The Subject application has been reviewed for water quality impacts and the following comments are offered: a. The project, as proposed, will not require a Section 401 Water Quality Certification. b. Construction of the proposed marina is expected to result in closure of open shellfishing waters according to information from DHS Shellfish Sanitation Branch. The closure of these shellfish waters would constitute the loss of an existing use of shellfishing, if there is a resource and use presently existing. Division of Marine Fisheries should be consulted to determine whether there is an existing resource and use for shellfishing. The loss of an existing use would constitute a violation of the Antidegradation Policy of the Water Quality Standards. C. If the automatic closure of the open waters will result in the loss of an existing shellfishing use, it is recommended that the application be denied. NARRATIVE DESCRIPTION: Applicant's property is an 85 acre undeveloped tract located off SR 1321, on Broad Creek near Pamlico, in Pamlico County. The tract consists of mixed pines and hardwoods with elevations ranging up to 7' above sea level. The primary man-made feature existing on the tract is a dirt road with side ditches. A marsh fringe consisting of Juncus roemerianus and Spartina cynosuroides borders much of the eastern portion of the property along Broad Creek. Coastal wetlands also occur along Sandy Branch on the western property boundary and along North Creek on the northeastern corner of the property. The waters of Broad Creek are classified as a Primary Nursery Area by the Division of Marine Fisheries, designated as 'SA' by the Division of Environmental Management, and are open to shellfishing by the Division of Health Services. Water depths along the proposed project are from 0-5' MSL. The proposed project is a 14 slip residential community marina and a community boat ramp with courtesy docks. The proposed marina pier is 140' long x 6' wide with 2' wide x 17' long finger piers with tie pilings. The proposed boat ramp is 36' x 22' and will be constructed through highground. Two (2) 3' x 36' courtesy piers are to be constructed in association with the boat ramp. The proposed marina is to serve a proposed 36 home residential subdivision with average lot sizes of 2.2 acres. Stormwater Management Plans and Sedimentation Erosion Control Plans have already been submitted. No impervious surface area is proposed within the estuarine shoreline Area of Environmental Concern, except for the concrete at the boat ramp. The existing dirt road will be paved with asphalt. Water will be supplied by the Pamlico County water system and individual septic systems are planned for each lot. 10. ANTICIPATED IMPACTS: The proposed 14 slip marina, docks and piers will cover approximately 7,146 sq. ft. of public trust waters and the boat ramp will fill approximately 320 sq. ft. of shallow estuarine bottom area with 4 cu. yds. of concrete. Approximately 14 cu. yds. of highground material will be excavated for the boat ramp and the materials will be placed on Lot #35. PREPARED BY: W. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by the applicant.
