THROUGH: Preston Howard Wilmington Regional upervisor SUBJECT: Lockwood Folly Marina CAMA Major Permit Application/ Brunswick County At the request of Mr. Mason Anderson, the staff of the Wilmington Regional Office conducted an on site visit at the proposed Lockwood Folly Marina. The purpose of the on site visit was to provide an opinion on the feasibility of utilizing a low pressure pipe-soil absorption system (LPP-SAS) for wastewater disposal. The wastewater will be generated in a 125 dwelling unit complex and 50 slip marina. Assuming the 125 dwelling unit complex will be a mixture of 2 and 3 bedroom units; the anticipated volume of wastewater from the housing units and marina is 0.040 MGD. Conversation with Mr. Paul Dennis, one of the principals of the development, indicated very little clay had been encountered on site; with area being deep white sands. Using a conservative loading rate of 0.5 pllons/day/ft of effective absorption area; the 0.040 MGD would require 80,000 ft of area with an equal area for repair. During the onsite visit; it appeared sufficient area was available to install a LPP-SAS. Mr. Steve Manley, Landscape Architect for the project, has provided a layout showing approximately 4.3 acres designated for potential disposal areas on the eleventh and seventeenth fairways. It is therefore reasonable to assume a permit may be issued for this proposed facility. The remaining residential lots are to be served by individual septic tank systems. The entrance of the proposed 50- slip marina south of.Varnaintown lies about 200 feet from an oyster and clam bed where the Division of Marine Fisheries last year planted 6,000 bushels of shellfish. The mari- na would be part of Lockwood Folly, a 500-acre development and 18-hole golf course developed by Channel Side Corp. Marine Fisheries has objected to the planned marina, saying it is likely to have an adverse impacton fisheries resources in what is "historically one of the most produc- tive shellfish areas in the state." The agency also expressed con- cern that additional pressures, such as a marina, on the fragile river environment would result in per- mananent shellfish closures. Comments by Marine Fisheries, the Division of Health Services and Environmental Management are generally considered the most criti- cal to marina permit applications. Marine Fisheries and Community Assistance, a division of, Natural Resources and Community Devel- opment, are the only two agencies that have objected to the planned marina, though some agencies have requested studies or other special provisions, according to Coastal Management officials. "I think the file indicates there is concern ... about water quality," Matthis said. Coastal Management has until next month to issue its decision on the permit application. His home' also sits on the edge of a 500. acre grouping of upscale homes and an 18- hole golf course, developed after the family land was sold to Channel Side Corp., a firm Hewett formed in 1986. Hewett, a major stockholder who sits on the board of directors, has been meticulous about the development's design. The wind= ing golf cart paths and paved roads bypass as many of the area's oaks, dogwoods and cy- press trees as possible. A moat was dug around a cypress grove to create a built-in golf course obstacle without having to uproot the trees. "I came to the realization that some day I would have to be done with it," he said of selling thel,heavily forested land owned by his family since 1932. "1 always wanted it to be pretty, and to be an asset to the communi- ty and the', state." In light of Hewett's effort to protect plants and wildlife, his suggestion that Channel Side apply to build a 50-slip marina stands apart from what appears to be an environ- mentally aware development philosphy. The opening of the proposed marina is about 200 feet from an oyster and clam bed known as Crossrock, where the state Divi. sion of Marine Fisheries last year planted 6,000 bushels of oysters and clams. The agency objects to the proposed marina because it is so close to "highly productive" shellfish beds and may have negative effects on an already fragile coastal environment, William Hogarth, director of Marine Fisher- ies, said last week. Shellfish Sanitation, part of the Division of Health Services, does not anticipate any automatic closures of shellfish beds if the marina is built, but officials are worried about long-term effects, said Deputy Direc- tor George Gilbert. "The Lockwood Folly River is a river sys- tem that has problems with bacteria any- way," he said. "Anything that could happen in addition to that could hurt the balance of the river." The agencies are not alone in their con- cern. Fishermen who regularly hand-rake clams and oysters from Crossrock, and from beds called Galloway's Flats near the Intra- coastal Waterway, have reacted strongly against the proposed marina. Annie Smigiel, who has been clamming and oystering in the river all her life, said the marina will not be able to avoid polluting the river with stormwater and other runoff. "I cannot think of a way they could do it that would not harm the river," she said. "To me, it's worse than mechanical clam harvest- ing' because the dredges may leave when theydon't find anything. The marina will be herd to stov." Mrs. Smigiel has written the state Divi- sion of Environmental Management to re- quest a hearing on the marina proposal. She is waiting for an answer. Hewett, who gathered clams and oysters on Galloway's Flats as a boy, said he believes Channel Side has done everything possible to prevent environmental damage. For this reason, the Division objects to the proposed project. The lower Lockwood Folly River, historically, is one of the most productive shellfish areas in the State. Over 40% of the commercial landings in Brunswick County come from this area. The Division maintains five shellfish management areas in the immediate vicinity of the project. Over 40,000 bushels of polluted oysters have been manually relayed to this area by local shellfishermen. This entire area, including the river channels, is heavily utilized by hand clammers. The waters in the lower Lockwood Folly River are very fragile. At various times in the past, this area has been closed to shellfishing because of pollution. Because of the sensitive nature of the waters, the Division is extremely concerned that any additional pressures, such as this marina, added to the system will result in permanent shellfish closures and the loss of a significant portion of the shellfish producing area of Brunswick County. The Division is charged with the stewardship of the marine and estuarine resources of the State of North Carolina. As such, it is responsible for the maintenance, preservation, protection and development of all marine and estuarine fisheries resources. The Division would be in violation of this charge if it supported activities that it felt would result in the loss of fisheries resources or their availability to the public. The Division of Marine Fisheries objects to the proposed project because it feels that permanent closures of shellfish waters will occur as a result of the construction and operation of the marina. ADJACENT WATER BODY: CLASSIFICATION: SA Lockwood Folly River Status: Open The project has been reviewed to determine impacts to water quality. The following comments are provided. The project will not require a 401 certification. Since several agencies met with the applicants of the project on July 1, 1988 this office is revising earlier comments dated May 26, 1988. During the July 1 meeting, Bob Benton indicated that no automatic closure of shellfish areas will be imposed on those waters outside the entrance channel. The Division of Marine Fisheries was also represented during the July 1 meeting and expressed concerns over the potential loss of the significant shellfish resource in the Lockwood Folly Estuary adjacent to the proposed development. Although no automatic closure will be imposed it is very likely that the increase in boat traffic will ultimately result in additional closed area and although this is a 1150 slip marina", the additional 100 boat dry stack storage has the potential to store boats with heads, which also adds to the potential for numerical closures in the area. ow Page Two July 14, 1988 It is recommended that a permanent pumpout facility be installed, fully maintained and operable through the life of the marina, in addition to the signs posted in conspicuous locations prohibiting any overboard discharge of sewage. Only July 11, the revised information pertaining to stormwater was received and is being processed at this time. The development is proposing low density throughout the 460 acre tract and appears to meet the stormwater regulations. Based on the marina policy, we will not be required to automatically recommend closure of shellfish waters due to this project. However, this is a sensitive area which is already stressed by other pollution sources and this marina may provide enough additional pollution to require a closure at a later date. 2. Grassy swales and ponds need surveillance for a control of mosquitoes. They should be designed to drain in 3 days, have an adequate maintenance program for mosquito control or both. For information regarding appropriate mosquito control measures, the applicant should contact the Vector Control Branch, (919) 733-6407. 3. No construction of the marina, associated dry stock boat storage or multifamily buildings should begin until plans and specifications for the proposed sewer system are approved and an improvement permit is issued by the Brunswick County Health Department or until a comparable permit is issued by the Division of Environmental Management. Based on a January 26, 1988, on-site inspection, we have determined that this work would be detrimental to fishery resources due.to the excavation of 0.31 acre of wooded wetlands for marina construction. These wetlands provide food and water quality maintenance functions that are important for the continued fishery production. Therefore, we recommend that this permit not be issued unless the excavation of wetlands for marina construction is eliminated from the project plans. We are also concerned that the proposed marina could cause water quality degradation and the closure of adjacent SA (open) shellfishing areas in the Lockwood Folly River. However, the Environmental Protection Agency and the North Carolina Division of Health Services, Shellfish Sanitation Division have the primary expertise in these areas. Project Summary The applicant proposes to construct a Marina to accommodate 50 goats with a maximum size of 45', also dry stack boat: storage and 6 multi-family buildings. PROJECT DESCRIPTION Lockwood Folly Golf Community is a 500 acre recreational. community located in Brunswick County on the west bank of the Lockwood Folly River at its confluence with the intracoastal waterway. The site is reached from SR 1119. Lockwood Folly Golf Community has been designed to include 426 single family lots; 25 acres of multi-family development, an 18 hole golf course with clubhouse and pro shop, a 6 court tennis facility with swimming pool. The site is densely covered with old stands of pines, live oaks, deciduous oaks, hickory and dogwood. There are several pockets of protected "404" wetlands. Some of the wetland will be excavated to accommodate approximately 10 acres of lakes and retaining ponds. The soil. is a loose, friable sandy loam which drains well. The site is relatively flat; most grades range between 0-47. The golf course has been built outside of the 75' estuarine shoreline. The Lockwood Folly River has an average depth of -7' in the general vicinity of the development described above. Most of the estuarine shoreline consists of 6-10 foot high vegetated bluffs. Extensive salt marsh vegetation consisting predominantly of cordgrass (Spartina alterniflora) and black needlerush (Juncus spp.) extends along all of the water perimeter of the tract, with the exception of an area located on the east side of the property, approximately 300 feet north of the peninsula which resemble a beach landing void of any vegetation. There are several wetland pockets which have been identified by the Corp of Engineers and are indicated on the plat work. Based on personal observation and consultation with the senior consultant, it appears that the tidal amplitude in the area is approximately 4 1/2 to 5 1/2 feet. The area is designated as a secondary nursery and SA waters open to the taking of shellfish. The applicant proposes to excavate a boat access channel and basin. Also proposed is a 100 boat dry stack storage and 6 multi-family buildings. The proposed access channel is approximately 340' long x 75' wide x -7' mean low water (MLW). The basin is approximately 400' x 150' x -5' MLW. There is also a proposal to bulkhead the entire perimeter of the access channel and the boat basin. Approximately 20,000 cubic yards of high ground material will be excavated by dragline and will trucked to another on site location (high ground). Presumably some will be placed landward of the proposed bulkhead (approximately 1720' linear feet of bulkhead). Boat slips for 50 boats ranging between 25' to a maximum of 45' will be provided in the basin. No dredging is proposed on the River, with the exception of an area of approximately 75' x 30' at the confluence of the River and access canal which has a slope ranging from approximately -1' mlw to -5 mlw. This area will be dredged to reach a depth of -7' mlw. Channel Side Corporation, Inc. Page 3 10. ANTICIPATED IMPACTS In consultation with CAMA senior consultant, it is anticipated that the tidal amplitude as mentioned above, should help in the flushing of the basin during average daily tidal periods. In addition the allowance for sheet flushing at the northeast side of the basin should also assist with water quality. As proposed the marina basin will cause .31 acre of 404 wetlands to be excavated. There should be only 1.5% of impervious cover-(i.e. roof and roads) within the 75 feet area of environmental concern. No coastal wetlands will be impacted by this proposed project. All urban runoff on the tract is to be directed into grassed swales and man-made irrigation ponds. Our evaluation was that we could find no basis for concluding that the project would create a violation of Water Quality standards including the Antidegradation Policy of the Standards. We advised the Division of Coastal Management that we had no objection to the permit issuance based upon water quality concerns. Only a few months ago, a representative of your department met with me, a local official, the US Army Corps of Engineers and concerned fishermen in Brunswick County to discuss the horrible pollution problem in the Lockwood's Folly River Inlet area and to formulate a plan to resolve the crisis facing the shellfishing industry in Brunswick County. With your representative's agreement and verbal support, proposals were drawn up to fund a comprehensive study of the fecal coliform pollution problem that has closed the area to shellfishing in recent years and to fund a demonstration project to dredge the Eastern Channel of the Lockwood's Folly River Inlet in hopes that pollution will be flushed from the shellfish beds. The House recently approved $465,000 to conduct the study, and I expect the House to authorize the $1.2 million demonstration project before adjournment this year. Without a doubt, the problems facing Brunswick County waters and its shellfishing industry are associated with coastal development policies, or perhaps more appropriately, the lack of sound development policies. The State's decision to move ahead with a project that offers no relief to the stress placed on the Lockwood's Folly River and that may very well worsen a bad situation is in direct conflict with the objectives of cleaning up the Lockwood's Folly River and have not been in the spirit of co-operation. I have spent a very substantial amount of time securing Federal support for these two aforementioned proposals with the expectations that State and local officials would offer their co-operation in meeting this challenge. With this in mind, am I now to disengage in my efforts to secure limited Federal funds to help State and local officials and the people of Southeastern North Carolina to save the Lockwood's Folly River? Dissolved Oxygen, salinity, and tidal amplitude will provide impact information from the potential depression of Dissolved Oxygen that has been found to occur in man-made basins even if there are no boats involved. See attached Marina Report. Monitoring for fecal coliform is of course intended to indicate whether there are water quality problems occurring with sewage from boats. The sampling with respect to oxygen impacts needs to be conducted over a long period (essentially for the life of the marina).
