PROJECT SUMMARY: Applicant is proposing to construct a dock into Nelson Bay and to pump and discharge water via pipelines to serve a proposed clam hatchery facility. NARRATIVE DESCRIPTION: The applicant's property consists of an approximately 100 ac. tract of land located adjacent to US Hwy. 70 East and Nelson Bay, near the community of Stacy, Carteret County. The vast majority of this property has been previously classified either as coastal wetlands or pocosin 404' wetlands. The only highground are spoil areas that resulted from pond excavation which occurred some years ago and an existing road which goes through the property. This property was the subject of an earlier permit application by the applicant in which he proposed to construct a clam hatchery facility at this site. The original application proposed the excavation of a water intake canal through an approximately 600' border of coastal wetlands and the filling in of coastal and pocosin wetlands. This permit application was ultimately denied in 1987. Since that time, the applicant has constructed an approximately 100' long x 38' wide building on this property in which to set up a clam hatchery operation. The applicant is now requesting a permit to get water to the hatchery via pumps and pipes and would eliminate any excavation or filling of wetlands. Plans included with the application show that an approximately 70' long x 4' wide pier is proposed to be constructed at the water's edge in which an approximately 20' long x 4' wide section would extend over the waters of Nelson Bay, while the remaining 50' x 4' section would be over Spartina alterniflora and Juncus romerianus marsh. On top of the dock, an approximately 70' long x 8" wide x 8" high fiberglass trough is proposed in which a submergible pump in Nelson Bay would pump water into the trough so that foreign materials could be screened out. From the trough, water will be discharged by gravity into an existing pond via a 6" ABS pipe. From the pond, water would be moved to the existing building via a pump and 4" PVC pipe. Discharge water from the clam hatchery building would be sent back to the existing pond by a 4" PVC pipe and from the pond to an existing "gut" off of Nelson Bay by a 6" ABS pipe. Gravity will be used to move the water in the discharge phase. All of the intake and discharge lines are proposed to be placed directly on wetlands vegetation. No excavation of filling of coastal or 1404' wetlands is proposed. 10. ANTICIPATED IMPACTS: The project, as proposed, will result in the construction of an elevated pier structure over approximately 200 sq. ft. of coastal wetlands and . approximately 80 sq. ft. of water area of Nelson Bay. Approximately 1100 ln. ft. of 6" ABS pipe and approximately 860 ln. ft. of 4" PVC pipe will be placed directly on the existing elevation of marsh or '404' wetland areas. The exact quantity of water to be withdrawn is not know, but, should not be significant. The discharge water should also not contain any significant pollutants or cause water quality problems, but the N.C. Division of Environmental Management will be asked to evaluate these concerns. Type of fill material 8 ADDITIONAL INFORMATION In addition to the completed application form, the follow- ing items must be submitted: A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected property. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to cant' out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 1J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 16 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the ad- jacent waterfront (riparian) landowners. These in- dividuals have 30 days in which to submit comments on the proposed project to the Division of Coastal Manage- ment and should be advised by the applicant of that op- portunity. b.
