DfENVI(;{jiv+nF Wilmington, North Carolina- 28402-] 890 NrAL NIAIVAGE41ENT Raleigh, NC REC:gWgBN1-89-0001 ;September 22, 1988 OC O 6 PUBLIC NOTICE' MAINTENANCE DREDGING OF THE ATLANTIC INTRACOASTAL WATERWAY Nilmington Regional Office DEM FROM MOREHEAD CITY, NORTH CAROLINA, TO SOUTH CAROLINA STATE LINE ?J (CARTERET, ONSLOW, PENDER, NEW HANOVER, AND BRUNSWICK COUNTIES, NORTH CAROLINA TO WHOM IT MAY CONCERN: The WILMINGTON DISTRICT CORPS OF ENGINEERS, Wilmington, North Carolina, proposes to perform routine maintenance dredging in the Atlantic Intracoastal Waterway (AIWW) between Morehead City, North Carolina, and the South Carolina State Line. Project Description: This work, which is scheduled to begin in mid-November 1988, will require approximately 5 months to complete and requires the removal of isolated shoals above the plane of 14 feet below mean low water (MLW) within the designated limits of the channel as shown on the enclosed drawing. The estimated quantity of material to be removed is approximately 480,000 cubic yards of varying types of material. The estimated quantity of material to be removed, type of material, type of disposal, dredging frequency, and date of last dredging are shown in tabular form enclosed. The USGG Station (Swansboro) will be included in this contract; however, it is being dredged to 8 feet below MLW under its own State and Federal permit. There is no development near the disposal areas, and all the disposal areas, except the beach disposal area at Emerald Isle, have previously been used for maintenance of this project. A drawing showing the proposed work is enclosed with this notice. More detailed drawings are available in the Wilmington District Office. The work will not be performed until a coordinated viewpoint from interested State and Federal agencies has been received and reviewed. There is enclosed a list of Federal, State, and local agencies with whom these activities are being coordinated. The proposed discharge of liquid effluent from upland diked disposal areas resulting from the proposed hydraulic dredging, although subject to review under Section 404(b) of the Clean Water Act of 1977, has been determined to satisfy the terms and conditions of Nationwide Permit 33 CFR 330.5(a)(16) and the NC Division of Environmental Management General Water Quality Certification No. 1273 issued on November 10, 1978, for upland diked disposal. The proposed discharge of dredged material on the beaches is covered under General Water Quality Certification No. 1264 issued on October 9, 1978, and Amendment No. 1264-R issued on April 15, 1982. A Section 404(b) evaluation report concerning beach disposal was completed on October 30, 1978. An amendment to General Water Quality Certificate No. 1264 and a Section 404 (b) evaluation report for beach disposal on Emerald Isle is being prepared. i 2 No impacts to known archaeoiogical/historical resources or endangered.., s.p?eci^es, will occur. The proposed action is covered in the final Environmental Impact Stiatement (EIS) for maintenance dredging of the AIWW, filed with CEQ on November 6, 1,975, and the final Environmental Impact Statement for the AIWW Side Channels, filed with'CEQ' on November 10, 1976. An Environmental Assessment and Finding of No Significant Impact (EA/FONSI) for the Channel to Bogue Inlet and Section IV, Tangent 3 (mouth of Whiskey Creek) will be prepared and sent to State and Federal agencies, and the public prior to work in these areas. The proposed action is consistent with the approved Coastal Management Program of the State of North Carolina. State concurrence for Bogue Inlet Crossing and Saunders Creek Crossing was received on October 14, 1983; State concurrence for Lockwoods Folly River was received on September 25, 1980; State concurrence for Mason Inlet Crossing was received on August 17, 1981; State concurrence for Carolina Beach Crossing was received on March 30, 1987; State concurrence for Snows Cut, Tangent 2, Section V, was received on October 31, 1985; State concurrence for the remaining listed segments of the AIWW was received on May 6, 1980. A consistency determination for the Channel to Bogue Inlet, Section IV, Tangent 3 (vicinity of Whiskey Creek), and Core Creek (Tangents J & K) will be fowarded to the NC Division of Coastal Management for concurrent/nonconcurrence prior to performing work in these areas. The decision whether to perform this work will be based on an evaluation of the probable impact including cumulative impacts of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. Any person who has an interest which may be affected by the disposal of this dredged material may request a public hearing. The request must be submitted in writing to the District Engineer within 30 days of the date of this notice and must clearly set forth the interest which may be affected and the manner in which the interest may be affected by this activity. In order for such request to be given appropriate consideration, it should be mailed or delivered to the U.S. Army Engineer District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 281402-1890, in time to be received on or before October 24, 1988. All correspondence should refer to the number and date of this notice.
