JHG:mb cc: DCM-( tmi VJ MA' CF, WiRO A Y DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 SAWCO-ND-89-10-0009 November 10, 1988 PUBLIC NOTICE MAINTENANCE DREDGING IN Wilmington Harbor, North Carolina (Ocean Bar) (Brunswick County) TO WHOM IT MAY CONCERN: The WILMINGTON DISTRICT CORPS OF ENGINEERS, Wilmington, North Carolina, proposes to perform maintenance dredging in Wilmington Harbor, North Carolina between Baldhead Shoal Channel and Battery Island Channel. PROJECT DESCRIPTION. The work is performed annually, and begins this year on or about mid-December 1988, and involves the removal of all material lying above the plane of 43 feet below mean low water (MLW) in Baldhead Shoal Channel, Smith Island Channel, Caswell-Southport Channel, Southport Channel, and Battery Island Channel within the designated limits of the channels as shown on the enclosed drawing. The estimated quantity of material to be removed is 450,000 cubic yards and the work will require approximately 60 days to complete. The work will be accomplished by use of the Corps of Engineers Hopper Dredge McFARLAND. The dredged material, consisting of approximately 60% mud and 40%' sand and shell, will be deposited in the Environmental Protection Agency (EPA) approved Wilmington ocean- dredged material disposal site (ODMDS), Encl 1. The Wilmington ODMDS boundary coordinates are: 33°49'30"N, 078°03'06"W, 48'18"N, 01'39"W, 47'19"N, 02'48"W, 48'30"N, 04'16"W. The average depth of the disposal area is 42 feet. The Wilmington District will take all necessary actions to ensure that the materials dredged are appropriately placed within the ODMDS. Those actions will include designation of the transportation route to the disposal site, designation of the specific area within the disposal site to be used for disposal, and the requirement that the dredge have a navigation recorder on board to document the disposal locations. A drawing showing the location of the proposed work is enclosed with this notice. There is enclosed a list of Federal, State, and local agencies with whom these activities are being coordinated. No impacts to known archeological/historic resources or.encaangered species will occur. The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina. Concurrence was received from N.C. Department of Natural Resources and Community Development on September 23, 1981, for Baldhead Shoal and Smith Island Channels and on November 28, 1984, for Battery Island, Caswell-Southport Channel, and Southport Channels. -2- The effects of the prop-osed.dr.edging and transportation of -dredged-material- to the ocean disposal s-ite, were assessed in-the. Final Environmental-impact Statement (FEIS), Maintenance of Wilmington Hartsar:, North Carolina, April 1977- which was prepared by the Corps of Eng-ineer-s and -filed with -the -Counci-l an Environment Quality on September 23, 1977. Chemical and biological testing of representative sediment materials from the proposed dredging areas in the Wilmington Harbor Ocean Bar Channels was conducted in 1979. Those tests indicate that the sediments are acceptable for ocean disposal. EPA Region IV restated concurrence with this conclusion by letter dated January 23, 1987. The effects of the disposal of dredged material at the Wilmington Harbor ocean disposal site were assessed in the FEIS, Savannah, GA, Charleston, SC, and Wilmington, NC, Ocean Dredged Material Disposal Sites Designation, October 1983 which was prepared by the Environmental Protection Agency EPA), and filed on October 28, 1983. EPA's environmental impact assessment of ocean disposal was made on the basis of compliance with general and specific criteria of the ocean Dumping Regulations and Criteria (40 CFR, Parts 220 to 229.) promulgated by the Environmental Protection Agency under the authority established by Section 102(a) of the Marine Protection Research and Sanctuaries Act of 1972 which ensures that disposal of dredged material will not degrade nor endanger the marine environment and will not cause unacceptable human health effects or other adverse effects.. The decision whether to perform this work will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effect thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Any person who has an interest which may be affected by the disposal of this dredged material may request a public hearing. The request must be submitted in writing to the District Engineer within 21 days of the date of this notice and must clearly set forth the interest which may be affected and the manner in which the interest may be affected by this activity. In order for such request to be given appropriate consideration, it should be mailed or delivered to the U. S. Army Engineer District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 28402-1890, in time to be received on or before December 12, 1988. All correspondence should refer to the number and date of this notice. John F.
