SUBJECT: Application for CAMA Permit
James Jones
Currituck County
The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. This proposed project does require a 401 Water
Quality Certification but does meet the
requirements for General Certification No. 1273
for discharge of liquid effluent from an upland
diked disposal area.
b. The basin is proposed-to be°dredged to 6'MLW
while the water depth outside the basin area is
-3' to -4'MLW. This dredge depth presents the
real potential for water quality problems and
potential standards violation due stagnant water
trapped in the lower portion of the dredged basin
which will not flush readily. Low dissolved
oxygen in the lower portion of the basin can be
expected to occur in these situations. If the
depth of dredging can be reduced to approximately
the depth outside the basin, these problems are
not expected to occur.
The permit should be conditioned or the application
revised by the applicant to limit the dredge depth to
-4'MLW. We realize that such a condition is difficult to
monitor, but it is important that this project not be
allowed to dredge the basin deeper.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Natural Resources and Community
Development hereby gives public notice as required by NCGS
113A-119(b) and 143-215 3(a)(1)(c) that JAMES B. JONES of
Waterlily, Currituck County, N.C. filed an application on
December 28, 1988, for a permit from the Division of Coastal
Management to develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management that
a discharge of fill material in project wetlands will not violate
applicable water quality standards.
According to said application JAMES B. JONES proposes to
maintenance excavate a 50' X 80' boat basin at his property
located off SR 1142, Waterlily, Currituck County, N.C.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
David R. Griffin, Division of Coastal Management, located at
Route 6, Box 203, Elizabeth City, N.C., (919) 264-3901, and/or
the office of Deborah Sawyer, Division of Environmental
Management, NRCD Regional Field Office, Washington, N.C., 27889.
The Division of Environmental Management proposes to take
final action on 'this water quality certification on or before
February 9, 1989. The issuance of the CAMA Major Development
permit and the Section 401 Certification may deviate from this
projected date depending upon the nature of the comments
submitted and subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. David Owens, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
January 30, 1989 for consideration in the CAMA permit decision,
and to Mr. Bill Mills, Division of Environmental Management, P.O.
Box 27687, Raleigh, N.C., 27611, prior to January 30, 1989 for
consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered
up to the time of permit decision. Project modifications may
occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter
will be provided upon request.

SUBJECT: MAJOR MODIFICATION REQUEST TO CAMA PERMIT #227-87
DATE.: January 6, 1989
This office has received a request to modify CAMA permit
#227-87 issued to James B. Jones on 11/23/87. This permit
authorized the construction of a 150' long jetty adjacent a boat
basin off SR 1142 in Waterlily, Currituck County, Currituck
Sound..
The permit holder has completed the construction of the
jetty, but now desires to maintenance excavate the 50' by 80'
basin. Dead milfoil has collected in the basin and presents
problems for area fishermen utilizing the basin. The permit
holder seeks to excavate by dragline the 50' X 80' basin to a
depth of-61 MLW. Existing depths (as taken by permit holder)
range from 2' to 3.5' within the basin. The water depths
immediately outside the basin are 3' to 41. Waters of Currituck
.Sound are classified as "SC" by DEM. The proposed spoil material
will be placed in a truck and deposited on high ground on the
agricultural field across SR 1142 from the basin. The intent of
the excavation is to provide` uniform basin depth and to remove
the decaying milfoil trapped in the basin.
ANTICIPATED IMPACTS
The excavation of the basin to -6' MLW may create a basin in
which water quality may degrade. However, the extreme wave
action periodically present in Currituck Sound may serve to mix
and adequately flush the basin.
