater Master Plan which includes impervious calculations and complies with provisions of Chapter C of the Unified Development Ordinance of the Town of Kernersville.
