The Subject application has been reviewed for water quality
impacts and the following comments are offered:
a) The proposed dock presents some concern as to the
potential for adverse effects upon water quality and
associated uses. This area of Brown's Creek already has
two other ten slip docks one of which is located within
one quarter mile of the proposed dock. Multiple docks
located along this creek, which is open shellfishing
waters and a primary nursery area might be expected to
eventually result in water quality degradation,
potential shellfish closures, and loss of water quality
related uses should this type development continue to
occur.
b) While specific violations of water quality standards
cannot be projected for this application, we have
concern for the cumulative impacts of this type
development in important areas like Brown's Creek.
Resource agencies need to coordinate on the proper
approach to evaluate these small boat dock projects in
light of authority recently given to DCM for cumulative
impact considerations. A meeting has been scheduled for
later this month.

9. NARRATIVE DESCRIPTION: The applicant's property is a 121
acre tract of land which has been subdivided into 27 lots
ranging from 1.5 to 5 acres. The subdivision, water's Edge,
is a wooded tract with an existing logging road but no other
development. The property is located off SR 1321 (Straight
Road) with the subdivision entrance being a dirt road
approximately 1/4 mile north of the Fork Point Road
Subdivision. Water's Edge Subdivision is located on Brown's
Creek, near Merritt, in Pamlico County.
The applicant's proposed project is a 6' wide x 140' long
pier with ten (10) 15' x 30' slips. The docks will serve as
a community pier for non-waterfront lots in the subdivision.
Water depths at the end of the pier are approximately -4' to
-42' NWL. The creek is approximately 445' wide and the pier
is 140' long or 31.5% the width of the creek.
10. ANTICIPATED IMPACTS: The waters of Brown's Creek are open
to shellfishing by the Division of Health Service and
Division of Marine Fisheries, classified as 'SA' by the
Division of Environmental Management, and designated as -a
Primary Nursery Area by the Division of Marine Fisheries.
The proposed pier and slips will occupy 5340 sq. ft. of
public trust waters.
The two (2) existing ten (10) slip community docks are
already on the creek.
