Yost, the State of North Carolina hereby submits its list of potential witnesses and a brief summary of their expected testimony. 1. Steve W. Tedder - Chief, Water Quality Section, Division of Environmental Management (DEM). Mr. Tedder has been the Water Quality Section chief since February, 1989, and prior to that served as head of the Technical Services Branch. He received his B.S. degree (biology) in 1973 from Western Carolina University and has worked within the water quality program since January, 1974. He currently e -2- supervises the NPDES permitting, nondischarge permitting, modeling, monitoring, pretreatment, toxics, nonpoint source, and enforcement and compliance programs for the Section. In his various capacities, Mr. Tedder has been involved in all aspects of the administration of the State of North Carolina's NPDES program, including promulgation of water quality standards and setting of permit effluent limita- tions. As the current chief of the Water Quality Section, he will be called to testify on the application of state (North Carolina and Tennessee)' water quality standards to the permittee, the State of North Carolina's §401 Certifica- tion process, and the position of the State of North Carolina on the issuance of Permit No. N00000272 to Champion International by EPA. Mr. Tedder will examine the current permit and the challenged permit conditions from the State's perspective, to provide assurances that the permit will meet North Carolina requirements. He will also testify concern- ing the use of EPA Method 8290 for the measurement of dioxin. Mr. Tedder will certify and attest to DEM-related records which will be submitted for admission to the record, and will substantiate the various duties and responsibil- ities of the other DEM witnesses listed below. Mr. Tedder will offer factual opinion testimony in his official capacity as the Chief of the Water Quality Section, and will be tendered, by reason of his expertise, experience -3- and familiarity with the subject permit, as an expert in all aspects of water quality management and regulation -- including standards-setting, permitting, compliance and modeling. 2. Forrest R. Westall - Regional Water Quality Supervisor, Asheville Regional Office;'Division of Environ- mental Management. Mr. Westall graduated with a B.S. in Civil Engineering from North Carolina State University in 1975, and received his Masters of Civil Engineering from North Carolina State University in 1976. He is a registered professional engineer (N.C. Reg. #9033). He has been responsible for the state permitting aspects involving the Canton facility, including review and comment on the subject EPA-issued draft and final permit. Mr. Westall will testify as the primary State witness, and will provide the State's position on the challenged permit effluent limitations and conditions, including but not limited to those relating to color. With regard to the issues surrounding the color discharge limit, Mr. Westall will offer opinions on: (a) the color compliance monitoring point and schedule of compli- ance; (b) the use of the 30-day average in the color calcu- lation; (c) the model performance, and (d) the application of state (North Carolina and Tennessee) water quality standards to the permittee. He may also testify concerning the dioxin measurement methodology - Method 8290; and, if -4- necessary, will provide historical and record context for the issuance of the State NPDES permit for the Canton facility in May, 1985 and the State variance in July, 1988. Mr. Westall will offer factual and opinion testimony in his official capacity as the regional water quality supervi- sor and will be tendered, by reason of his expertise, experience and familiarity with the subject permit, as an expert in all aspects of water quality management and regulation--including standards-setting, permitting, compli- ance and modeling. 3. William E. Mills - Environmental Engineer, Divi- sion of Environmental Management. Mr. Mills received his B.S. in Civil Engineering from North Carolina State Univer- sity in 1968, and has been employed since graduation by the State of North Carolina. He is a registered professional engineer (N.C. Reg. #10437). His current duties with DEM include coordination of the Division's input to the Coastal Area Management Act review process, and coordination of the §401 Certification process. In that latter capacity, Mr. Mills was the official responsible for the State §401 Certification process, attendant to EPA's issuance of the subject permit. He will testify to the procedural and substantive review concerning the §401 Certification, which culminated in the issuance of the certification on September 8, 1989. -5- Mr. Mills will offer factual and opinion testimony in his official capacity and will be tendered, by reason of his expertise, experience and familiarity with the subject permit, as an expert in water quality management and regu- lation -- including §401 Certifications. 4. J. Trevor Clements - Assistant Water Quality Section Chief, Division of Environmental Management. Mr. Clements has been in this position since May, 1989, and prior to that served as the environmental modeling supervisor within DEM. He received a B.A. (political science; environmental studies concentration) from Augustana College, Rock Island, Illinois, in May, 1982; and a Master of Environmental Management from Duke University in May, 1983. He has worked within DEM since August, 1983, and currently manages the Technical Support Branch which is responsible for analyzing surface water quality, simulating system responses to management and establishment of NPDES permit requirements. Mr. Clements has been involved in the development and review of appropriate NPDES permit limits and the various color compliance models for the Canton facility, including those at issue. He will offer testimony concerning the application of state (North Carolina and Tennessee) water quality standards to the permittee, the establishment and validity of the various color unit calculations made -6- heretofore, and the color model performance. He will also testify concerning the dioxin measurement methodology - Method 8290. Salisbury St. Raleigh, North Carolina 27611 919-733-7015 Current duties and responsibilities are coordination of the 401 Water Quality Certification process for the Division's Water Quality Section and coordination of the Division's input to the CAMA major permit review process for coastal development projects. Also, I provide coordination at the administrative offices for water quality input into RCRA permit process, solid waste permit process, and the Environmental Certification for Industrial Revenue Bonds and Pollution Control Bonds. I have had these duties and responsibilities since 1985. During the period of 1982 to 1985, I held the,position of Supervisor of the Permits and Engineering Unit in the Water Quality Section. In that capacity I supervised the review and issuance of the NPDES permits for the State and the review and issuance of the Non-Discharge Permits for the State. From the period of 1975 to 1982, I was the Supervisor of the NPDES Group of the Permits and Engineering Unit. During the period of 1968 to 1975 I was a Regional Engineer for the Water Quality Section in the eastern and the central portions of the State. Regional Engineers are generally responsible for all the field activity in their area including permitting, compliance, environmental emergencies, and complaint investigations. I hold a Bachelor of Science Degree from North Carolina State University in Civil Engineering. (1968). I am a registered Professional Engineer in North Carolina, P.E. 10437. I have had 22 years of experience working with discharge permits in North Carolina. This includes experience from a field engineer perspective, experience from the standpoint of supervisor of discharge permits, and from the standpoint of Section 401 Water Quality Certifications for all of the NPDES permits issued by EPA in North Carolina since the NPDES permit program was created. + I was not involved with the State NPDES permit issued in 1985. This permit was being issued as I left the role of Supervisor of Permits and Engineering. I was not involved in the variance proceeding in 1988. As coordinator of the 401 Certification process, I processed the requests from EPA for Certification of the draft EPA permits (one in 1988 and twoin 1989). In this regard I acknowledge receipt of the requests to EPA. Prepare and issued Public Notice of the request as required in 15A NCAC 2H .0500, solicited review comments from Section personnel with respect to their role in the Water Quality Standards and Permitting functions of the program, and drafted Certification documents for the Division Director's consideration. With regard to the Certification of the last EPA draft permit, the request was received from Mr. Marlar on July 12, 1989. The request included the draft permit and supporting material. I was sent the request by the Section Chief with instructions to proceed with review and certification. Also I was advised to send copies of the request to the regional office, the permits office, Trevor Clements and to the Section Chief (Steve Tedder). I prepared a Public Notice soliciting public comment on the requested certification on July 20, 1989, and mailed that notice to the Asheville Citizen and Times newspaper for publication. I also sent copies of the public notice to the Environmental Mailing List of the Section, the mayors of Asheville and Canton, Campion International, Chairman of the County Commissioners for Haywood County, and to several Division personnel for their information.. Isent a memorandum to Trevor 'Clements, Dennis Ramsey, and Forrest Westall on July 20, 1989, transmitting copies of the request for certification, draft permit and supporting documents and requesting their review and comments. I received comments from Clements, Ramsey, and Westall. by memoranda in August and September, 1989. Using the input from these staff members and based upon discussions with Steve Tedder, I drafted a certification letter on September 6, 1989. This draft letter was reviewed by Clements, Ramsey and Westall and appropriate changed incorporated in a final letter dated September 8, 1989. This final letter of certification was reviewed my immediate supervisor, the Assistant Chief for Planning, the Section Chief, and the Deputy Director who signed the Certification letter for the Division Director. The letter of Certification was mailed to Mr. Marlar and copies were sent to Steve Tedder, Forrest Westall, and Champion International. The Water Quality Section of DEM was the only section involved in the review of the requested certification. Final action on the requested Certification was taken on September 8, 1989, by the signing and mailing of the letter of certification to Mr. Marlar at EPA. With respect to the issues raised by the Dead Pigeon River Council, Mr. Marlar's expected testimony is as follows: 1) The effluent limits in the permit will assure compliance with the Tennessee water quality standard for color. Based on the data available at the time of permit issuance, as well as data that have become available since the permit issuance, it is reasonable to assume that the color calculation provides an 44 1, h - 2 - accurate prediction of the color in the river at the state line. Additionally, the permit contains a reopener clause (Part III.B) which allows the modification of the color calculation to insure that it will accurately predict the color levels at the state line. 2) The compliance schedule for meeting the color limitation is reasonable. The compliance schedule was based on the construction required to reconfigure the mill to the oxygen delignification process to meet the color limitations imposed for the first time in this permit. The permit at Part I, Page I-6, B. requires status reports every six months beginning six months after the effective date. The first status report must include a detailed description and schedule for the proposed reconfiguration of the Champion mill. This schedule must include the identification of major milestones and estimated improvement in effluent quality. 3) 40 C.F.R.S125.3(f) allows the use of "non-treatment" techniques such as in-stream oxygen injection to achieve water quality standards if certain criteria are met. The Region determined that those criteria were met; therefore, it properly allowed in-stream oxygen injection at the outfall structure, at 0.9 miles downstream of the discharge, and at 2.1 miles downstream of the discharge to maintain the water quality standard for. dissolved oxygen. 4) EPA properly did not include a water-quality based - 3 - effluent limit for total suspended solids because there is no water quality standard in North Carolina or Tennessee for total suspended solids. The Region has reached agreement with the permittee on the following conditions, and therefore the Region does not expect to present testimony on the issue of the reasonableness of these conditions. The Chlorine and Effluent Suspended Solids Minimization conditions have been effectively replaced by the .Dioxin Control Plan that was approved by the Region on April 4, 1990. On June 8, 1990, the Region approved the alternate method for analyzing dioxin submitted by the permittee. (See attachments). With respect to the other factual issues raised by the permittee, Mr. Marlar's expected testimony is as follows: 1) The Region reasonably interpreted the State of Tennessee's water quality standard for color based upon the State of Tennessee's interpretation and other documentation., The above-described proposed witness list and expected testimony is submitted based upon the Region's knowledge at this time, however, the Region respectfully reserves the right to supplement this document if necessary. The permit uses a "floating" effluent limit based on river flow, which is unprecedented. Use of monthly average ignores requirement for daily maximums, at 40 CFR Section 122.45(d), and unfairly assists Champion in compliance. (See their calculations at Petition p. 6-0 C) The compliance schedule should be shortened and should have interim requirements, 40 CFR Section 122.47. BOD and - Champion has not complied with 40 CFR DO Section 125.3(f), and should not be allowed to use a "non-treatment technique" TSS - The segment is water-quality limited for suspended solids (Pigeon River Investiga- tion, DEM, 10/79). Also, I provide coordination at the administrative offices for water quality input into RCRA permit process, solid waste permit process, and the Environmental Certification for Industrial Revenue Bonds and Pollution Control Bonds. I have had these duties and respondsibilities since 1985. During the period of 1982 to 1985, I held the position of Supervisor of the Permits and Engineering Unit in the Water Quality Section. In that capacity I supervised the review and issuance of the NPDES permits for the State and the review and issuance of the Non-Discharge Permits for the State. From the period of 1975 to 1982, I was the Supervisor of the NPDES Group of the Permits and Engineering Unit. During the period of 1968 to 1975 I was a Regional Engineer for the Water Quality Section in the eastern and the central portions of the State. Regional Engineers are generally respondsible for all the field activity in their area including permitting, compliance, environmental emergencies, and complaint investigations. I hold a Batchelor of Science Degree from North Carolina State University in Civil Engineering. (1968). I am a registered Professional Engineer in North Carolina, P.E. 10437. I have had 22 years of experience working with discharge permits in North Carolina. This includes experience from a field engineer perspective, experience from the standpoint of supervisor of discharge permits, and from the standpoint of Section 401 Water Quality Certifications for all of the NPDES permits issued by EPA in North Carolina since the NPDES permit program was created. I was not involved with the State NPDES permit issued in 1985. This permit was being issued as I left the role of Supervisor of Permits and Engineering. I was not involved in the variance proceeding in 1988. As coordinator of the 401 Certification process, I processed the requests from EPA for Certification of the draft EPA permits tone in 1988 and two in 1989). In this regard I acknowledge receipt of the requests to EPA. Prepare and issued Public Notice of the request as required in 15A NCAC 2H .0500, solicited review comments from Section personnel with respect to their role in the Water Quality Standards and Permitting functions of the program, and drafted Certification documents for the Division Director's consideration. With regard to the Certification of the last EPA draft permit, the request was received from Mr. Marlar on July 12, 1989. The request included the draft permit and supporting material. I was sent the request by the Section Chief with instructions to proceed with review and certification. Also I was advised to send copies of the request to the regional office, the permits office, Trevor Clements and to the Section Chief (Steve Tedder). I prepared a Public Notice soliciting public comment on the requested certification on July 20, 1989, and mailed that notice to the Asheville Citizen and Times newspaper for publication. I also sent copies of the public notice to the Environmental Mailing List of the Section, the mayors of Asheville and Canton, Champion International, Chairman of the County Commissioners for Haywood County, and to several Division personnel for their information. I sent a memorandum to Trevor Clements, Dennis Ramsey, and Forrest Westall on July 20, 1989, transmitting copies of the request for certification, draft permit and supporting documents and requesting their review and comments. I-received comments from Clements, Ramsey, and Westall by memoranda in August and September, 1989. Using the input from these staff members and based upon discussions with Steve Tedder, I drafted a certification letter on September 5, 1989. This draft letter was reviewed by Clements, Ramsey and Westall and appropriate changed incorporated in a final letter dated September 8, 1989. This final letter of certification was reviewed my immediate supervisor, the Assistant Chief for Planning, the Section Chief, and the Deputy Director who signed the Certification letter for the Division Director. The letter of Certification was mailed to Mr. Marlar and copies were sent to Steve Tedder, Forrest Westall, and Champion International. The Water Quality Section of DEM was the only section involved in the review of the requested certification. Final action on the requested Certification was taken on September 8, 1989, by the signing and mailing of the letter of certification to Mr. Marlar at EPA. 401 Certification - Champion NPDES Permit Chronology July 12, 1989 - Application received from EPA (Marlar) requesting 401 for draft NPDES Permit. EPA has required daily sampling for many parameters in the permit. The DEM regulations define daily as every day on which a discharge occurs except weekends and legal holidays. Does EPA mean seven days a week or are they using the DEM definition? 3. There is no language in the permit that defines instream samples as grab samples. Based on the way the permit is written, the stream samples for BOD5, COD, and Hardness are interpreted as composite samples. The DEM has never required these samples to be collected as composites in the stream. It can also be interpreted that BOD5, Dissolved Oxygen, Temperature, pH, and Hardness must be collected on a daily basis instream. 4. The DRAFT permit contains monitoring for trichlorophenols and penta- chlorophenols on a quarterly basis. The Fact Sheet states that the limit was placed in the permit based on the permit issued by the DEM on May 14, 1985. EPA has never honored the permit issued by the DEM, and it does not seem practical to honor the permit now and require monitoring that seems to be useless. The draft permit has been _modif ied based on - review of all comments received rt during the previous public comment periods. The revised draft permit and supporting materials are enclosed with this letter. We have interpreted North Carolina water quality standards to establish effluent limitations and permit conditions in the draft permit. The draft permit also incorporates the requirements of the permit issued by the State on May 14, 1985, and the requirements of the previous State water quality certifications dated February 5, 1988, and May 15, 1989. The limits for color in the draft permit are based on the revised North Carolina and the existing Tennessee water quality criteria for instream color. EPA approved the revision to North Carolina water quality standards on August 11, 1988. In accordance with Section 401 of the Clean Water Act (33 U.S.C. 1251) and the NPDES regulations (40 C.F.R. 124.53), state certifications must be in writing and must include: (1) Conditions which are necessary to assure compliance with the applicable provisions of Clean Water Sections 208(e), 301, 302, 303, 306, and 307 and with appropriate requirements of State law; 1 s.. -2- (2) Any conditions more stringent than those in the draft permit which the State finds necessary to meet the requirements listed in paragraph (1) above. For each more stringent condition, the Clean Water Act or State law references upon which that condition is based must be cited. Failure to provide such a citation waives the right to certify with respect to that condition; and (3) A statement of the extent to which each condition of the draft permit can be made less stringent without violating the requirements of State law, including water quality standards. Failure to provide this statement for any condition waives the right to certify or object to any less stringent condition which may be established during the EPA permit issuance process. In accordance with 40 C.F.R. 124.53(c), EPA cannot issue or deny NPDES`permits until the state haseither granted or denied certification, or waived its right to certify. The State will be deemed to have waived its right to certify unless that right is exercised within 60 days from the mailing of this letter. EPA anticipates that in some cases certification cannot be provided within 60 days. Therefore, if a longer time is needed, please request an extension of time in writing setting out the nature of the delay and anticipated date when certifi- cation will be completed.
