Little Creek WRF
Dear Mr. Lindsay:
The Division has reviewed your application for the subject permit. To enable us to complete our review
in accordance with N.C.G.S. 143-215.1 and 15A NCAC 2H.0105,please provide additional or revised
information to address the following comments:
1. As you may be aware,the NC 2007-2015 Water Quality Standard(WQS)Triennial Review
was approved by the NC Environmental Management Commission(EMC)on November 13,
2014. The US EPA subsequently approved the WQS revisions on April 6,2016 with some
exceptions. For NPDES implementation purposes,the following changes were required by
EPA and became effective as of April 6,2016:
• Adoption of assorted dissolved metal standards(acute and chronic)for aquatic life
protection and deletion of the corresponding `total recoverable' metals standards for
aquatic life(chronic). Some of the new standards are hardness-dependent. Use of the
dissolved fraction of metal and the influence of hardness is considered more
appropriate for evaluation of aquatic toxicity for copper, zinc, cadmium, silver,nickel,
lead, and trivalent chromium.
• Rescission of Action Level Policy for copper,zinc,and silver.Effluent limits must
now be added if there is positive reasonable potential,regardless of WET test results.
Therefore,we will need a minimum of one weeks' worth of upstream hardness samples(5
days)upstream of your outfall to determine site specific dissolved metals standards for your
facility.These should be grab samples and representative of the instream conditions.

If no response is received within 60 calendar days [per 15A NCAC 2H.0107(b)],the project will be
deactivated and withdrawn from our review process and the documents recycled. If you have any
