The project, as proposed, would require a 401 Water Quality Certification. b. The proposed areas of wetlands and other waters to be filled by the boat ramp are excessive. Such extensive filling and the proximity of the fill to shellfishing waters would degrade the existing shellfishing use of these waters. This existing filling should not be allowed and the Certification is likely to be denied. If the applicant should reduce the amount of filling below mean high water to that area allowed by our General Certification for boat ramps, 300 square feet below mean high water, we would not object to the permit. Please advise us concerning any change in design or proposed permit restrictions on the area to be filled. We plan to withhold any final action on the Certification denial pending possible design changes. PROJECT SUMMARY: The applicant is proposing to construct a boat ramp & adjacent pier into Charles Creek, to relocate & extend a previously permitted pier, and to construct 2 piers on a canal which enters Charles Creek, at Escobo Bay Subdivision, located adjacent to NCSR's 1518 & 1520, near the community of Sneads Ferry, in Onslow County. 9. NARRATIVE DESCRIPTION: The applicant received a CAMA Major Permit (#78-88) which authorized the construction of roadways, gazebos, and a pier which were to service a 242 lot subdivision, known as 'Escoba Bay'. This subdivision is located adjacent to NCSR's 1518 & 1520, and Charles Creek, east of the community of Sneads Ferry, Onslow County. Development in Phases 1, 2 and 3 have been initiated and is continuing along at the present time. The applicant is now, however, requesting a permit modification which would allow the following: (1) Construction of a parking lot, boat ramp and adjacent pier; (2) Relocation and extension of a previously permitted pier; (3) Deletion of three (3) gazebos; and, (4) Construction of two (2) "common area" docks. The proposed boat ramp is to be located along the southern property line and will consist of an approximately 100' long x 20' wide concrete and shell boat ramp. An approximately 50' section of this boat ramp would be located below the MHW line of Charles Creek and would be constructed of shell material (such as oyster and clam shells). The proposed concrete boat ramp would cause the filling of an approximately 101-15' long x 20' wide border of wetlands consisting of sea oxye, iva frutescens, cedar, Spartina patens and yaupon. An approximately 200' long pier is also proposed to be constructed adjacent to this ramp and will provide temporary tie-ups. The proposed pier and boat ramp are to be located in shallow water (-1' MLW) and will be in close proximity to a shellfish lease (#564). Additionally, scattered oysters were observed along the boat ramp location. Upland development will consist of an approximately 1.07 ac. asphalt parking lot and access drive, and an approximately 42,000 sq. ft. grassed parking area for overflow traffic. Stormwater from these upland improvements are proposed to be contained by grass swell and diversion berms. An approximately 80' long (total) by 6' wide pedestrian pier with gazebo was permitted under the original permit at a FIELD INVESTIGATION REPORT - CEPCO, INC., ONSLOW COUNTY PAGE #3 location just north of the proposed boat ramp. This pier was to have extended into Charles Creek for a distance of approximately 501. The applicant is now requesting permission to move this pier approximately 300' to the north and to extend the pier further into Charles Creek for a maximum distance of 1201. An approximately 240 sq. ft. open-sided gazebo is to be constructed at the end of this pier. The applicant is also proposing to construct two (2) "common area" docks which will be used by the property owners in the subdivision. The proposed 4' wide docks will be located adjacent to a man-made canal which is approximately 15' wide and appears to have approximately -3' of water in the center of the canal at low tide. Total lengths of these two (2) piers will be 2501. 10. ANTICIPATED IMPACTS: The boat ramp, as proposed, will result in the filling in of approximately 1,000 sq. ft. of intertidal and shallow water habitat area with o ster and clam shells, and approximately 250 sq. ft. of wetlands area will be filled in with concrete. Approximately 1 ac. of upland land area will be asphalted and an additional 1 ac. will be maintained as a gra lawn area and available for overflow parking. The applicant is proposing to incorporate grasse swe s and diversion berms to handle stormwater runoff from the parking lot area. The proposed boat ramp and pier will be in close proximity to a shellfish lease, and the lessee has expressed concerns about potential turbidity impacts on adjacent shellfish resources. Additionally, a scattered amount of oysters will be impacted by the proposed boat ramp but, relocation of these resources would be quite easy. As previously mentioned, Charles Creek is a Primary Nursery Area and is opened to the harvesting of shellfish. The pedestrian pier is proposed to be extended into Charles Creek to a distance almost triple what was permitted.
