The creek channel enters the upper valley on its western side. It continues down the far west side of the valley until 'it reaches a .short projection of granite from the west bank approximately 120 feet upstream from' the wide transverse vein of graqte mentioned above. At this point the creek channel moves into.the middle of the valley and then crosses the main transverse granite structure to the east of the midpoint. After cascading over the transverse granite vein, the stream runs sharply to the west, behind the granite wall where it then continues down the far west side of the valley. continued on page 2 Page 2 We propose to dig a trench 120 feet long between the upstream and downstream side of the west bank with a backhoe and place an 18 inch conduit pipe to divert the water away from the original channel during dam construction. Three anti-seep collars will be utilized. We will secure the intake end of the conduit pipe to the granite floor with concrete using sandbags to prevent any contamination of the water with fresh concrete. After construction of the dam the conduit will be closed, to be opened again only if maintenance work on the dam becomes necessary in the future. Once the creek water has been safely diverted into the conduit pipe, then we will proceed with the dam construction. First, we shall excavate the topsoil and debris from the creek valley floor beneath the dam site down to solid granite or clay. This material will be loaded on a dump truck with a front-end loader and will be transported out of the vacinity. We will then start construction of an 8 inch vertical concrete wall on the upstream side of the dam to prevent erosion and silting from the earthen dam during and after construction. Simultaneously we will start a concrete and stone wall on the downstream side of the dam beginning at the main transverse vein of granite. The downstream wall will be at least 12 inches thick with a slope of 1:2. We will then start forming the earthen dam with fill material from the east bank of the valley being careful to keep the concrete retaining walls at a higher elevation than the rising earthen dam; again, to prevent siltation. We will then construct a concrete spillway over the top of,.the dam 5 feet wide and 3 feet deep with walls 8 inches thick. We plan to construct a bottom release inlet 5 feet x 3 feet with a release 4 feet from the bottom of the dam. We will then construct a trout ladder on the downstream side of the dam with no step to be greater than 18 inches in height. Finally, we will construct an emergency earthen spillway to the east of the dam as originally proposed. Our plans include construction of a home at the site of excavated fill material on the east bank of the valley. Since this side is greater than 4 miles from the nearest electrical power source, we plan to construct an overshot waterwheel to power a 12 volt DC generator. We plan to store this electrical energy with a bank of batteries to feed a residential basic 12 volt system but with a converter to alternating current for major appliances. We plan to not use more than 50% flow rate of the stream during spawning season, so as not to'impede the migration of trout upstream. During the initial site survey several members of the various agencies did not inspect the site of pond #1 because they misunderstood it to be located in the pasture area downstream adjacent to the proposed site of pond #2. This upper pond #1 site is totally located in the hardwood forest which should provide shade from sunlight and minimize heating of the surface water. Upon completion of the dam we will plant trees along the top of the dam and along any edges of the pond disturbed during construction. continued on page 3 Page 3 We submit that this bottom release overdam spillway will conserve habitat for existing teri-estial and acquatic species and will ensure the normal flushing action of the creek during flooding season. As water cascades over the concrete dam, the water should be well oxygenated when it reaches the downstream creek bed to assure high oxygenation for the trout. To place our proposals into perspective-we have enclosed copies of the Schuler Creek system. On the enclosed map the watershed area of the Shuler Creek system is outlined in red, the Shuler Creek and its tributaries are outlined in blue, and the watershed area of our proposed dam site is outlined in green. There is a total stream footage of 205,050 feet. Our proposed construction of dam 41 will impact only about 350 feet of this system, which is less than 0.1% of the total footage. The total watershed area of the Shuler system, by my measurements, are estimated to be about 13,244 acres, while the watershed area of our small tributary is 250 acres. This makes up 1.89% of the total Shuler Creek watershed system. We feel our proposal will not significantly impact the Shuler system downstream. It is our intent to manage these ponds only for private-recreational purposes and never for commercial uses. No type of fertilizer or growth enhancer will be introduced into the system. We also plan to construct the dam during the Summer of 1991 when the creek flow rate is low to minimize interfering with downstream habitat during construction. We will then plan to fill the pond during a time of high flow rate. In making these alterations we have tried to comply with all of the criticisms offered by the various review agencies. If this new proposal does not meet everyone's satisfaction, we again will be very happy to try to make adjustments accordingly. We plan to be in the Asheville area on business from July 30th to August 2nd, and then plan to be at the Cherokee County, property August 2nd through the 4th. We will be most happy to meet with personnel from any of the review agencies either at their Asheville office or at the property site. Everett, Ph.D. Director Water Quality Certification Your application for a Water Quality Certification under Section 401 of the Federal Clean Water Act was received by the Division on March 28, 1990. The activity for which the Certification is sought is the placement of fill material into the waters and adjacent wetlands of Elbow Creek. The purpose of the proposed project is the creation of two "run of the stream" ponds on the stream. A Water Quality Certification is a determination by this Division that the activity for which the Federal Permit or license is sought is not expected to result in a violation of State Water Quality Standards for waters of the State. Our staff has reviewed your application and has identified specific concerns for impacts of this project on the Water Quality Standards. The significant existing uses of the Waters of the State are to be protected as required in the Antidegradation Policy of the Water Quality Standards (15A NCAC 2B .0201b.). The construction of the dam will interfere with fish migration in this stream which is classified as "C-Trout Waters." It is also expected that temperature in these waters as a result of impounding them will increase. The construction of two dams across an unnamed tributary to Elbow Creek is proposed. Elbow Creek is classified "C-Trout" and is located in the Hiwassee River Basin. Construction of these ponds will result in increased water temperature and interfere with fish migration. It is therefore recommended that water quality certification for this project be denied. Modification of the request to an off stream pond construction would be a desirable and very practicable for this site. Holder to place fill material in waters and wetlands of Elbow Creek in order to construct two ponds on Elbow Creek off SR 1325 near Violet, Cherokee County, North Carolina (CESAW-0090-N-020-0233). This report is submitted in accordance with provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e), and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543). It is to be used in your determination of 404(b)(1) compliance (40 CFR 230) and your public interest review (33 CFR 320.4) as it relates to protection of fish and wildlife resources. According to information provided in Public Notice, the applicant is proposing to construct two ponds, approximately 1,000 feet apart, on Elbow Creek. The ponds will be located approximately 6,000 feet above Elbow Creek's confluence with Shuler Creek. Shuler Creek is designated by the North Carolina Wildlife Resources Commission (Commission) as General Trout Waters. The first pond is proposed to have a surface area of 1.15 acres and is to be stocked with trout. The second pond, located downstream of the first pond, is proposed to have a surface area of 2.0 acres and is to be stocked with bass and bluegill. According to the Public Notice the purpose of the ponds is for: soil and water conservation; fish and wildlife values; flood and fire protection; recreation; and aesthetics. A Service biologist conducted an inspection of the project site on April 24, 1990. Elbow Creek is a small upper perennial trout stream with a substrate comprised primarily of rock slab, cobble, and gravel. The ponds are proposed for location on a section of the stream that runs adjacent to a pasture area. Remaining riparian vegetation adjacent to the creek includes such species as alder (Alnus serrulata), yellow poplar (Liriodendron tulipifera), Eastern hemlock (Tsuga canadensis), red maple (Acer rubrum), white pine (Pins strobus), rhododendron (Rhododendron maximum), black willow (Salix ni ra), and dog-hobble (Leucothoe sp.). In addition to providing spawning and nursery habitat for trout, streams such as Elbow Creek typically provide important spawning, nesting, nursery, foraging, and/or cover habitat for a wide variety of other aquatic and terrestrial species. They generally perform an important function in maintaining aquatic resources of their receiving waters by transporting food and nutrient items to downstream flora and fauna. Adverse impacts associated with the proposed project include: (1) the loss of approximately 755 linear feet of high-quality mountain stream and wetland habitat as a result of excavation and filling associated with construction of the dams and inundation by the ponds; (2) increased turbidity and sedimentation of Elbow Creek and Shuler creek below the project site during construction of the proposed dams, resulting in degradation of water quality and aquatic habitats in the two streams; (3) disruption of recruitment and nutrient cycles of Elbow Creek and Shuler Creek since the 'dams and lakes will act as barriers to stream life and the downstream flow of nutrients; (4) degradation of aquatic habitats of Elbow Creek at and above the project site since the ponds will act as sediment traps ; (5) likely alteration of downstream water depth and velocity within Elbow Creek; and, (6) likely increase in water temperature in Elbow Creek due to an increase in surface area and the possible loss of overstory vegetation adjacent to the permanent pool areas. The Service considers waters and wetlands such as those within the project area as habitat of high value that is scarce or becoming scarce on a national basis or in this ecoregion. The Service's Mitigation Policy (Federal Register 46(15):7644-7663, January 23, 1981) for such habitat calls for no net loss of in-kind habitat value. After minimizing losses of such habitat, the unavoidable losses should be replaced with similar habitat values so that the population of the species associated with the habitat will remain relatively stable in the area over time. In view of the Service's Mitigation Policy and the value of the project area to fish and wildlife resources, we believe that authorization of this activity would result in significant adverse alteration and elimination of important public trust resources. Accordingly, in order to effect fish and wildlife conservation and to fulfill the public trust in this matter, the Service recommends that a Department of the Army permit not be issued for this project. Based on our records, there are no federally listed or proposed endangered or threatened plant or animal species in the impact area of the project. In view of this, we believe the requirements of Section 7(c) of the Endangered Species Act (Act) are fulfilled. However, obligations under Section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner which was not considered in this review, or (3) a new species is listed or critical habitat determined that may be affected by the identified action. Although we do not have records of federally listed or proposed species within the project vicinity, there are two species that are currently under status review by the Service [the hellbender (Cryptobranchus alleganiensis) and the olive darter (Percina sguamata)l which may occur in the impact area of the project. Status review species are not legally protected under the Endangered Species Act and are not subject to any of its provisions, including Section 7, until they are formally proposed or listed as endangered/threatened. We are including these species in our response for the purpose of giving you advance notification. These species may be listed in the future, at which time they will be protected under the Endangered Species Act. In the meantime, we would appreciate anything you might do to avoid impacting these species. The Service appreciates the opportunity to provide conservation recommendations on this project. We would be pleased to meet with you, your staff, or the applicant to discuss our concerns. Please advise us of any action taken by your office in this matter. HOLDER, 801 Osceola Street, Stuart, Flordia 34994, has applied for a Department of the Army permit TO PLACE EXCAVATED MATERIAL IN THE WATERS AND WETLANDS OF ELBOW CREEK, A TRIBUTARY TO SHULER CREEK, ASSOCIATED WITH CONSTRUCTION OF TWO PONDS, OFF S.R. 1325, Violet, Cherokee County, North Carolina. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show the proposed construction of 2 ponds approximately 1,000 feet apart and 6,000 feet upstream of Shuler Creek. Pond No. 1 is to have a surface area of 1.15 acres.measuring 250-foot-long by 200-foot-wide. Pond No. 2 is to have a pool area of 2 acres measuring 320-foot-long by 270-foot-wide. Quantities of fill material for the dam and pond construction are 5,900 and 3,300 cubic yards respectively. Pond No. 1 will have a top width of 16 feet and Pond No. 2 will have a top width of 12 feet. Sideslopes vary between 2:1 and 3:1. Emergency spillways will be excavated adjacent to the proposed dams on both ponds. Pond No. 1 is to be stocked with trout and Pond No. 2 bass and bluegill. Approximately 755 feet of stream channel will be impacted by the projects. Shuler Creek is designated as General Trout Waters by the NC Wildlife Resources Commission. The purpose of the ponds is for soil and water conservation; fish and wildlife values; flood and fire protection; recreation; aesthetics and general environmental concerns. Plans showing the proposed construction are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will.be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register -2- constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public;' Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. HOLDER, 801 Osceola Street, Stuart, Flordia 34994, has applied for a Department of the Army permit TO PLACE EXCAVATED MATERIAL IN THE WATERS AND WETLANDS OF ELBOW CREEK, A TRIBUTARY TO SHULER CREEK, ASSOCIATED WITH CONSTRUCTION OF TWO PONDS, OFF S.R. 1325, Violet, Cherokee County, North Carolina. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show the proposed construction of 2 ponds approximately 1,000 feet apart and 6,000 feet upstream of Shuler Creek. Pond No. 1 is to have a surface area of 1.15 acres measuring 250-foot-long by 200-foot-wide. Pond No. 2 is to have a pool area of 2 acres measuring 320-foot-long by 270-foot-wide. Quantities of fill material for the dam and pond construction are 5,900 and 3,300 cubic yards respectively. Pond No. 1 will have a top width of 16 feet and Pond No. 2 will have a top width of 12 feet. Sideslopes vary between 2:1 and 3:1. Emergency spillways will be excavated adjacent to the proposed dams on both ponds. Pond No. 1 is to be stocked with trout and Pond No. 2 bass and bluegill. Approximately 755 feet of stream channel will be impacted by the projects. Shuler Creek is designated as General Trout Waters by the NC Wildlife Resources Commission. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register t a -2- constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. -3- Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after May 23, 1990.
