April,
I am putting together a modification application for this change at U-2524D Site 4 and I
have a mitigation question for you. From what I understand the grade controls would
not require mitigation, and the USACE doesn’t need mitigation for the additional 70’ of
bank stabilization. However, given that the total impacts for this site are over 1500’
with the long culvert, I wasn’t sure if DWR would require mitigation for this 70’ of
corrective stabilization. We did already secure 0.5:1 mitigation for this stretch of stream
due to loss of function in the 2016 phased modification, so if DWR does want mitigation,
I presume we’d only have to secure an additional 0.5:1 (35’) of mitigation to make 1:1
for this stretch.
Let me know your thoughts. I will try to get this modification application out next week
if I can.

Hi Chris, and thanks for the email. If rip rap on the banks (Detail 25) is necessary to
prevent further bank erosion at Site 4 then the Corps would be willing to authorize it.
However, 70 feet of additional impacts is too much to authorize via email. Instead we
would require an official permit mod. Talk with Nikki Thompson as she has been through
this process before. NCDOT’s written permit mod request should include both the step-
down grade controls as discussed in my earlier email (10/30 ad 12/3/2018) as well as
the proposed additional bank stabilization since it’s all part of the same issue.

:) I clicked on the wrong email in the string and sent this to Jerry instead of David.
David,
Would we be able to place bank stabilization (detail 25) back to where the 4”
sewer line is, to armor against further bank erosion when the stream floods above
the normal high water mark. As you can see from the pictures, this stream has
eaten the Class B rip rap from the key-in point (normal high water mark) to
approximately the same height as the class 1 that was placed as per the upstream
channel improvements. I measured this length before, it would be an additional 70
LF of upstream improvements.
The original stream bed was 3’-4’ wide before the stream was turned into the
culvert. It is currently 8’-10’ wide along the eroded bank section now. It may have
something to do with the culvert having no baffles that there is more velocity in
this area. There is also a lateral V ditch that ties into this stream and bucks the
flow that has yet to be constructed. The contractor and I hope to one and done the
work in this area as it will be very difficult to get back to after Flatiron closes up
the sound wall.
I will sketch up something this week on the rock drop structures as per your
request. Please advise if the bank stabilization is approved to do also.

Jerry,
As per our discussion in the field with regards to the head cutting/scouring that
has been taking place on the upstream of Culvert #1 inlet (Site #4). I am
proposing to use detail #14 from page #8 in the plans that was used for the JS of
Site #3 & #3A, which is the same JS just 600’ upstream of culvert #1. I measured
70 LF beyond where we were already permitted to do the original upstream
improvements for additional impacts to construct this detail.
I have included pictures of detail #14, the class 1 lined stream for site 3 &3A, the
head cutting/scouring at Culvert #1 and you will see where the scouring is
currently resting up against a 4” lateral sewer clean out pipe, and roadway sheet
#8 where detail 14 came from and was used. If there are any additional questions
