Dear Mr. Norris:
The Wilmington Regional office received your CAMA application
on December 12, 1988. A preliminary review indicates that a 401
Water Quality Certification will be required from our division due
to the proposed wetland fill. A 401 certification is required
prior to issuance of a CAMA or 404 permit.
Because of the many essential functions wetlands provide, including
purification of surface and groundwater, any loss of wetlands as
the result of filling activities is viewed by this office as
degradation of water quality, and potentially, a loss of these
essential functions wetlands provide.
Your project, as proposed, will result in the loss of wetland
areas. As a result, this office is requesting the following
additional information be submitted within 30 days upon receipt of
this letter: an alternate proposal that will eliminate or reduce
the proposed fill in wetland areas; or submit an explanation of why
such reductions are not possible and what mitigating factors we
should consider to insure no net loss of wetlands within the
project area.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
a. The proposed project does require a 401 Water
Quality Certification.
b. The alignment shown in the original application
would allow an excessive amount of fill of
wetlands and would not have met requirements of
the General Certification for construction of
bulkheads.
C. The revised alignment as per Charles Jones'
January 30, 1989 memo would reduce the amount of
fill below MHW to conform to our General
Certification No. 1272 for construction of
bulkheads.

following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. The original bulkhead alignment would result in the loss of 260 square
feet of vegetated wetlands and 1,700 square feet of non-vegetated bottom
area. 123 cubic yards of fill below MHW was proposed with this
alignment.
3. If the new bulkhead alignment, as per your February 17, 1989 memo,
requires less than 1 cubic yards of fill per linear foot of bulkhead
below MHW and meets the other requirements of the General Certification,
this office would have no objection to the project.

8. PROJECT SUMMARY: The applicant is proposing to construct a house,
bulkhead, pier, and boat house at Lot 1-R, in the Waterway Haven
Subdivision, at the end of SR 1553 and adjacent to the AIWW,
Onslow County.

9. NARRATIVE DESCRIPTION: The applicant's property consists of
an approximately 11,500 sq. ft. lot located in Waterway
Haven Subdivision and adjacent to the AIWW, south of the
community of Sneads Ferry, in Onslow County. One could find
this property by taking a right hand turn at the stop sign
at the end of NCSR 1553, and then take a left at the next
stop sign. This property would be the first vacant lot on
the right hand side of the road.
Presently, this property is vacant and consists of a grass
yard area with several trees growing upon it. The
shoreline, as it abuts the AIWW, is severely eroded on the
east side with a vertical bank of approximately 31. This
bank area diminishes as you go towards the western property
line where there exists an approximate 20' long x 2' to 10'
wide border of Spartina alterniflora marsh. Landward of
this marsh, there exists an approximately 20' long x an
average of 8' wide border of Spartina patens. This marsh
has been somewhat impacted by sand overwash. The adjacent
property to the east is bulkheaded, while the area
immediately to the west is in its natural state. The
surface waters of the AIWW at this location are classified
as 'SA' and are open to the harvesting of shellfish.
The applicant is requesting a permit to construct an
approximately 100 ln. ft. bulkhead to stabilize his
shoreline property. This bulkhead would be a maximum
distance of 35' waterward of the MHW line on the east side
and approximately 10' waterward on the west side. The
proposed bulkhead would connect to an existing bulkhead on
the eastern side. The applicant is also proposing to
construct an approximately 55' long x 6' wide pier into the
water's adjacent to the AIWW. A portion of this pier would
be covered by a proposed 36' x 36' open sided boat house.
Water depths in this area are approximately -6' MLW deep.
The applicant is also proposing to construct an
approximately 46' x 46' two-story house on pilings with a
concrete driveway and parking area underneath the house. A
12' wide wooden deck is proposed to be constructed on the
waterward side of the house and would be a minimum distance
of approximately 70' from the new MHW line. Impervious
surfaces would be less than 30% within the estuarine
shoreline AEC: Sewage disposal for the residence is to be
provided by North Topsail Water & Sewer, Inc., with potable
water being supplied by the County's own water system.
10. ANTICIPATED IMPACTS: The project as proposed will result in
the filling in of approximately 1700 sq. ft. of bottom area
below the MHW line. Approximately 126 cu. yds. of upland

fill material will also be placed below the MHW line and
would be confined behind the proposed bulkhead.
Additionally, approximately 100 sq. ft. of Spartina
alterniflora marsh and 160 sq. ft. of Spartina patens marsh
would be filled by the proposed bulkhead project. The
proposed pier would extend into the water and towards the
channel of the AIWW for approximately 55' and, it would
appear to be slightly farther into the waterway than
adjacent pier structures. The residential dwelling would be
set back approximately 70' landward of the proposed bulkhead
and would be consistent with the standards for development
in the estuarine shoreline AEC.

A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.

have no objections to the issuance of this permit if the
bulkhead and pier are aligned to be consistent with CRC
regulations. 15 NCAC 7H .0208(b)(7)(D)(ii) does allow for
bulkheads to be aligned with adjacent bulkhead structures. This
would be permissible as proposed on the eastern end but the
bulkhead should terminate landward of the Spartina alterniflora
marsh on the western end. Also, the proposed pier and boat house
cannot extend farther waterward than the established pier length
line (15 NCAC 7H .0208[b][6][C][i]).
I therefore have no objections to the issuance of a permit with
the following conditions:
1. That the bulkhead be aligned consistent with the attached
plat (as revised on 1/30/89).
2. That all backfill material will be obtained from a
highground source and confined behind the permitted
bulkhead.
3. That the proposed pier and boat house must not extend any
farther waterward than the adjacent pier structure
immediately to the east of this property.
4. That the boat house will remain open-sided.
