Your letter concerning proposed wastewater treatment
facilities for the Broad Reach Development was received October
5, 1989, accompanied by site plans and additional information.
The submittal indicates that a tertiary treatment plant with low
pressure pipe subsurface disposal is to be installed, with a
design capacity of 171,880 GPD. Based on a design application
rate of 0.5 GPD/sq. ft. approximately 16 acres of suitable land
would be required for disposal field construction and repair
area.
Sheet 1 of the plans indicates placement of a disposal
system within Parcel F plus an additional 12 acre "reserve area"
in Parcel D. Based on the recommendations contained in the
attached soil scientists report it appears that there may be
sufficient suitable land for installation of a system within
these parcels. Please be advised, however, that the minimum
setback from property lines is 50 feet and not 20 feet as
specified on the plans. Further evaluation of the site may
indicate that setbacks in excess of 50 feet are required.

Additional information will also be required in order to
determine the suitability of the site. A hydrogeologic and soils
description of the subsurface to a depth of 20 feet is required.
The number of borings shall be sufficient to determine
significant changes in lithology underlying the site, the
vertical permeability of the unsaturated zone and the hydraulic
conductivity of the saturated zone and the depth to the mean
seasonal high water table. A determination of transmisivity and
specific yield of the unconfined aquifer based on withdrawal or
recharge tests will also be required. If the lithology is
determined to be similar to the site where pump tests were done
to support the stormwater application, then this data may be
used.
In order to support a permit application for the proposed
project, complete plans and specifications must be submitted as
well as a check in the amount of $250 for the processing fee.

I spoke with John Parker NCDCM today concerning the Broad
Reach CAMA permit request. He asked that I contact you
regarding the proposed wastewater collection and disposal
system for the project. Please be advised that the applicant
plans to operate the wastewater system as a public utility
and will seek a wastewater discharge permit from NCDEM once
final utility construction drawings are prepared for the
project.
I have enclosed for your review a number of documents which
may be helpful. Of particular relevance is the April 5, 1989
field soil investigation by a certified professional Soil
Scientist which recommends wastewater loading rates.for the
soils designated for wastewater disposal.

We have completed our review of the Subject application for
potential water quality impacts and the following comments are
offered:
a. The proposed project will require a Water Quality
Certification but does meet the requirements of General
Certifications Nos. 1273 and 1431 for discharge of liquid
effluent from a diked disposal area resulting from
hydraulic dredging and for placement of fill from
construction of boat ramps, respectively.
b. The proposed project construction should be done in such
a way as to not cause turbidity outside of the immediate
construction area to exceed 25 NTU. An earthen plug
should be maintained in the channel during excavation of
the basin and the majority of the channel to minimize
turbidity impacts in adjacent waters.
c. The stormwater management plan for this project was
approved on September 8, 1989 in conformity with 15 NCAC
2.H .1000.
d. This Division has not received any specific information
on the wastewater disposal for this project. The
applicant has indicated that a tertiary treatment plant
with subsurface disposal would be provided. This type of
system must be permitted by DEM or DHS depending on
whether the owner of the system will be a public utility.

e. We would like to clarify our position on dredge and fill
activities in Outstanding Resource Waters (ORW) in light
of Todd Miller's letter of September 16, 1989 to you
regarding this permit modification. First, it should be
noted that while the ORW rules include an explicit
statement regarding dredge and fill activities, this
statement is a description of existing procedures for
handling dredge and fill activities in all coastal
waters. It was determined that these existing procedures
would be adequate to also protect ORWs, and they were
included in the rules to clarify this point, not to add
additional restrictions.
Second, we defer to the appropriate resource agency to
make the determination of whether "significant shellfish
or submerged aquatic vegetation bed resources" occur
where any new dredging is proposed. Obviously new
channels should be located to minimize their impacts to
existing resources, and it is the resource agency which
has the expertise to determine whether a channel location
can be found which has no significant impact.
Based on the above points, the modified permit would not
be inconsistent with the ORW rules if the resource
aaencies determine that the new channel location results
in equal or less impact to existing resources as the
original channel location. It should also be noted as
stated by Todd Miller, that the ORW rules for this area
are not anticipated to be effective until January 1,
1990.
To follow up on this last point, we would like to clarify
the procedure outlined by the Environmental Management
Commission (EMC) in addressing projects being reviewed
before an ORW designation takes place. The EMC adopted
Guidelines for the Designation of Outstanding Resource
Waters in Coastal North Carolina on July 14, 1989. These
guidelines state that "any permit application which has
been filed and accepted as complete by DEM or CRC prior
to the acceptance by the EMC of the designated body of
water as a candidate for ORW should continue to be
processed through the normal procedural channels. No
action may be taken by the EMC during the time that the
area is being formally considered that would preclude
designation of the proposed area as ORW". This area was
accepted by the EMC as a candidate for ORW on September
8, 1988. Therefore, complete applications received
before that date need not consider ORW requirements and
applications received after January 1, 1990 must conform
to the ORW requirements. Complete applications received

between the two dates may be processed and approved if
they would not jeopardize the ORW designation.
This Division, therefore, has no objection to this
modification requested unless: 1) The Division of
Environmental Health.determines that an automatic closure of
productive shellfishing areas would be required; or 2) the
Division of Marine Fisheries determines that the dredging of the
entrance channel would remove a significant shellfish resource.
If either of these occur this Division would object to issuance
of the modification.

quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.

concerning wastewater disposal. The proposed tertiary
package treatment plant with subsurface disposal would
require a either a State Non-discharge Permit issued by DEM
or a permit issued by the local health department or DHS.
The project was issued CAMA Permit No. 120-88 on June 29,
1988 for the the subdivision development and marina basin with
entrance channel along Alignment 'B' off Saunders Bay. With the
current application the channel would be constructed along the
alignment of Alternative 'A' off the AIWW. The new proposal
would reduce the direct impact on clam habitat from 66,000 sq.
ft. to 21,000 sq. ft. This office has no objection to this
modification request unless: 1) DHS determines that an automatic
closure of productive shellfish areas would be required; or 2)
DMF determines that the dredging of the entrance channel would
remove a significant shellfish resource. If either of these
occur this office would recommend denial of the project.

Please consider these comments in regard to Broad Reach's latest
application to modify its permit. Our comments regarding this
application include:
(1) Include by reference all our previous comments made in regard
to this project which are in earlier permit files;
(2) Include by reference all previous public and agency comments
in regard to this project which are in earlier permit files;
(3):. oject proposal violates new ORW regulations just adopted for
western Bogue Sound. Rule 15 NCAC 2B .0216(c)(2) now states
that "No dredge or fill activities will be allowed where
significant shellfish or submerged aquatic vegetation bed
resources occur except for maintenance dredging..." This
rule should preclude any expansion of the permitted- marina
facility. The proposed channel alignment has been documented
to have a signficant shellfish resource by the NC Division of
Marine Fisheries. While the new ORW regulations do not take
effect until January 1, you know from your experience at DEM
'that the state is required to protect existing uses Re h as
,the ORW resource values) regardless of when the n s take
effect. Thus, loss of this resource to dredging a
violation of state water quality standards which.you are required
'by CAMA regulations to enforce.
(4) The road leading to the waterfront development is currently a
small.farm road that passes through 404 wetlands. No provisions
in this application have been made to deal with filling activities
that will be required to construct a road to this project.
It.is clear that this new proposal violates the dredging limitations
just adopted by the EMC. Please refer to Jim Rennedy',s letter of
January 21, 1989 in regard to additional problems posed by this
project. We ask you do deny this permit modification request.
Please notify us immediately of any actions taken in regard to this
project.

all new development activities requiring a
Sediment/Erosion Control Plan will be required as follows:
(A) Low density Option: Developments which limit single
family developments to one acre lots and other type
developments to 12% built-upon area,. have no stormwater
collection system as defined in 15 NCAC 2H .1002(13),
and have built-upon areas at least 30 feet from surface
water areas will be deemed to comply with this
requirement.
(B) High Density Development: Higher density developments
will be allowed if stormwater control systems utilizing
wet detention ponds as described in 15 NCAC 2H
.1003(i), (k) and (1) are installed, operated and
maintained which control the runoff from all built-upon
areas generated from one inch of rainfall. The size of
the control system must take into account the runoff
from any pervious surfaces draining to the system.
More stringent requirements may be required by the Environmental
Management Commission on a site specific basis.
(2) Saltwater: Water quality conditions shall clearly maintain
and protect the outstanding resource values of waters
classified ORW. Management strategies.to protect resource
values will be developed on a site-specific basis during
the proceedings to classify waters as ORW. At a minimum,
new develo ment will comply with the low density options
as specified in the Stormwater Runoff Disposal rules (15
water line of the designated ORW area. New non-discharge
permits will be required to meet reduced loading rates and
increased buffer zones, to be determined on a case-by-case

which have been taken to protect a water body in determining the

9. -NARRATIVE DESCRIPTION:
BACKGROUND REVIEW:` On June 29,1988, the Division of
Coastal Management issued Permit #120-88 to Broad Reach
Investments, Inc. authorizing.the development of a 156 ac.
subdivision and marina`basin,oriented along Channel
Alignment 'B' off Sanders Bay, in Carteret County. Since
that time, careful consideration has been given (by the
permittee and the review agencies) to possible project
modifications that would minimize the direct and indirect
environmental consequences caused.by excavation of the
offshore channel and operation of the marina. The
developers have submitted a modification request to the
existing permit that will relocate the access channel and
marina basin along the alignment of Alternative 'A' nearest
the Atlantic Intracoastal Waterway.' The applicant's
consultant, Paton/Zucchino & Associates, P.A., have put
together a concise project summary and up-to-date project
description in a three page introduction that is attached to
the application.
PROJECT SETTING: The project site consists of 271.8 ac.
situated between Bogue Sound and Highway 24, near the
community of ocean, in Carteret County, NC. The focus of
the permit request is Phase I consisting of 156 acres
nearest Bogue Sound, Sanders Bay, and Sykes Creek. The
estuarine shoreline of Broad Reach adjoins the Outstanding
Resource Waters (ORW) of Western Bogue Sound. The nominated
area extends 575' onto the highground property.
The master workplat plan, Sheet l of? 7, provides an
overview and orientation to the project. Three of the six
parcels shown on the master plan.are-the subject of Phase I.
Parcel 'A' contains 78.6 acres with-a projected 174
single-family lots (2.21 units/acre) ranging in size from
8,000 sq. ft. along Bogue Sound and,the marina to 12,000 sq.
ft. in the northwest interior. Parcel 'B', at a combined
52.9 acres, is subdivided into Parcels 'B1' and 'B2'
characterized by attached townhouse`u'nits. On the east side
of the property, Parcel 'B1' at 37.,;8 acres will provide 113
residential'units.(299 units/acre)A; A centralized
non-tidal lagoon and amenities area`"i4ill be the focal point
of Parcel 'B11. The developers have`dedicated 1.5 acres of

open-ground property within the amenities area of B-1 as a
long-term spoil disposal site reserved for future
maintenance dredging requirements. On the west side of the
property, near the marina basin, Parcel 'B2' with 15.1 acres
will provide 58 attached townhouse units (3.84 units/acre).
Parcel 'C' is 24.5 acres and contains the central activities
center for the entire development. The community center
will contain such activities as a'30 room inn, restaurant,
ships store and club.
All interior side roads in Phase I.will feed to the primary
loop road that encircles the community center. Adjacent to
the loop road is the 75 slip marina basin and drystack
storage facility to be located on 5.1 acres within Parcel
'C'. This figure includes the 60' wide access channel
connecting the highground basin with Bogue Sound some 630'
to the south. As proposed, an entrance channel measuring
350' long x 60' wide x -9.5' deep will be dredged from the
Intracoastal Waterway to the highground access channel
leading to the basin. Dredging and excavation associated
with the entrance channel and access channel will not
involve coastal wetlands or submerged aquatic vegetation
habitat (as determined by NMFS). The marina basin will
measure 540' wide x 320' long x -6.51 deep on MLW. The 4
acre marina basin will be positioned some 685' from the 'SA'
surface waters of Bogue Sound. The developers have
indicated on Page 4 of the application that the proposed
marina is residential rather than commercial or public. The
marina will not provide fuel pumps or repair facilities.
According to the Division of Health Services definition, the
marina design is a closed system marina by virtue of the
lengthy highground canal that connects the boat basin with
Bogue Sound. According to the graduated schedule used by
the Division of Health Services, the proposed marina basin
with 75 wetslips will require a shellfish closure zone of at
least 325' beginning at the basin and., extending down the
highground access channel.
The applicant is proposing to constrtict 2 piers to provide
pedestrian access to Bogue Sound. A`".200' x 6' pier will be
positioned on Bogue Sound just west-of the entrance channel.
Natural water depths at the end of the. 200' pier are
estimated to be -4.5' MLW. A 300'..-Vieir will be located on

depths at the end of the 300' pier are 'estimated at -2' MLW.
Both piers will be interlinked with the residential

coastal wetlands.
Broad Reach will be serviced-by a tertiary wastewater
package treatment plant with-infiltrated subsurface lines to
be located on Parcel 'F', a 20.5 acre site near Highway 24.
In addition, the development has been designed with a
community well system as its initial source of drinking
water. These community type-services are consistent with
the current land classification scheme as designated by
Carteret County in their recent Land Use Plan Amendment.
The highgroun'd property within.57.5' of Bogue Sound is
classified 'Community' and the'.remainder of the property is
designated as 'Trans ition/Re`sidential'. At present, the
Broad Reach property is zoned by Carteret County as
'Recreational- Residential/Planned Unit Development'
(RR-PUD). As the master plan shows, a 6 acre out-parcel on
Highway 24 is zoned B-1.
PROJECT DIMENSIONS: The applicant has provided a series of
project statistics that relate to unit density and the
amount of impervious surface areas. This data is
categorized on Workplat Sheet 3 of 7 as well as in the
stormwater plan submitted to DEM and included in the LAMA
application. The applicant's calculations appear to comply
with current requirements of the 575.' Outstanding Resource
Waters area nominated as western Bogue Sound. The overall
unit density for Phase I has been calculated by the
applicant to be 2.21 units per acre.,

10. ANTICIPATED IMPACTS: The applicant has requested a permit
modification to move the location of the permitted boat
basin and entrance channel from Alignment 'B' on Sanders
Creek to the alternative Alignment 'A' on the Intracoastal
Waterway. Dredging Alternative 'A' involves no coastal
wetlands or submerged aquatic vegetation. The National
Marine Fisheries Service has also classified Alignment 'B'
as 'SAV' habitat. Open water dredging of Alternative 'A'
will generate a footprint of 21,000 sq. ft. based on a
length of 350' by a maximum top width of 601. This
represents a 68% reduction in the total amount of bottom
disturbance when compared to the permitted channel Alignment
'B' at 1100' in length. Water depths within the proposed
entrance channel will average -9.5' relative to MLW. This
is 3.5' deeper than the permitted entrance channel at -6'
MLW. However, the controlling depth at Alignment 'A' is the
existing entrance channel of Holiday Village with a water
depth of -6' MLW. The connecting waters of the Intracoastal
Waterway adjacent to Alternative 'A' are -14' MLW. As the
application states, water depths within the highground
access channel will average -8' as opposed to -5' in the
permitted highground access channel. Within the marina
basin, the applicant proposes a water depth that will
average -6.5' which is approximately 1.5' deeper than the
permitted basin. In terms of channel width, the two
Alignments 'A' and 'B' are comparable in size. Alternative
'A' is proposed with a top width not to exceed 601. The
permitted bottom width of Alignment 'B' is limited or
conditioned (Number 6) to 401. The application indicates
that both power and sailboats with a typical length of under
45' are expected.
Sampling by DMF has shown that hard clam resources occur and
are harvested within the alignments of both the permitted
channel and the one being proposed. An interpretation of
the quantitative aspects of these data is available from
DMF. The significance of the modification request is that
the direct impact on clam habitat will be reduced from
66,000 sq. ft. to 21,000 sq. ft.
The applicant has fine tuned the type and amount of
development that will occur on the highground property. The
amount of impervious surfaces, as presented by the
applicant, complies with CAMA/ORW requirements of less than
30%, and less than 25%, respectively.

Hydraulic dredging of the open water entrance channel will
generate an estimated 4,000 cu. yds. of sandy spoil. It
will be pumped to a diked area on highground. The disposal
site is about 1.5 acres in size with a design capacity of
18,667 cu. yds. Excavation of the highground basin and
access channel should produce little to no turbidity
problems since the work is scheduled to be accomplished
in-the-dry and landward of an earthen plug near the
shoreline. The hydraulic spoil site may become useful in
de-watering the boat basin during construction. An
estimated 143,000 cu. yds. of sandy loom will be removed
from the 5 acre basin site. The excavated earthen material
will be trucked throughout Phase I and used for landscaping
purposes.
CAMA REVIEW SECTION: The applicant's consultants have
worked closely with the Carteret County Planning Department
to help ensure compliance with all Local Building
Regulations and Zoning ordinances, as well as, the Amended
Land use Plan. The developers are in the process of
requesting a zoning change that will allow construction and
operation of the drystack storage facility within the PUD
designation. Carteret County's review of the zoning changes
and preliminary approval of the subdivision plat is being
coordinated during the CAMA review process.

' SUMMARY PROJECT DESCRIPTION
The Broad Reach property is located between Highway 24 and
Bogue Sound in the White Oak Township in Carteret County,
' roughly halfway between Swansboro and Morehead City.. The
property encompasses 271.8 acres. The Major C.A.M.A. Permit
Request for Phase one includes the southern 156 acres of the
' total 271.8 acres in the property. The Phase One permit
request is bounded by Bogue Sound to the southeast, Syke's
Creek to the north and a privately owned undeveloped parcel
to the west. Most of the permit request area is currently in
' agricultural use. The remaining areas are wooded uplands and
wetlands.
The property is currently zoned as Recreational Residential -
Planned Unit Development (RR-PUD) by Carteret County with a
six acre outparcel zoned B-3 commercial fronting NC 24. The
' County C.A.M.A. Land Use Plan has designated the property for
two land use categories, the Transitional - Residential and
Community Classification. The area adjoining of Bogue Sound
has the Community Classification and has also been nominated
as Outstanding Resource Waters by NCDEM.
The Broad Reach development has been master planned as a
private retirement and second home water front community
providing private amenities to its residents and their
guests. The project is divided into six parcels, labeled on
the Master Development Plan as Parcels A through F. The 156
acres in the Phase One permit request area includes Parcels
A,B, & C.
Parcel A, at 78.6 acres, contains 174 single family lots
ranging in size from 8,000 -12,000 square feet. It occupies
the northwestern and south central sections of the permit
request area. The larger lots are concentrated in the
northwestern section and the smaller lots near the shoreline
of Bogue Sound and the Marina. All lots in Parcel A are
serviced from cul-de-sacs off the main loop road.
Parcel B is subdivided into Parcels B1, & B2, both containing
attached units. Parcel B1 occupies the extreme eastern 37.8
acres of the permit request area. It contains 113 units
surrounding a central lagoon and small amenity center.
Parcel B2 is in the southwestern corner adjacent to the sound
and marina. It contains 58 units on 15.1 acres situated to
' take advantage of the views to a proposed pond near the shore
and the Community Center complex.
' Parcel C occupies the central 24.5 acres of the permit
request area. It contains the central amenities of Broad
Reach. Within the loop road, the 32,000 square foot
Community Center will hold a 30 room inn, restaurant, ship's
' store, and community club. A pool and four tennis courts are
located adjacent to the club. Outside the loop road and
adjacent to the 75 slip residential marina is a 195 slot non-
commercial drystack for use by the project residents.
The upland marina basin is a private facility and is served
' by an access channel to the Intracoastal Waterway located 350
feet offshore. The channel location was determined by the
State and Federal resource agencies as the alignment with
least impact on aquatic resources. Sewage pump out
' facilities will be available near the drystack facility.
A 200 foot pedestrian pier near the marina channel connects
' to a pedestrian walkway system that rings the shoreline and
marina basin. A second 300 foot pedestrian pier is located
to the east in Parcel B2. The pedestrian system includes
concrete walks in upland areas and wooden boardwalks in
wetlands.
The entire Broad Reach project will be serviced by a central
' utility system. The water system's initial source will be a
community well system. When the West Carteret Water
Corporation extends its lines along NC 24 in the early
' 19901s, service lines will be extended to Broad Reach. The
central sewer system will be a combination of gravity lines
and force mains directed to a tertiary package treatment
' plant in Parcel F, the wastewater treatment area. The
treated wastewater will be infiltrated via subsurface lines
in a manner approved by the Division of Environmental
Management (DEM).
' Impervious surfaces in the permit request area total 36.89
acres or 23.6% of the entire area in Phase One. The
' impervious surface area is below the maximum 25% coverage
requirements of the DEM low density stormwater control
regulations. In addition to the low density design,
stormwater infiltration basins have been designed using DEM
guidelines for Parcel C as an added measure of water quality
planning for this Parcel.
' Erosion control will be accomplished by the standard methods
of silt fencing, sediment pits, and vegetative stabilization
developed by the Land Quality Section of the N.C. Division of
' Land Resources. The erosion control plan insures that Broad
Reach will not contribute any construction sediment to the
surrounding waterbodies.
' Broad Reach has been planned to benefit from the inherent
natural strengths and beauty of the site and takes the
relevant local State and Federal regulations into account.
' Through thoughtful analysis and programming a development has
emerged that will attract responsible residents without
marring the natural beauty and sensitive ecology of this
' stretch of Bogue Sound.

Each single family lot in the subdivision will be restricted
to a maximum impervious cover of 3,350 s.f. through a set of
legal deed restrictions attached to each lot. By restricting
each owner to a certain built upon surface area, the total
development will not exceed the twenty-five percent

covenants specifically note that the State of North Carolina
will be the beneficiary of these restrictions.

PROJECT DESCRIPTXON: Proposed is Phase I of the Broad Reach
subdivision, 156 acres of 271 acres, to consist of 174
single-family lots and 173 attached units; 75 slip highground
marina basin with a 3501 X 60' entrance channel and a 750' X 60'
highground access channel; 195 slip drystack; community center;
and two access piers 200' and 3001.

The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
1. The project will require a 401 Water Quality Certification.
2. The project complies with the General 401 water Quality
Certification No. 1273 for the discharge of liquid effluent
from a diked disposal area resulting from hydraulic
dredging, and Certification No. 1431 for boat ramp
construction.
3. An earthen plug shall be maintained in the channel during
excavation of the basin and the majority of the channel.
4. The proposed project should be done in such a way as to not
cause the turbidity outside the immediate construction area
to exceed 25 NTU.

5. A stormwater management plan has been approved for this
project.
6. A4? this time no information has been received by this office
concerning wastewater disposal. The proposed tertiary
package treatment plant with subsurface disposal would
require a either a State Non-discharge Permit issued by DEM
or a permit issued by the local health department or DHS.
The project was issued CAMA Permit No. 120-88 on June 29,
1988 for the the subdivision development and marina basin with
entrance channel along Alignment 'B' off Saunders Bay. With the
current application the channel would be constructed along the
alignment of Alternative 'A' off the A:CWW. The new proposal
would reduce the direct impact on clam habitat from 66,000 sq.
ft. to 21,000 sq. ft. This office has no objection to this
modification request unless: 1) DHS determines that an automatic
closure of productive shellfish areas would be required; or 2)
DMF determines that the dredging of the entrance channel would
remove a significant shellfish resource. If either of these
occur this office would recommend denial of the project.

Dear George:
Please consider these comments in regard to Broad Reach's latest
application to modify its permit. Our comments regarding this
application include:
(1) Include by reference alb our previous,comments made in regard
to this project which are in earlier permit files;
(2) Include by reference all previous public and agency comments
in regard to this project which are in earlier permit files;
(3) Project proposal violates new ORW regulations just adopted for
western Bogue Sound. Rule 15 NCAC 2B .0216(c)(2) now states
that "No dredge or fill activities will be allowed where
significant shellfish or submerged aquatic vegetation bed
resources occur except for maintenance dredging..." This
rule should preclude any expansion of the permitted marina
facility. The proposed channel alignment has been documented
to have a signficant shellfish resource by the NC Division of
Marine Fisheries. While the new ORW regulations do not take
effect until January 1, you know from your experience at DEM
that the state is required to protect existing uses (such as
the ORW resource values) regardless of when the new rules take
effect. Thus, loss of this resource to dredging would be a
violation of state water quality standards which.you are required
by CAMA regulations to enforce.
(4) The road leading to the waterfront development is currently a
small.farm road that passes through 404 wetlands. No provisions
in this application have been made to deal with filling activities
that will be required to construct a road to this project.
It.is clear that this new proposal violates the dredging limitations
just adopted by the EMC. Please refer to Jim Kennedy',s letter of,
January 21, 1989 in regard to additional problems posed by this
project. We ask you do deny this permit modification request.
Please notify us immediately of any actions taken in regard to this
project.

(B) High Density Development: Higher density developments
will be allowed if stormwater control systems utilizing

maintained which control the runoff from all built-upon
areas generated from one inch of rainfall. The size of
the control system must take into account the runoff
from any pervious surfaces draining to the system.

Management Commission on a site specific basis.

8. PROJECT SUMMARY: The applicant proposes to modify Permit
#120-88-to allow construction of a drystack storage facility
measuring 350' x 135' on the highground adjacent to Basin B
in the Transition/Residential Land Classification.
9. NARRATIVE DESCRIPTION: The project site is located off
Highway 24, just west of Sanders Creek, and east of the
community of ocean, on Bogue Sound, in Carteret County. The
developers of 'Broad Reach' were issued a State CAMA/Dredge
and Fill Permit in June of 1988. Permit #120-88 authorizes
the development of a subdivision and the excavation of a 75
slip highground marina basin, known by its location as Basin
'B'. As part of the restrictive permit conditions, the
original commercial drystack storage marina located at Basin
'A' was found to be inconsistent with the Carteret County
Land Use Plan and was therefore deleted from the approved
project. The developers have worked since the permit was
issued with Carteret County and the Coastal Resources
Commission to have the Land Use Plan and the Land
Classification scheme changed to accommodate higher density
residential use and the development of a non-commercial type
marina. On November 21, 1988, Carteret County adopted the
Land Classification change from 'Community' to
'Transition/Residential'. The Coastal Resources Commission
certified the amendment changes on December 2, 1988.
Today, the developers of Broad Reach propose to modify
Permit #120-88 to allow the construction of a 'drystack
storage building' to be located adjacent to the 'SB' surface
waters of Basin B. This position will place the
non-commercial drystack building some 600' from the 'SA'
surface waters of Sanders Bay and Bogue Sound. The proposed
building will be setback 30' from the bulkheaded basin and
will measure 350' long x 135' wide. It will house on tiered
racks 195 boats in a class under 30' in length. The
drystack building will occupy 47,250 sq. ft. within the area
designated as 'Transition/Residential'. A 75' long concrete
driveway will connect the drystack building to the boat
ramp. The modification request involves a 7.58 ac. section
of land surrounding Basin B which was identified in the
original permit. As calculated by the developer, only 24.3%
of the LAMA Estuarine Shoreline AEC will be rendered
impervious. Rainwater-runoff will be collected from the
drystack building and the adjacent asphalt parking lot, and
directed to grassed swells and retention areas away from the
AEC. The applicant has provided, on the revised workplat

description of the Stormwater Management Plan. Finally, the
proposed modification includes a parking lot of about 6,000
sq. ft. and necessary restrooms with septic tank and leech
fields.
10. ANTICIPATED IMPACTS: The proposed permit modification will
render about 27,000 sq. ft. of the total LAMA AEC (110,500
sq. ft.) as impervious. This includes the drystack storage
building and a portion of the parking lot and concrete ramp.
These figures, along with the proposed Stormwater Management
Plan, should control the runoff of pollutants into the 'SB'
surface waters of Basin B. The drystack storage facility
will allow an additional 195 boat owners within the 725 lot
subdivision to have water access available in a marina basin
without generating the potential long-term impacts due to
wetslip dockage. The applicable 28 permit conditions to the
Broad Reach development will continue to help safeguard the
local estuarine environment as construction begins and the
project grows to maturity around the permitted marina basin-

with the Land Use Plan where the unzoned area of Carteret
County has been reclassified as 'Transition/Residential'.
