to serve his single family residence and provide simple riparian boat access

9. PROJECT DESCRIPTION
The project is located near the intersection of NC 50 and Shore Drive on the
west side of NC 50. The site is known as Lot 6 of the Elizabeth Grady
Subdivision, Map Book 22, Page 5 of the Pender County Registry. The dimensions
of the property are approximately an average of 64' wide x 1100' long. The
elevation of the tract ranges from 1.0' msl to 10.8' msl or NGVD. A portion of
the tract between NC 50 and the coastal wetlands present appeared at the time
of the site visit to be adjacent "404" wetlands. This area was visited by the
Corp's area coordinator for Pender County and the "404" wetlands were
identified. According to the applicant, the Corp's representative indicated
that a structure on pilings with no fill could be placed within the area
identified as "404" wetlands. The coastal wetland border on the property is
approximately 700' wide. Species include Juncus roemerianus, Distichlis
spicata, Salicornia spp., Limonium spp., Borrichia frutescens, Spartina patens,
and dwarf Spartina alternaflora. The Spartina alternaflora is scattered with
other vegetation types through the area of the lot where it occurs except just
adjacent to the waters of Topsail Sound. The applicant's surveyor used Corps
of Engineers survey information to establish the mean high water elevation
(mhw) on the property. Based on the applicant's information and personal
observations, it appears that the survey is more or less accurate. The
majority of the marsh is irregularly flooded. The water depths just waterward
of the marsh edge are approximately -2.5" mlw. The waters are classified as SA
and are open to the taking of shellfish. The Division of Marine Fisheries has
not designated these waters as a primary nursery area.
The applicant proposes to construct a house and to build a pier with "T" head
dock to serve the property. The house is shown on the plans located
approximately 210' west of NC 50. The dimensions of the structure are shown as
48' x 40'. The pier will begin approximately 50' landward of the edge of the
coastal wetlands. It will extend waterward for a distance of approximately
750' to the northwest. At this point, it will turn to a more southwesterly
direction for an additional 110' and will terminate in a 40' x 6' "t" head.
The turn in the pier is due to the apparent riparian access corridor.

10. ANTICIPATED IMPACTS
Although not considered to be fill, the location of a structure within "404"
wetlands does not appear to be exercising the best professional judgement
concerning discretionary authority for the use of the applicant's property.
Due to the relative nearness of adjacent section 10 wetlands to the building
site, it seems highly probable that eventually flooding problems may occur
causing the applicant to seek authorization to fill underneath the structure as
well as any access corridor needed to reach the structure. The problem has
been observed further south on the island where high marsh species have invaded
the area underneath a residential structure. This structure was apparently
built on high ground or marginal "404" which over time was lowered due to sheet
erosion. The location of the applicant's structure is not within a CAMA AEC.
The pier crosses a fairly broad expanse of mixed coastal wetlands. The
stagnant nature of the surface water observed within the marsh and the lack of
pure stands of Spartina alternaflora made the identification of the approximate
location of the mean high water contour relatively difficult. However, the
overall length of the structure over such an expanse of marsh has a potential
impact on coastal wetland resources. The applicant has minimized these impacts
by reducing the width of the structure to 3'. The property will be served by
municipal water and sewer from the Town of Surf City.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 fora detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
