(Hyde County) TO WHOM IT MAY CONCERN: The WILMINGTON DISTRICT CORPS OF ENGINEERS, Wilmington, North Carolina, proposes to perform maintenance dredging in Far Creek, North Carolina. PROJECT DESCRIPTION. This maintenance work is scheduled to begin in January 1989 and will be completed by March 31, 1989. The work will require the removal of all material lying above the plane of 14 feet below mean low water (MLW) within the designated limits of the channel as shown on the enclosed drawings. The estimated quantity of material to be removed is approximately 270,000 cubic yards of predominately silt and clay with lesser amounts of sand and shell fragments. The dredged material will be placed within an upland diked area with the dredge effluent being returned toward the channel being dredged. The disposal area (shown on the enclosed drawing) has been previously used in the past for maintenance dredging and has no development near it. The frequency of dredging is once every 2 to 3 years, and the area was last dredged in 1986. The work will be accomplished by use of a hydraulic pipe line dredge selected by competative bidding. A drawing showing the work and disposal area is enclosed with this notice. There is enclosed a list of Federal, State, and local agencies with whom this activity is being coordinated. No impacts to known archaeological/historical resources or endangered species will occur. The proposed action is covered in the Final Environmental Impact Statement, Maintenance of the Navigation Projects on Sounds of North Carolina, filed with CEQ on August 26, 1976. The proposed discharge of liquid effluent from upland diked disposal areas resulting from the proposed hydraulic dredging, although subject to the review under Section 404(b) of the Clean Water Act of 1977, has been determined to satisfy the terms and conditions of Nationwide Permit 33 CFR 330.5 (a) (16) and the North Carolina Division of Environmental Management General Water Quality Certif?r.-.;:ion No., 1273 issued on Novembe- 1978, for upland diked disposal. The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina. State consistency concurrence was received January 15, 1985. f The decision whether to perform this work will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will- reflect-the national concern for-both- protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reason- ably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effect thereof; among those are conservation, economics, aesthetics. general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety. food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Any person who has an interest which may be affected by the disposal of this dredged material may request a public hearing. The request must be submitted in writing to the District Engineer within 21 days of the date of this notice and must clearly set forth the interest which may be affected and the manner in which the interest may be affected by this activity. In order for such request to be given appropriate consideration, it should be mailed or delivered to the U. S. Army Engineer District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 28402-1890, in time to be received on or before November 25, 1988.
