After reviewing your application, we have determined that this project is covered. by Water Quality General Certification Number 3494, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwe'tlands, The General Certification allows you to use Nationwide Permit 36 once it is issued to you by the U.S. Army Corps of Engineers (USACOE). This letter also serves as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0243. Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. The above noted: Certification will expire when the associated USACOE's 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with .all conditions. _ This approval, however, should not be construed as authorization to impact any part of the 50-foot riparian buffer that currently exists on the main stem of the Catawba River under the Catawba River Buffer Protection Rule (15A NCAC 2B .0243). If the total wetland fill for this project (now or in the future) exceeds one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). In addition to the requirements of the certification, you must also comply with the following conditions: 1. No impacts shall occur in the buffer, including the removal of trees, except along the immediate shoreline. 2. Mulch or pine needles (6" deep) shall be used to help reestablish the buffer upon completion of the project. ; 1 We understand that you have chosen to contribute to the Ecosystem Enhancement Program (EEP),in order to compensate for the impacts in the Catawba River Buffer. The property for the site has been donated to the City of Charlotte by Crescent Resources as part of their rezoning for the Sanctuary Development, located adjacent to the Fire Station. Fire Station No. 38 is unique to Charlotte in that it will be the first Fire Station with water access. The proposed station will include a boat ramp and a boathouse that will serve two Fire Department Fire and Rescue Boats along with a Charlotte-Mecklenburg Police Department Boat; The property is a wooded site of 3.20 acres that slopes to the lake from Shopton Road. The proposed development includes driveway access off of Shopton Road to serve both Fire Rescue Vehicles as well as public and private personnel vehicles. The boat ramp will extend down to the water for loading and unloading boats as well as emergency vehicle access to the boat house for ambulance transfer from the boats. In order to construct the boat ramp and boathouse, portions of the 50 foot Catawba River Buffer must be encroached upon. Tree removal and grading will be required with minor shore-line stabilization. Stormwater Management BMPs will be installed to permanently treat the runoff generated by the project prior to discharge to Lake Wylie. Location The proposed Fire Station No. 38 is located at 12100 Shopton Road West (SRI 116), in Charlotte, Mecklenburg County, North Carolina (35.1450°N -81.00290°W) and is approximately 3.0 acres in size. The proposed impacts are located on Lake Wylie. Lake Wylie flows into the Catawba River, which ultimately flows into the Atlantic Ocean through the Santee-Cooper River in South Carolina. ? jdj c?-C Existing Site Conditions The site is wooded and slopes toward Lake Wylie. This portion of Lake Wylie has a regulated 50-foot wide Catawba River Buffer as required by the North Carolina Division of Water Quality. The property is separate from, but adjacent to the Crescent Resources Development known as The Sanctuary. Crescent Resources donated the land to the City of Charlotte for the construction of the new Fire Station, which will contain a boathouse for fire and police service on Lake Wylie. Applicant's Stated Purpose As stated by the applicant, the purpose and need for this project is to provide fire protection to this region of Mecklenburg County. It will also be the first in Mecklenburg County with emergency service watercraft to provide both fire and emergency response on the water. Due to the nature of the Fire Department's Emergency response requirements, it is vital to the mission to have refueling capabilities at the boathouse. A concrete boat ramp will be required for loading and unloading the emergency watercraft. Recent annexation requires a new Fire Station in this part of Mecklenburg County. Project Description The applicant is proposing to construct a 2,600 square feet boathouse that will house two fire rescue boats and one police boat. The boathouse will be a heated enclosed structure to ensure rapid response of emergency boats during all seasons. The boathouse is not considered a.habitable structure. It will also contain a dual dispense (gas and diesel) fuel facility with emergency shut offs at various locations. A concrete boat ramp will be required for loading and unloading the emergency watercraft. Portions of the Catawba River Buffer will be disturbed with tree removal, grading, and minor shoreline stabilization to construct the boathouse and boat ramp. The applicant is proposing to compensate for these buffer impacts by making payment in to the N.C. Ecosystem Enhancement Program in the amount necessary to restore 10,022 square feet of buffer in the Catawba River Basin (HUC 03050103). Total proposed impacts to Lake Wylie is 0.033 acre of open water. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. The property was donated to the City of Charlotte for the construction of the Fire Station. In order to meet the Fire Station Mission, the boat house and boat ramp are critical to providing emergency response service. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. Page 9 of 12 USACE In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. The property for the site has been donated to the City of Charlotte by Crescent Resources as part of their rezoning for the Sanctuary Development, located adjacent to the Fire Station. Fire Station No. 38 is unique to Charlotte in that it will be the first Fire Station with water access. The proposed station will include a boat ramp and a boat house that will serve two Fire Department Fire and Rescue Boats along with a Charlotte-Mecklenburg Police Department Boat. The property is a wooded site of 3.20 acres that slopes to the lake from Shopton Road. The proposed development includes driveway access off of Shopton Road to serve both Fire Rescue Vehicles as well as public and private personnel vehicles. The boat ramp will extend down to the water for loading and unloading boats as well as emergency vehicle access to the boat house for ambulance transfer from the boats. In order to construct the boat ramp and boat house, portions of the 50 foot Catawba River Buffer must be encroached upon. Tree removal and grading will be required with minor shore-line stabilization. Stormwater Management BMPs will be installed to permanently treat the runoff generated by the project prior to discharge to Lake Wylie. In addition, a temporary Sediment and Erosion Control Plan will be permitted through NCDENR, Land Quality Section prior to construction operations.
