The Application provides adequate assurance that the discharge of fill material into the waters of Tubb's Inlet Bay in conjunction with the proposed rip rap in Brunswick County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related. discharge (increases such that the turbidity in the Stream is 50 NTU's or less are not considered significant). 2. That the rip-rap material be of such size as to not be washed away by wind on tidal action and consist of clean rock or masonry material free of debris or toxic pollutants. 3. That where the rip rap material is to be placed below the mean high water mark, the applicant shall take all reasonable steps to minimize the adverse effects on water quality. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 16th day of November, 1989. PROJECT DESCRIPTION The project sites are located at the ends of three 10' easements leading to Tubb's Inlet Bay from Canal Drive adjacent to 1401, 1501, and 1601 Canal Drive. Site A - is located at 1401 Canal Drive., The bank is covered by small rip-rap material approximately 20' in width measured from the high ground waterward. Site B - is located at 1501 Canal Drive. An existing bulkhead is at this location. The rip-rap gravel is approximately 12' wide at this point. Site C is located at 1601 Canal Drive. This shoreline also has an existing bulkhead. The rip-rap is also approximately 12' wide at this location. Tubb's Inlet Bay is the reminant of the earlier location of Tubb's Inlet. It was filled by man-made activities several years ago. It is a "blind gut feature". The waters are classified as SA and are closed to the taking of shellfish. Although not a primary nursery area it is a blue channel crab spawning area. The majority of the southern shoreline has been bulkheaded or rip-rapped in the past by the developer and subsequent property owners. No coastal wetland species are found within the project sites. The applicant proposes to take the following action at the three sites: Site A - A catch basin and drain pipe will be installed along the north side of Canal Drive. The drainpipe will extend easterly approximately 100' and will then turn to the north within the 10' wide Town easement. This pipe will be installed on a grade of 1" fall in 25 linear feet. The pipe will be extended through the existing bank. The discharge will be confined within a 16' long x 20'wide x 2' deep rip-rap splash bed. Site B - At this location, the catch basin and drainpipe will be installed on the north side of Canal Drive. The pipe will extend easterly to the 10' easement and then to the north. It will be installed into the same fall as that at site A. At this location, the pipe will be installed through the bulkhead about 2-2 1/2' above the base. The rip-rap splash bed will be approximately 16' long x 12' wide x 2' deep. Site C - At this location, the catch basin will be installed right at the 10' easement, then the pipe will extend northward within the easement with the same degree of fall as the other two. The pipe will also be installed through the existing bulkhead and the rip-rap splash bed will be approximately 16' long x 12" wide x 2' deep. Town of Sunset Beach Page three 10. ANTICIPATED IMPACTS Rain water at all three locations creates a traffic hazard when ponding occurs. In order to maximize the efficiency of the system, maintainable silt trays should be incorporated within the catch basins. Submitted by: C. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the ad- jacent waterfront (riparian) landowners. These in- dividuals have 30 days in which to submit comments on the proposed project to the Division of Coastal Manage- ment and should be advised by the applicant of that op- portunity. A preliminary review indicates that a 401 Water Quality Certification will be required from our Division due to the proposed rip-rap fill. A 401 Certification is required prior to issuance of a CAMA Permit. The project as proposed will result in direct discharge of stormwater runoff to the SA surface waters of Tubb's Inlet Bay. Such a discharge has the potential to adversely impact water quality, best usage, or otherwise violate water quality standards. Therefore, the project should include best management practices to minimize stormwater impacts to the SA waters of Tubb's Inlet Bay. The following best management practices are suggested. 1) The catch basins should include a length of infiltration trench prior to discharge. PROJECT DESCRIPTION The project sites are located at the ends of three 10' easements leading to Tubb's Inlet Bay from Canal Drive adjacent to 1401, 1501, and 1601 Canal Drive. Site A - is located at 1401 Canal Drive. The bank is covered by small rip-rap material approximately 20' in width measured from the high ground waterward. Site B - is located at 1501 Canal Drive. An existing bulkhead is at this location. The rip-rap gravel is approximately 12' wide at this point. Site C - is located at 1601 Canal Drive. This shoreline also has an existing bulkhead. The rip-rap is also approximately 12' wide at this location. Tubb's Inlet Bay is the reminant of the earlier location of Tubb's Inlet. It was filled by man-made activities several years ago. It is a "blind gut feature". The waters are classified as SA and are closed to the taking of shellfish. Although not a primary nursery area it is a blue channel crab spawning area. The majority of the southern shoreline has been bulkheaded or rip-rapped in the past by the developer and subsequent property owners. No coastal wetland species are found within the project sites. The applicant proposes to take the following action at the three sites: Site A_ - A catch basin and drain pipe will be installed along the north side of Canal Drive. The drainpipe will extend easterly approximately 100' and will then turn to the north within the 10' wide Town easement. This pipe will be installed on a gradejof 1" fall in 25 linear feet. The pipe will be extended through the existing bank. The discharge. will be confined within a 16' long x 20'wide x 2' deep rip-rap splash bed. Site B - At this location, the catch basin and drainpipe will be installed on the north side of Canal Drive. The pipe will extend easterly to the 10' easement and then to the north. It will be installed into the same fall as that at site A. At this location, the pipe will be installed through the bulkhead about 2-2 1/2' above the base. The rip-rap splash bed will be approximately 16' long x 12' wide x 2' deep. Site C - At this location, the catch basin will be installed right at the 10' easement, then the pipe will extend northward within the easement with the same degree of fall as the other two. The pipe will also be installed through the existing bulkhead and the rip-rap splash bed will be approximately 16' long x 12" wide x 2' deep. Town of Sunset Beach Page three 10. ANTICIPATED IMPACTS Rain water at all three locations creates a,"traffic hazard when ponding occurs.
