Corporation pursuant to an application filed on the 2nd day of November, 1989 to develop an existing boat basin by dredging the basin, build piers, cottage, shops, storage sheds and a walkway and stabilize the shoreline. The Application provides adequate assurance that the discharge of fill material into the waters of a tributary to the Intracoastal Waterway in conjunction with the proposed development project in Currituck County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That the applicant abide by the approved stormwater runoff management plan. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 12th day of February, 1990. E. J. CORPORATION of Currituck County, filed an application on October 13, 1989, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the - Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application the applicant proposes to dredge an existing basin and canal, build pier, cottage, shop, storage sheds and a wooden walkway, and stabilize the shoreline with riprap and bulkheading on 3.05 acres of land in Coinjock, Currituck County on the Intracoastal Waterway. The Division of Environmental Management proposes to take final action on this water quality certification on or before December 2, 1989. The issuance of the CAMA. Major Development permit and the Section 401 Certification may deviate from this projected date depending upon the nature of the comments submitted and subsequent hearings that may result. '! Bio Report Page 2 Site Description S.E.J. Corporation owns a 3.05 acre tract located off of S.R. 1165 on the Intracoastal Waterway, Coinjock, Currituck County. This site is approximately 50 yds. N.E. of the lots developed by S.E.J. Corporation under CAMA 'M.P.#94-89, on the Intracoastal Waterway. The site varies in elevation from approximately 6 to 42 inches above MHW. The highest elevations being a berm along a man-made canal (formed from spoil taken from the canal) and the N.W. portion of the lot adjoining S.R. 1165 and the neighboring lots. The lowest elevations abut the inland wetlands and the existing basin. Property elevation along the northern canal vary from 15 to 28 inches above MHW. Soils found on the site are characterized by a shallow organic layer (approximately'l") followed by a horizon of lighter colored, fine to very coarse sandy soil (ranging in thickness from l to 5 inches in depth. Beneath this horizon is a layer of dark colored soil, finer in texture with a large percentage of clay. Vegetation on the high ground consists of a mix of hardwood and Loblolly Pines. Predominant hardwoods are Liriodendron tulipifera (Yellow Poplar), Acer rubrum (Red Maple) and Liquidambar styraciflua (Sweetgum). Brambles, Smilax sp. (Catbriers), and Lonicera sp. (Honeysuckle) make up the under story. On the embankment along the mouth of the canal were patches of Spartina patens (Salt Meadow grass). 11404" wetlands have been delineated and verified on the site. The dominant trees in these area are Acer rubrum (Red Maple), followed by Liquidambar styracif lua (Sweetgum). The wetland fringe along the basin was made up of Arundinaria gigantea (Southern Cane), Pontederia cordata (Pickerelweed), Peltandra virginica (Arrow Arum) Myrica cerifera (Wax Myrtle) and ferns, mostly Osmunda cinnamomea (Cinnamon fern) and Osmunda regalis (Royal Fern). Smilax sp. (Catbriers), Arundinaria gigantea (Southern cane) and various ferns were common in the forested wetlands. Along the eastern edge of the developers driveway lies a wetland forest having standing water. Unidentified submerged aquatic vegetation is growing in the existing canal and is the only submerged aquatic noted. The applicant proposes to: (1) Dredge the existing man-made canal (810'x 301) to depth of 6 ft. and the basin (100' x 501) to a depth 61. All spoil will be placed on high ground. Bice Report Page 3 (2) Construct a dwelling (24' x 381) having a gravity feed, septic system, tieing into a low pressure system on the applicant's property permitted under CAMA MP 494-89. (3) Relocate a shop (22' x 321) from nearby property. No septic system will be required. (4) Use a combination of bulkheading and riprap along the shoreline'for,a distance of 1,140 ft. (average distance waterward of mean high water is 5 ft.). (5) Build a 90 ft. breakwater along the interface of the boat basin and.the adjoining 11404" wetland (6) Construct a 210 ft. x 6 ft. elevated walkway along the boat basins breakwater and bulkhead. (7) Erect two storage sheds (16' x 20' and 201.x 301) (8) Place a 35' x 6' elevated walkway over 11404" wetlands adjoining the long canal. ANTICIPATED IMPACTS Presently the man-made canal and boat basin are 1.5' and between 1.5 and 2.5 ft. deep respectively. Dredging the canal and basin to a depth of 6 ft. will result in the-removal of approximately 2,896 cubic yards and the disturbance of 29,300 sq. ft. of shallow water habitat. Fairly significant turbidity will result from the operation. All spoil will be placed on high ground on the project site. If necessary spoil material can be hauled off-site to a suitable high ground location. The construction of a bulkhead will remove approximately 5700 sq. ft. of shallow water habitat and create short-term, localized turbidity. The placement of riprap along the Intracoastal Waterway will reduce the potential amount of turbidity caused by shoreline stabilization. There are no plans to alter the delineated wetlands. Land clearing, filling, and grading can create sediment encroachment into the 11404" areas. According to the applicant there will be no other developments on, this property. The prepared developments are intended to provide an area for patrons of Midway Marina and residents of the surrounding neighborhood to utilize for passive recreational activities.
