PROJECT SUMMARY: The applicant proposes to maintenance excavate a man-made canal approximately 370' long x 50' wide by -6.5' deep on NWL and construct a bulkhead 340' long. The spoil material, some 1,400 cu. yds. to be contained on Lots #83, #84 and #85, Turtle Bay Drive, in Olde Towne Subdivision, New Bern, Craven County. 9. NARRATIVE DESCRIPTION: The project site is known as the Turtle Bay section of Olde Towne Subdivision, located off of Pembrooke Road, better known as Country Club Road, about 1 mile southwest of the Highway 70 by-pass and the City of New Bern, Craven County. The Turtle Bay section is the latest expansion efforts of Mr. Tom Karam and his development group, Olde Towne Partnership. Mr. Nelson G. Paul, acting as consultant and President of ECPS, has put together an informative CAMA application package for his clients. Part of the application package that is included with the distribution of this field report is a narrative description of the project provided by Mr. Paul. His report represents a clear and accurate description of the proposed project site and work activities. The applicant has also supplied a large blueline site plan that will help orient the review agencies to the overall project boundaries, as well as, focusing on the Turtle Bay canal site. Development of the original 250 ac. tract of land started in the 1970;s. The overall project includes a lengthy man-made canal and lagoon system providing water access to the Trent River. The Estuarine Waters in and around the project site are classified as 'SC'. The applicant proposes to maintenance excavate an existing man-made canal-measuring 370' long x 50' wide. The proposed maintenance excavation will restore the -6.5' water depth relative to the NWL. Water depths within the canal average -3.5' NWL. An estimated 1,400 to 2,000 cu. yds. of sandy much will be excavated from the canal. The spoil material will be placed directly on the highground property shown as Lots #83, #84 and #85, adjacent to Turtle Bay Drive. An earthen plug measuring 10' to 15' wide and 40' long constructs the mouth of the canal to a narrow opening of about 10' wide. Floating debris further restricts flushing of the canal with the primary waterway connecting Olde Towne Subdivision to the Trent River. Excavation of the plug will displace approximately 50 sq. ft. of giant cordgrass and cattails. These Coastal Wetlands are scattered along the shoreline. A narrow band of sweet gum and waxed myrtle reside along the east side of the canal where the proposed bulkhead will be located. On the west side of the canal FIELD INVESTIGATION REPORT - TURTLE BAY - OLDE TOWN PARTNERSHIP - TOM KARAM, CRAVEN COUNTY PAGE #3 opposite the residential area, the shoreline and terrain adjacent to the canal are characterized as 1404' type wetlands. The residential east side of the canal will be stabilized with a wooden bulkhead measuring a total shoreline length of 3401. The bulkhead will be aligned at an average distance of 2' waterward of the NWL. This will allow for straight line construction. On the north end of the canal, the proposed bulkhead will join an existing bulkhead that stabilizes the remaining Turtle Bay shoreline. On the south end of the canal, the bulkhead will terminate with a wing-wall into an open area of 1404' wetlands. Some of the dredged spoil will be incorporated as backfill to the proposed structure. The project drawings show the proposed construction of single-family houses on Lots 483, #84 and #85. As mentioned in the application package, construction of these three houses has already been authorized by a Minor CAMA Permit issued by the City of New Bern in the Fall of 1989. 10. ANTICIPATED IMPACTS: Maintenance excavation will displace some 18,500 sq. ft. of bottom substrate characterized as mucky sand. The onsite field inspection revealed no significant quantities of estuarine resources occurring within the canal. The potential impacts of increased turbidity can be minimized by conducting all of the interior excavation before opening the plug and canal to the primary waterway. It is noted that the proposed -6.5' water depth will connect to open-waters of equal depth. Proper containment of the 1,400 to 2,000 cu. yds. of spoil will also insure that runoff will not increase the amount of suspended sediments in the surface waters. The proposed excavation will directly displace some 50 sq. ft. of Coastal Wetlands dominated by giant cordgrass. In addition, a narrow fringe of 1404' wetlands will be removed. It is further noted from the project drawings that no excavation will occur to the 1404' shoreline on the western side of the canal. CAMA REVIEW SECTION: Most of the components of the proposed project approximate the dimensions and limitations of the CAMA General Permits, such as, those items listed under maintenance excavation and bulkheading. However, it was determined that processing a Major CAMA Permit would provide the developer with a higher level of consistency in terms of land use planning and environmental considerations. In addition to the Turtle Bay project, the applicant is FIELD INVESTIGATION REPORT - TURTLE BAY - OLDE TOWN PARTNERSHIP - TOM KARAM, CRAVEN COUNTY PAGE #4 currently developing other areas within the O1de Towne properties. Southwest of Bats Hill Road, another new section of homesites has been opened. Some 25 lots adjoin two non-tidal ponds that appear to have been excavated from wooded swamp wetland areas. The project site is within the extraterritorial jurisdiction of the City of New Bern. Therefore, the 1987 Updated Land Use Plan for the City of New Bern was consulted in the review of the Turtle Bay application. The land classification maps show the highground area to be 'Transition' where municipal services are provided and the surface waters of the canal system as 'Conservation'. At the same time, the planning document provides a list of Environmental Determinants on Map #4, on Page 25, that shows the entire Olde Towne development located in a highly unsuitable area for urban growth where flooding is common. It is uncertain, at this time, as to whether or not the proposed project is consistent with the goals and objectives of the local land use plan. Additional comments and review will be required in the interpretation of the City's planning document before a consistency determination will be made. PREPARED BY: JAMES L. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. The subdivision was begun in the late 1970's and is built around the Olde Towne Canal and borders the Trent River. The Olde Towne Canal is an artesian fed basin, originally created as a borrow pit for materials to construct the Highway 70 bypass in the early 1970's. It was opened for navigation by a canal dug under state and federal permits in the mid 1970's. The Olde Towne property is divided into two large tracts by the basin and canal. The north side is undeveloped and is largely a cypress, maple and gum swamp, interrupted by a few small low sand ridges and fill areas rimming the canal and basin. South of the basin and canal, where the ridges are more prominent and continuous, is the present Olde Towne subdivision. Soils on the ridges are classified as Tarboro series, a highly permeable sand typically found in the flood plains of the major eastern North Carolina rivers. Wetland soils are classified as Masontown/ Mucklee series. These soils have gray sandy subsoils under organic layers of variable thickness. The property is within the planning jurisdiction of the City of New Bern and the uplands are classified as transitional by the City Land Use Plan. Wetlands are classified as conservation under the same plan. The Trent River water quality is classified as SC by the Division of Environmental Management. Adjacent waters are also classified as joint fishing waters by agreement between the Wildlife Resources Commission and the Division of Marine Fisheries. Narrative - Proiect Site The project site of this application is located north of Batts Hill Road and west of Turtle Bay Drive. The project will involve the maintenance excavation of an existing canal presently 370' long, 50' wide, and 3.5' deep, and the construction and backfill of a bulkhead along the east side of the canal that will average 2' below the normal water level. The edge of the canal is presently vegetated on both sides by black willow, bay, red maple, wax myrtle, sweet gum, groundsel tree and dog fennel. The uplands on the east are vegetated with red oak and loblolly pine. The wetlands across the canal on the west are dominated by red maple, black gum, and minor amounts of bald cypress. Higher portions include loblolly pine and wax myrtle. Elevations on the eastern side of the canal are t5', whereas on the western side of the canal they range from 1.5' to 3.5'. A partial plug exists at the canal mouth that include`s'-fhe----------------- typical species rimming the canal along with some minor amounts of giant cordgrass and cattail. Outside the canal and to the east, an existing bulkhead will be backfilled, behind which are minor amounts of willow, maple, myrtle, bay, cattail, dog fennel, and accumulated flotsam. This structure was erected by authority of CAMA General Permit Number 4195C, and areas east of the canal that were previously filled are covered under CAMA Minor Development Permit Number 897-1, issued by the City of New Bern. Three residential structures were authorized for individual lots 83, 84, and 85 by this Minor Development Permit decision. Narrative - Proposal/Anticipated Impacts The developer is proposing to maintain the existing canal to its previous depth of 6.5'. This will disturb approximately 18,500 s.f. of subtidal substrate and is expected to produce approximately 1400 cubic yards of spoil material. The spoil material will be spread and leveled on lots 83, 84, and 85 along with the area occupied by the sewer lift station. The bulkhead proposed for the east side will be constructed and backfilled also at this time. It will be 340' long and will average 2' offshore. In addition, an area of volunteer 404 type wetlands behind the existing bulkhead will be filled. This area is approximately 40' long and 10' wide (200 s.f.) and is sparsely vegetated. These activities are not expected to be a significant adverse impact on the water quality or marine resources of the adjacent water bodies. Narrative - Total Development/Required Statements in accordance with 15 NCAC 7J .0203 (C)(1-5) the developer makes the following required statements: The Olde Towne subdivision is a residential subdivision composed of no more than 150 single family residential lots and 64 townhouse units. There is no area dedicated to non-residential purposes other than natural areas, open space, ponds, lakes, roadways, and parking. Wastewater is to be handled by the Town of New Bern Municipal system. Access is available to the site of this application without any new fill crossings of section 404 wetlands. A plan of the development is attached and shown on the sedimentation and erosion control plan, as are the approved wetland delineation maps and plats.
