extent that such matters are valid and in force and affect title to the Property, provided that reference to any matter
shall not operate to ratify or reimpose such matter (the "Permitted Exceptions").

Legal Description
All that certain piece or parcel of land, situate, lying and being in Raleigh Township, Wake County, North Carolina
and more particularly described as follows:
BEGINNING at an iron stake at the N.E. Corner of the property of K. & L. Auto Service Company in the western
line of the right of way of U.S. Highway No. 70 between Raleigh and Garner, said stake being located 30 ft. in a
western direction from the center of said highway; runs thence along the northern line of property of K. & L. Auto
Service Co. S. 88 degrees, 10' W. 935.1 ft. to an iron stake, located 52.4 ft. in an easterly direction from the center
of the North Carolina Railroad Company; runs thence along the said right-of-way N. 15 deg. 35' E. 387.0 ft. to a
stake in said right of way where a 48 foot driveway terminates; runs thence along the southern line of said driveway
S. 88 degrees. 13' E. 852 ft. to a stake in the western line of right of way of U.S. Highway No. 70; runs thence in a
southern direction 321.4 ft. to the beginning and containing 7.15 acres, according to map and survey made by Sam
Powell, Registered Surveyor, Sept. 24, 1946, and recorded in Book of Maps 1946, at Page 31, Wake County
Registry.
LESS AND EXCEPT any portion of the property taken for right of way in Book of Maps 2002, at Page 1154.
