The NCDWR is very concerned with sediment and erosion impacts that couLd result from this project The NCDOT shzll address these concerns by describing the potential impacts that may occur to the aquatic environments and any mi[igating factors that would reduce the impacts. 7. An analysis of cumulative and secondary impacts anticipated as a result of this project is required. 'fhe type and detail of analysis shall conform to the NC Division of Wrter Resource Policy on the assessment of secondary and cwnulative impacts dated April IQ 2004. 8. The NCDOT is respec[fi�lly reminded tha[ all impac[s, including but not limited to, bridging, fill, excavation and clearing, and rip rap to jurisdictional wetlands, sh�eams, anA riparian buffers need to be included in the final impact calculalions. These impacts, in addition to any construction impacts, temporary or otherwisq also need to be included as part of [he 401 Water Quality Certification Application. Where streams must be crossed, the NCDW R prefers bridges be used in lieu of culverts. However, we realize that economic considerations often require the use of culverts. Please be advised that culverts should be countersunk [o allow unimpeded passage by fish and olher aquatic organisms. Moreover, in areas where high quality wetlnnds or sheams are impacted, a bridge may prove preCerabla When applicable, Ihe NCDOT should not install �he bridge bents in Ihe creek, to the maximum es[ent practicable. 10. Whenever possible, tlie NCDWR prefers spanning structures. Spanning structures usually do not require work within the stream or grubbing of the sheambanks and do not require stream channel realignment The horizontzl and vertical clearances provided by bridges shall allow for human and wildlife passage beneath Ihc structw�e. �ish passage and navigation by canoeists and boaters shall not be blocked. 6ridge supports (bents) should not be placed in the stream when possible. 1 I. Detailed field delineation is required to determine the presence or absence ofjurisdictional resources within thc project limits. In addition, NCDOT must provide �n estimate to any resources located witliin the cons�ruction limits of the project area before we can specitically comment on NCDWR pennit eligibility. Final permit aulhorization will require ihe submiUal of a formal application by the NCDO"I' and written concurrence from the NCDWR. Please be aware tl�at any approval will be con[ingent on appropria[e avoidance and minimization oP wetland and stream impacts to the maximum extent practical, the development of zn acceptable stonnwater management plan, and the inclusion of appropriate mi[igation plans where appropriate. 16. If concrete is used during consuvction, a dry work area shall be maintained to prevent direct contact between curing concrete and stream water. Water that inadvertently contacts uncured concrete shall not be discharged to surface waters due to the potential for elevated pH and possible aqualic life and fish kills. Concrete shall be handled in accordance with the NPDGS Construction General Permit NCG010000. 17. If temporary access roads or detow's are construcled, lhe site shall be graded to i[s preconstruction contours anA elevations. Disturbed areas shall be seeded or midched to stabilize the soil and appropriate nntive woody species shall be planted. When using [emporary s[ruchires the area shall be cleared but not grubbed. Unless o�herwise authorized, placement of ciJverts and other slructures in waters and strcams shall be placed below the elevation of the streambed by one foot for all culvm�ts with a diameter greater tlian 48 inches, and 20 percent of tlie culvert diameter for culverts having a diameter Iess than 48 inches, to allow low flow passage of wa[cr and aquatic lifc. Design and placement of culverts and other structures including temporary erosion conhol measm�es shall not be conducted in a manner tliat may result in dis-equilibrium of wetlands or streambeds or bznks, adjacent to or ups�ream end downsh'eam of the above structwes. The applicant is required to provide evidence thTt the equilibrium is being maintained if requested in writing by the NCDW R. If ihis condition is unable to be met due to bedrock or other limiting features encountered during construction, please contact the NCDWR for guidance on how to p�roceed and to determine whether or not a permit modifica[ion will be required. 19. If multiple pipes or barrels are required, Ihey shall be designed to mimic natural stream cross section as closely ns possible including pipes or bzrrels at Flood plain elevation, floodplain benches, and/or sills may be required where appropriate. Widening the sh�eam channel should b¢ avoided. Stream chaunel widening at the inle[ or outlet end of shuctures typically decreases waler vclocily causing sediment deposition that requires increased maintenance and disrupts aquatic liCe passage. 20. While the use of National Wetland Inventory (NWI) maps, NC Coastal Rcgion Evzluation of Wetlaud Signiticance (NGCREWS) maps and soil survey maps are useful tools, their inherent inaccuracies require that qualified personnel perform onsite weHand delineations prior to permit approval. 24. Lleavy equipment should bc operatcd fi�om the bank rather [han in stream chTnnels in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into streams. This equipment shall bc inspected daily aud maint�ined to prevent contamination of surface waters h�om leaking fiiels, lubricants, hydrnidic fluids, or other toxic materials. 25. Riprap shall not be placed in the active thalweg channel or placecl in the streambed in a manner that precludes aquatic life passage. E3ioengineering boulders or structures should be properly designed, sized and installed. 26. Riparian vegetation (native trees and shrubs) shall bc prescrved to [he maximum extent possible.
