Colonel Suermann: This responds to Mr. Charles Hollis's letter dated December 21, 1989, regarding the Department of the Army permit issued to the National Park Service, Cape Hatteras National Seashore, authorizing construction of a public boatramp facility near Ocracoke Village, on Pamlico Sound in Hyde County, North Carolina (Public Notice CESAW-C089-N-048-0125). This supplements our previous report dated January 24, 1989. This report is submitted in accordance with provisions of the Fish and Wildlife Coordination Act _(16 -U.S.C. 661-667e) and Section ,7 `of the Endangered Species Act p_.,'f .1973:,_as_ame?d d (16 V -4, S. Mr. Hollis requested the U.S. Fish and Wildlife Service (Service) to review a December 14, 1989, letter from Superintendent Thomas L. Hartman which proposed modifications to the issued permit. The proposed modifications include: relocation of the proposed ramp site 150 feet to the northeast; avoidance of regularly-flooded wetlands; elimination of all formerly proposed wetland excavation; and filling of approximately 0.12 acre of irregularly-flooded palustrine emergent wetland. Since the proposed modifications constitute a more environmentally acceptable plan of action, the Service will not object to them provided mitigation is forthcoming as required in Special Condition "a" of the original permit and as proposed in Mr. Hartman's letter. Accordingly, the following conditions should be included in any modified Department of the Army permit issued for the proposed project: 1. A mitigation plan shall be developed by the applicant and circulated to all regulatory review agencies for comment prior to the onset of construction. 2. The mitigation plan shall include at a minimum: details of any site proposed for wetland restoration or creation; techniques for site preparation; species and density of plants proposed for use; length of any proposed monitoring period; performance criteria for plantings; and replanting schedules. A wm? r YI 3. Mitigation provided shall consist of at least 2:1 replacement of the wetlands filled, either through restoration or creation, as specified in Mr. Hartman's December 14, 1989, letter. CD88-15 i tDun{,- F7?ce?? . 0 9988 jig., w Nt t i o n a l P ar-k S-er vi ce Cape Hatteras National Seashore Proposal to Construct Boat Launch Ramps in Ocracoke Village a i CONSISTENCY DETERMINATION The 1984 General Management Plan (GMP) for Cape Hatteras National Seashore proposed the development of boat launch facilities on the sound shore of the National Park Service (NPS) developed area within Ocracoke Village. These ramps were intended to satisfy an existing need for more public boat launching facilities by supplementing two existing ramps elsewhere in the village. In addition to routinely reducing waiting time for boat launching and take-out, they will be useful for rapid take-out in case of storms. The 1984 GMP was circulated within the North Carolina State Clearing House and was found to be consistent at that time with the North Carolina Coastal Management Program. A. Project Description Two new boat launching ramps and associated finger piers will be constructed on the sound shore of the NPS developed area within Ocracoke Village. Vehicle access will be from the north end of the two hundred-space parking area. The piers will provide for temporary use by visitors launching or taking out boats and for launching windsurfers or small sail craft. The launching site will take advantage of an existing shallow-water basin behind an existing concrete/sandbag breakwater which has effectively protected the immedJ_ate_ s,horelj-oe?:fz*m. erosion for mt?` e th, n; 20 -years : The` b a Cl? t.er ha-s- req-ui red. n-o- -ma-i-anftance in the past, and any maintenance or rehabilitation in the future is expected to be minimal. The launching site will impact less than 0.1-acre of wetland vegetation which occurs as a narrow strip along the shoreline. The shallow-water basin will be dredged to a depth of four feet below mean low water. B. Consistency Determination In accordance with federal consistency requirements of Section 307 of the Coastal Zone Management Act of 1972, as amended, the project has been reviewed for consistency with the North Carolina Coastal Management Program. The following information is being submitted to support a finding of consistency with that program. AREAS OF ENVIRONMENTAL CONCERN The project will take place in the estuarine system's AEC's and will affect the following categories: Estuarine waters in public trust areas. The project is consistent based upon a review of the management objectives and use standards for each category. 7H.0208(a) General Use Standards (1) The provision for boat launch ramps is a water-dependent use. r` (2)(a) The project is consistent with the stated management objectives for public trust areas and estuarine waters. The project will enhance public rights for navigation and recreation. The project complies with the second priority of estuarine waters use which supports development activities that require water access and use which cannot function elsewhere, such as simple access channels. (2)(b) There are no suitable alternative sites or locations outside of the estuarine water or public trust AEC for a boat launch facility. The facility will meet a recreation and water access need in Ocracoke that is not obtainable elsewhere on the island. The project has been designed to have a minimum adverse impact upon biological resources. (2)(c) The project will cause increased turbidity during construction of the boat basin. Additional turbidity to surrounding shallow-water habitats will also result from prop scour in the shallow habitats adjacent to the boat basin. The project will require a 401 permit. 2 (2)(d) The project will not adversely impact any _documented archeological or historic resources. (2)(i) The proposal is exempted from consideration under the ocean hazard AEC per section 7H.0309. 7H.0208(b) Specific Use Standards (1)(a) The boat basin and a short-access channel will pass through a narrow fringe of regularly flooded wetlands. This fringe is located adjacent to the Village of Ocracoke behind a breakwater, and the loss of less than 0.1-acre of this wetland should have no significant adverse impacts on fishery resources or water quality. There is no alternative for the provision of small boat access which would avoid this wetland loss. (1)(b) All spoil material from construction of the boat basin will be placed landward of the marsh. This material will be allowed to dry in the adjacent parking lot and will be utilized as fill material behind a retaining wall at the new Ocracoke Ferry office. f 3 (1)(c) As stated above, all excavated material will be placed landward of any wetlands and removed from the shoreline area. (1)(d) The basin's width and depth will be the minimum required to meet access needs. (1)(e) The boat basin will have adequate water exchange and will be sloped with the greatest depth at the waterward portion of the basin. (1)(f) The basin shall be excavated to a depth of four feet; there are no adjacent channels. (1)(g) N/A. (1)(h) N/A. (1)(i) N/A. (6) (e) The piers will extend to the breakwater area to allow access for windsurfers and other small boat use of the area. (6)(f) The piers will not interfere with any adjacent riparian property owner or shoreline access. (6)(g) The finger piers will not interfere with shellfish leases or franchises. 7H.1305 Boat Ramo Use Standards (a) Each boat ramp shall be 15 feet wide and will extend 20 feet beyond mean high water. (b) Excavation and ground disturbing activities above and below mean high water will be limited to that absolutely necessary to establish adequate ramp slope and to provide an adequate boat basin. (c) Fill materials will be limited to the ramp itself. Ramps will be constructed of concrete. Approximately 0.1-acre of coastland vegetation will be excavated for installation of these ramps. r LOCAL LAND USE PLAN - HYDE COUNTY The land use plan developed by Hyde County shows the project site is in an area classified as conservation. Conservation lands are so designated to protect historic, cultural and natural resources. Small boat access is a legitimate recreation need under the Hyde County plan. For these reasons, the proposal is considered to be consistent with the land use plan. OTHER AGENCY REVIEWS The project will not be initiated until the following reviews have occurred. Traffic circulation at the existing ramps is poor, causing congestion within the core village area during the peak use season. The existing boat ramps are inadequate to land a large number of boats quickly in the event of a storm. The project will take approximately 0.1-acre of fringe coastal wetlands for excavation for the boat ramps. The project will also increase turbidity in adjacent shallow-water and eel-grass habitat through prop scour adjacent to the boat ramps.. However, it is felt that this project presents clear significant public benefits and that there is no reasonable and prudent alternative site available for the project. Mitigation measures have been incorporated into project design, and such further mitigation as may be necessary and as may be identified during the review process will be incorporated. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show the proposed excavation, by dragline, of a 40-foot-wide, 80-foot-long basin,to a depth of 4 feet, mean low water (MLW) The approximate 4,000 cubic yards of excavated aaterial is to be placed on an adjacent high ground.vehicle parking area. Two 12-foot-wide, 40-foot-long concrete ramps and three 4-foot-wide, 40-foot-lon9 finger piers are to be installed within the basia`'area to fahitate launching and retrieval of &toiall recreational boats. A narrow fringe of wetlands vegetation is to be excavated or filled. The purpose of the work is to provide a boatramp facility for general public use. Plans showing the work are included with this public notice. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as:. a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management. c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management or their delegates. f ? -2- d. The issuance of an easement to fill or otherwise occupy State-owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration and the North Carolina Council of State. e. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army permit will be denied if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. Y -3- The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order . 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, is general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in.waters of the United States, a permit will be .denied if the discharge that would be authorized by such permft would not comply with the Environmental Prot.e.cton Agencies' 404(b)(l)w:- guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serve as application to the DEM for certification. Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after February 1, 1989. (SAWCO 89-N-045-0125 of Jan.5 x,1989. ) Most of the Sound shore of Ocracoke Island, something over 13 miles, including its ins and outs, is fringed by wetlands • vegetation. Mostly, too, it lies within the National Park Service's area and is thus protected from development. In the small village de elQpge-t .jgts displaced .some of the wetlands fr+ #?ge? In short, past and foreseeable loss of wetland. vegetation..::.doe s not seem to be a major problem on Ocracoke and the loss involved in A the Park Service proposal may fairly be said to be minimal. (See sketch of facility with application.) We submit that the displacement proposed is absolutely and relatively slight and is clearly distinguishable from other p6ssible applications affecting wetland vegetation in that: i, t (1) a ramp can not be located away from the shore; (2) it will benefit all the public; (3) it will be under the responsible management of the Park Service and (4) its benefits will deciseively outweigh the minimal l(Iss of wetland involved. We know at first hand that visitors,as well as islanders will benefit from the new Park Service ramp. The Rroposed ramv is uni uely right for Ocracoke because of the s r n„gtture of its facilities and its particular location. Unlike any other boat ramp on Ocracoke available to the, publ cl.this proposed ramp will offer now and for the.foreseeeble oOexnt`'parting s,, sufficient area. Aaneuvering boat trailers, easy access from route 12 without interfering with trE,.ffic, and responsible operation by a Federal agency experienced in providing public services. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North.Carolina agencies such as:. a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Environmental Management. b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management. c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA) by the North Carolina Division of Coastal Management or their delegates. r .o -2- d. The approval of an Erosion and Sedimentation Control Plan by the Land Quality Section, North Carolina Division of Land Resources, pursuant to the State Sedimentation Pollution Control Act of 1973 (NC G.S. 113 A-50-66). The requested Department of the Army permit will be denied if any required State or local authorization and/or certification is denied. No Department of the Army permit will be issued until a State coordinated viewpoint is received and reviewed by this agency. Recipients of this notice are encouraged to furnish comments on factors of concern represented by the above agencies directly to the respective agency, with a copy furnished to the Corps of Engineers. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 10 of the River and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District.Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. .r,% r -3- The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral, needs, considerations_of_pr9perty_ownership, and, in ga- w1, the needs ond *elfare of the people. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act.
