The City of Greensboro proposes to improve the intersection of Battleground Avenue and Westridge Road (TIP U-5306B) in Guilford County (Figure 1). The following Natural Resources Technical Report (NRTR) has been prepared to assist in the preparation of a Categorical Exclusion (CE) for the proposed project. 2.0 METHODOLOGY AND QUALIFICATIONS All work was conducted in accordance with the NCDOT Natural Environment Unit standard operating procedures and July 2012 NRTR template. Field work was conducted on August 27, 2014. No jurisdictional areas (i.e. wetlands, streams or Waters of the US) were identified in the study area. November 2014 Natural Resources Technical Report TIP U-5306B, Guilford County, N.C. 3.0 PHYSICAL RESOURCES The study area lies in the piedmont physiographic region of North Carolina (Figure 2). Topography in the project vicinity is comprised of gently rolling hills with moderately steep slopes along drainageways. Elevations in the study area range from approXimately 920 to 880 ft. above sea level. Land use in the project vicinity consists primarily of commercial development, interspersed with single-family residential lots. 3.1 Soils The Guilfard County Soil Survey identifies one soil type within the study area (Table 1). Table 1. Soils in the study area Soil Series Ma in Unit Draina e Class H dric Status Cecil sand loam Cc Well Drained Nonh dric 3.2 Water Resources Water resources in the study area are part of the Cape Fear River basin [U.S. Geological Survey (USGS) Hydrologic Unit 03030002]. No jurisdictional water resources were identified in the study area (Figure 3). There are no designated anadromous fish waters or Primary Nursery Areas (PNA) present in the study area. There are no designated High Quality Waters (HQW) or Outstanding Resource Waters (ORW) or water supply watersheds (WS-I or WS-II) within 1.0 mile downstream of the study area. Horsepen Creek (Class WS-III, NSW) is located approximately 1.2 miles downstream from the study area. Horsepen Creek (Stream IndeX: 16-11-5-(2)) is located 1.2 miles downstream of the study area, and is classiiied in the Fina12012 303(d) list for "fair" bioclassification. Therefore, there are no streams within the study area or within one-mile downstream of the study area identiiied on the North Carolina 2012 Fina1303(d) list of impaired waters. 4.0 BIOTIC RESOURCES 4.1 Terrestrial Communities One terrestrial community was identified in the study area: maintained/disturbed. Figure 4 shows the location and extent of this terrestrial community in the study area. A brief description of each community type follows. Scientific names of all species identified are included in Appendix B. 2 November 2014 Natural Resources Technical Report TIP U-5306B, Guilford County, N.C. 4.1.1 MaintainedlDisturbed The entire study area consists of the maintained/disturbed community. Within this community, there are areas which have been landscaped (signage, medians, lawns, etc.) and areas that are regularly cleared for utility maintenance. Typical herbaceous vegetation in this community includes fescue, Bermuda grass, clover, daylily, and common lirope. Woody vegetation includes red maple, silver maple, crepe myrtle, rhododendron, live oak, white oak, pin oak, river birch, wild cherry, Nellie Stevens holly, butterfly bush, magnolia, camellia, azalea, dogwood, blackberry, sweet gum, red maple, hickory, tulip poplar, persimmon, American elm, winged elm, red bud, and pokeberry. 4.1.2 Terrestrial Community Impacts Based on the design, the entire 12.4 acres of maintained/disturbed terrestrial community present in the study area will be impacted by project construction. Maintained/ Disturbed 12.4 Total 12.4 4.2 Terrestrial Wildlife The terrestrial community in the study area is comprised of disturbed and maintained habitats that may support a diversity of wildlife species (those species actually observed are indicated with *). Mammal species that would commonly exploit a maintained and disturbed habitat include species such as raccoon, Virginia opossum, common mouse, gray squirrel*, and eastern cottontail. Birds that may be found in the study area include the American crow, eastern bluebird, northern mockingbird, mourning dove, red-headed woodpecker, barrel owl, and yellow warbler. Reptile and amphibian species that may use terrestrial communities located in the study area include the copperhead snake, black rat snake, black racer, and American toad. 4.3 Aquatic Communities There are no aquatic communities present within the study area. 4.4 Invasive Species Nine species from the NCDOT Invasive Exotic Plant List for North Carolina were found to occur in the study area. The species identified were Chinese privet (Threat), lespedeza (Threat), mimosa (Moderate Threat), English ivy (Moderate Threat), Japanese November 2014 Natural Resources Technical Report TIP U-5306B, Guilford Counry, N.C. honeysuckle (Moderate Threat), wisteria (Moderate Threat), Bradford pear (Watch List), nandina (Watch List), and periwinkle (Watch List). The City of Greensboro, NC will manage invasive plant species as appropriate. 5.0 JURISDICTIONAL ISSUES 5.1 Clean Water Act Waters of the U.S. No jurisdictional features (i.e. wetlands, streams or Waters of the US) were identified within the study area. 5.2 Clean Water Act Permits Pending USACE concurrence that there are no jurisdictional features present within the study area, no permit will be required under Sections 404 & 401 of the Clean Water Act for this project. 5.3 Coastal Area Management Act Areas of Environmental Concern Guilford County is not under the jurisdiction of the Coastal Area Management Act (CAMA) and no Areas of Environmental Concern (AEC) occur in the study area. 5.4 Construction Moratoria No construction moratoria apply to any waters in the study area. 5.5 N.C. River Basin Buffer Rules Pending NCDWR concurrence that there are no streams subject to the NCDWR Jordan Lake Riparian Buffer Rules within the study area, the project will not result in impacts to regulated Jordan Lake riparian buffers. 5.6 Rivers and Harbors Act Section 10 Navigable Waters No waters designated by the USACE as Navigable Water under Section 10 of the Rivers and Harbors Act are present within the study area. 4 November 2014 Natural Resources Technical Report TIP U-5306B, Guilford County, N.C. 5.7 Wetland and Stream Mitigation 5.7.1 Avoidance and Minimization of Impacts There are no jurisdictional areas (wetlands, streams, or Waters of the US) within the study area. In addition, the proposed improvements will be constructed within the current NCDOT right-of-way and existing pavement surface wherever possible. All other proposed activities will occur within currently maintained/disturbed areas. 5.7.2 Compensatory Mitigation of Impacts Since the project will not require impacts to jurisdictional waters, compensatory mitigation will not be required. 5.8 Endangered Species Act Protected Species As of September 22, 2014 the United States Fish and Wildlife (USFWS) lists one federally protected species for Guilford County (Table 3). A brief description of each species' habitat requirements follows, along with the Biological Conclusion rendered based on survey results in the study area. Habitat requirements for each species are based on the current best available information from referenced literature and/or USFWS. Table 3. Federally protected species listed for Guilford County. Scientific Name Common Name Federal Habitat Biological Status Present Conclusion Isot�ia inedeoloides Small whorled pogonia T Yes No Effect T - Threatened Small whorled pogonia USFWS optimal survey window: Mid-May through Early July Habitat Description: Small whorled pogonia occurs in young as well as maturing (second to third successional growth) mixed-deciduous or mixed-deciduous/coniferous forests. It does not appear to exhibit strong affinities for a particular aspect, soil type, or underlying geologic substrate. In North Carolina, the perennial orchid is typically found in open, dry deciduous woods and is often associated with white pine and rhododendron. The species may also be found on dry, rocky, wooded slopes; moist slopes; ravines lacking stream channels; or slope bases near braided channels of vernal streams. The orchid, often limited by shade, requires small light gaps or canopy breaks, and typically grows under canopies that are relatively open or near features like logging roads or streams that create long-persisting breaks in the forest canopy. 5 November 2014 Natural Resources Technical Report TIP U-5306B, Guilford Counry, N.C. Biological Conclusion: No Effect Marginal habitat for Small whorled pogonia is present in the study area along roadside shoulders and utility easements. Pedestrian surveys were conducted throughout areas of marginal habitat on August 27, 2014. No individuals of Small whorled pogonia were observed. A review of NCNHP GIS records, received on August 26, 2014, indicates no known occurrences within 2.0 miles of the study area. Based on the results of the survey, lack of nearby records and minimal impact to natural areas anticipated for this project, it has been determined that the project will have no effect on any Small whorled pogonia populations. 5.9 Bald Eagle and Golden Eagle Protection Act Habitat for the bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. A desktop-GIS assessment of the project study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits, was performed on August 26, 2014 using 2013 color aerials. No water bodies large enough or sufficiently open to be considered potential feeding sources were identifed. Since there was no foraging habitat within the review area, a survey of the project study area and the area within 660 feet of the project limits was not conducted. Additionally, a review of the NCNHP GIS data, received on August 26, 2014, identified no known occurrences of this species within 1.0 miles of the project study area. Due to the lack of habitat, lack of nearby records and minimal impact to natural areas anticipated for this project, it has been determined that this project will not affect this species. 5.10 Endangered Species Act Candidate Species As of September 22, 2014, there are no Candidate species listed for Guilford County; however, the Northern Long-eared Bat is listed as a Proposed species for Guilford County. The listing determination will be published on or before Apri12, 2015. If the Northern Long-eared Bat is listed as Endangered, and if the project involves tree clearing (greater than 3 inches in diameter) or structure demolition (bridges or buildings), then the City of Greensboro will provide the appropriate information to NCDOT's Natural Environment Section to facilitate their coordination with the US Fish and Wildlife Service. 5.11 Essential Fish Habitat No designated Essential Fish Habitat occurs in the study area. 6 November 2014 Natural Resources Technical Report TIP U-5306B, Guilford Counry, N.C. 6.0 REFERENCES Environmental Laboratory. 1987.
