Per my conversation with Charles Jones on March 15, 1989, concerning
the most recent request for modification to subject permit, I submit
the attached replacement working plats.
Due to delays in obtaining approval of the permit modification, we
were forced to direct our contractor to install the sheetpile as ori-
ginally permitted in order to avoid substantial delay costs. In order
for the work to be completed in accordance with the permit modification
dated February 28, 1989, approximately 90' of sheetpile must be pulled
and relocated. This will require increased expenditure of State appro-
priations.
In order to minimize costs we are revising the request for modification
to include driving sheetpile north to a distance approximately 120' south
of the trestle at which point it will turn towards the west as shown on
the attached working plats. Note that the toe of the rip rap dike will
remain a minimum of 70' south of the trestle. In order to avoid further
delay, no additional modifications have been made to the stormwater
management plan.
I request that you include these revisions in the request for modifi-
cation and continue processing accordingly. By copy of this letter, I

This office has received a request to consider a modification to
the subject permit which was issued last September. The permit, as you
will recall, authorized major upgrading on the east side of the terminal.
Bulkhead backfill was understood to be scheduled after all sheet
pile and riprap had been installed. That concept was permitted. The
attached request explains the need for a phased type of fill to facilitate
installation of bulkhead tie-backs, etc. Please review the attached and
submit recommendations on the requested change as early as possible, prefer-
ably by January 31. A verbal initial response would be helpful.

Dear Mr. Parker:
'This letter constitutes a request for revision to subject permit. The
North Carolina State Ports Authority requests that the permit be revised to
allow for placement of fill material directly behind the new bulkhead as
illustrated in Exhibit A prior to the completion of the dike. The placement of
this fill material is required prior to the construction of the tie back
system. We have programmed the construction of the dike in the next phase of
--..his project which includes the dredging and filling aspect- of the project
(also included in this next phase is the construction of the mitigation
sites). If the dike is required to be constructed prior to any filling, the
current construction must be shut down to wait on the completion of the dike.
This delay will be significant and will require the dredging of the project to
be performed in a May-June time frame.
There are two options for constructing the dike. The first option is to
add the work to the existing contractors contract or to immediately bid the
next phase and to get that contractor on site. In order to get the next phase
underway (the latter option), we must follow state construction guidelines
which require that the project be advertised a minimum period and that
contracts be executed prior to the commencement of the construction
activities. A minimum time for advertising and award would be one month, and
the construction time for completion of the dike would be a minimum of one
month; therefore, the total time that construction would be delayed for this
option would be two months. Additionally, we can not guarantee that the low
bid contractor would begin immediately.
In order to add the work to the existing contract, we must execute a
change order which must be approved prior to commencement of the work. The
minimum amount of time required for this process would be two weeks, and once
again, the construction time would be one month; therefore, the total time of
delay would be one and one-half months.
Both of the above options require that the construction of the tie back
system be completed prior to dredging along the bulkhead. The time for
installation of the tie backs would be one and one-half months; therefore, the
minimum delay incurred for commencement of dredging would be three months which
would be the first of May.

An alternative to the above delays is to allow the fill material to be
placed as illustrated in Exhibit "A". The fill material would be confined by
-xhe bulkhead to prevent propagation into the harbor. The bulkhead creates a
cove where the material will be placed which shelters the fill from tidal
currents and wave attack. The installation of the silt curtain should confine
any turbidity resulting from the placement operations. The amount of flow
across the silt barrier should be minimal since the tributary area is the cove.
The contractor can not continue his work for placement of the tie backs
without placement of this fill; therefore, we request that this revision be
considered at your earliest convenience. We have discussed this alternative
with Charles Jones at the project site on 1/18/89 and with Cliff Winefordner of
the Corps of Engineers on this date. If you have any questions, please advise.

Dear Mr. Parker:

This letter constitutes a request for revision to subject permit and
withdrawal of the revision requested in my letter dated February 1, 1989. The
North Carolina State Ports Authority requests that the permit be revised to
allow for installation of a bulkhead wall to a point located approximately
ninety feet south of the centerline of the Beaufort-Morehead railroad trestle.
At such point the bulkhead would turn we-st and parallel the trestle for such
distance required to accommodate a transition to a rip rap dike that would
extend to the shoreline. We have revised the permit.drawings to reflect this
request which are provided in exhibit "A". Additionally, alternative methods
for placing fill on the project site within the bulkhead area is requested.
The two alternatives would be fill placed by hydraulic or mechanically placed
(by truck) methods. This lost request is for informative purpose only and not
a revision to subject permit since the permit did not specify the method for
placement of fill.
In reference to the revision, the installation details for the bulkhead
sheeting and tiebacks would be as previously submitted. The proposed dike that
would parallel the trestle would be of similar construction as the original
proposed dike that was oriented in a north/south direction except that the
depth of water at the dike would be less. The toe of the dike would match the
existing elevation in the east/west run; therefore, no dredging is required.
The storm drainage system has been modified to reflect the reduction in surface
area of the site. The outfalls for the existing storm drains would not be
altered and the outfall from the proposed storm drainage system would be
located at the proposed rock dike as indicated.-
The request for alternative methods for placement of fill is requested due
to the reduction of area to be reclaimed. This reduction reduces the benefits
of hydraulic placed fill since the volume of fill required compared to the cost
of setting up the discharge pipe and other miscellaneous work. Fill placed
mechanically (trucked in) would be clean sands obtained from alocal borrow
source.
