Williams of Swan Quarter, N.C. filed an application on 4 April 1989 for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental management that a discharge of fill material in project wetlands will not violate applicable water quality standards. SUMMARY: The applicant is proposing to replace existing piers and bulkhead. Environmental setting The application for permits which has been submitted by Mr. Williams involves four adjacent pieces of properties, all of which are located adjacent to the east side of Far Creek on SR 1100 in Hyde County. The applicant owns one of the four properties (0.64 acres) on which is located Williams Seafood Company. Associated with the seafood business is a deteriorated wooden bulkhead and a concrete dock. The second piece of property is located to.the south of Mr. Williams' property. The tract is owned by Mr. Tommy Etheridge and is leased to Mr. Williams. No structures are located on this property other than a deteriorated pier. The property is highground and is essentially being used for the storing of fishing gear. The third and fourth pieces of property are located to the north of Mr. Williams and are owned by Mr. Gilbert Gibbs and Hyde County. No structures are located on these properties which are vegetated primarily with Distichlis spicata marsh. Mr. Williams also has a lease on these prop- erties. At this location Far Creek is classified as SA waters by the N.C. Division of Environmental Management and as a primary nursery area by the N.C. Division of Marine Fisheries. The creek is almost completely surrounded by adjacent structures mainly seafood businesses. Project proposal The applicant is proposing the following: (1) To replace 86' of deteriorated bulkhead adjacent to the concrete dock on the Williams' property.. This section of bulkhead will average 2' beyond the NWL. (2) To extend the bulkhead 102' onto the Etheridge property. This section of bulkhead will also average 2' beyond the NWL. (3) To construct a 20' wide pier beginning at the end of the concrete dock on the Williams' property a distance of 188' to the eastern property line of the Etheridge property. The existing deteriorated pier on the Etheridge property will be removed. When completed the pier will be aligned in a straight line with the Williams' concrete dock. (4) To construct 70' of wooden bulkhead 1' in height along the western edge of the boat basin on the Williams' property. This section of bulkhead because it is located waterward of marsh will not be backfilled. (5) To construct a 6' wide pier from the northern-corner of the boat basin to Far Creek (70'), then turn the pier to follow the shoreline of the Gilbert Gibbs and the Hyde County shorelines (273').
