The Subject application has been reviewed for water quality
impacts and the following comments are offered:
a) Originally this project was expected to require a 401
Water Quality Certification. However, Mr. Gregson had a
phone conversation with Mr. Chesson on August 23 and Mr.
Chesson stated that the excavation would be accomplished
by dragline. If the dragline is used the project will
not require a 401 Certification.
b) It is recommended that the following be included as
conditions of the permit.
1) That the project shall not cause turbidity outside
of the immediate area of construction to exceed 25
NTU.
2) That silt fences and other erosion controls shall
be in place prior to placement of any spoils on the
site.

PROJECT DESCRIPTION: The applicant is proposing to maintenance
dredge a man-made canal and entrance channel.

The project has been reviewed to determine impacts to water
quality. The following comments have been provided.
The site was investigated on August 15, 1989.
During a phone conversation with the applicant on August 23,
1989, Mr. Chesson stated that a dragline would be used to
excavate the canal. If a dragline is used, the project will not
require a 401 certification. Due to the fact that the project is
maintenance excavation of an existing canal, this office has no
objection, however it is recommended that the following
conditions be incorporated into the CAMA permit.
1. That the project not cause turbidity to exceed 25 NTU
outside the project area.
2. That silt fences and other erosion controls be in place
prior to placement of any spoils on the site.

Dear Mr Chesson:
The Wilmington Regional Office received your CAMA
application on May 25, 1989. A preliminary review indicates that
a 401 Water Quality Certification will be required from our
Division due to the proposed wetland dredging. A 401
certification is required prior to issuance of a CAMA permit.
Because of the many essential functions wetlands provide,
including purification of surface and groundwater, any loss of
wetlands as the result of dredging or filling activities is
viewed by this office as degradation of water quality, and
potentially, a loss of these essential functions wetlands
provide.
Your project, as proposed, will result in the loss of
wetland areas. As a result, this office is requesting the
following additional information be submitted within 30 days upon
receipt of this letter: an alternate proposal that will
eliminate or reduce the proposed dredging in wetland areas; or
submit an explanation of why such reductions are not possible and
what mitigating factors we should consider.
Until this office receives your response, your proposal for a
401 Certification will be considered incomplete.

Thank you for your call in reference to cleaning out an existing canal
adjacent to our house in Swansboro. We would lke to encourage your approval
for our CAMA apllication for the follwing reasons:
1. The canal is an existing canal that was dug in the late Fifties, lack of
maintenance has caused the canal to close up creating a health hazard by
entraping stagnant water creating breathing grounds for mosquitos.
2. Actual dreding should be limited to a 150 feet of the canal to ensure
proper flushing for the changing of tides.
3. Dredging in our CAMA proposal was limited to the center of the canal in
an effort to protect the north and south bank by leaving in the marsh
grass.
4. We are consistent with current wetland policies in that we are extending
the estuary by extending the full use of the canal approximately 600 feet.
Currently only 30 to 40 feet of the canal exist for estuary benefit.
5. We will not fill in any wetland areas and will support the very con-
servative approach for protecting existing extuary.
6. Public value will have been achieved from providing a better health environment
as well as improving an estuary.
Please look very closely at a permit adjacent to this property being considered
for approving land use for boat storage which would create a hazard run-.off
?n-)this estuary and adjacent waters.

9. NARRATIVE DESCRIPTION: The applicant, Mr. Jerry S. Chesson,
owns Lot #9, a quarter-acre tract of land within W. I.
Herring Subdivision, located off Hwy. 24 and the AIWW, near
Swansboro, in the Town of Cedar Point, Carteret County. The
project site is a corner lot situated on Bogue Sound and an
old man-made canal that runs north/south along the west side
of the applicant's property. The referenced USGS
Topographic Map, entitled 'Swansboro', and the color aerial
photographs clearly show the project site with reference to
the surrounding area.
The applicant proposes to maintenance excavate the access
channel and canal measuring a total of 307' long x 20' wide
to a depth of -4' MLW. The resulting spoil approximately
900 cu. yds. of silty mud will be placed on the highground
property in two different spots near the canal. The canal

has not been used or maintenance in many years.
has completely filled with sediments and saltmarsh cordgrass
(Sartina alterniflora) completely occupies the old canal.
In addition, two small but distinctive patches of submerged
aquatic vegetation now occur at the mouth of the canal
within the access channel alignment. Each patch of eel
grass is estimated to be 10' long x 10' wide for a total of
approximately 200 sq. ft. In addition to the dredging
proposal, the application includes a request to reconstruct
the existing wooden bulkhead a total of 110' along the east
side of the canal. The new bulkhead will be installed on
the original alignment and will not involve any additional
fill on wetlands. The 'SA' surface waters of Bogue Sound
adjoining the project site are open to shellfish harvesting.
Although not shown on the application workplat drawing, the
applicant's property is equipped with a lengthy pier into
Bogue Sound, as well as, a wooden boat ramp allowing water
access.
10. ANTICIPATED IMPACTS: Although the proposed excavation is
classified as 'maintenance work' within a man-made canal and
access channel, the wetlands and eelgrass resources involved
with this project appear to be well-established and are a
significant part of the biological community. The proposed
project will directly displace an estimated 4,600 sq. ft. of
wetlands habitat.
11. LAMA REVIEW SECTION: The proposed project was reviewed with
regards to the 1986 Land Use Plan Update for Carteret
County. The highground property is classified as
'Transition/Residential' and the marsh and surface waters as

'Conservation'. The excavation of significant marsh habitat
and submerged grass beds is considered inconsistent with the
goals and objectives of the Land Use Plan where that
document endorses the CAMA Use Standards for Development as
they apply to the estuarine system of AEC's.

In addition to the completed application form, the
following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 ;1 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7].0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. 13lue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).

Reference the application of Mr. Jerry S. Chesson for a Department of the
Army permit to excavate a channel and canal off the Atlantic Intracoastal
Waterway (AIWW), Bogue Sound, Cape Carteret, Carteret County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report. By letters of June 6, 9
and 16, 1989, the U.S. Environmental Protection Agency (EPA), the U.S. Fish
and Wildlife Service (USFWS) and the National Marine Fisheries Service (NMFS)
recommended that the application be denied. The agencies are concerned
becaused the proposal would result in excavation of salt marsh cordgrass
(Spartina alterniflora) and submerged aquatic vegetation while the applicant's
ripariran access has already been established through construction of a pier
and boatramp. lie concur with the agencies' recommendation that the permit not
be issued.

Dear Mr Chesson:
The Wilmington Regional Office received your CAMA
application on May 25, 1989. A preliminary review indicates that
a 401 Water Quality Certification will be required from our
Division due to the proposed wetland dredging. A 401
certification is required prior to issuance of a CAMA permit.
Because of the many essential functions wetlands provide,
including purification of surface and groundwater, any loss of
wetlands as the result of dredging or filling activities is
viewed by this office as degradation of water quality, and
potentially, a loss of these essential functions wetlands
provide.
Your project, as proposed, will result in the loss of
wetland areas. As a result, this office is requesting the
following additional information be submitted within 30 days upon
receipt of this letter: an alternate proposal that will
eliminate or reduce the proposed dredging in wetland areas; or
submit an explanation of why such reductions are not possible and
what mitigating factors we should consider.
Until this office receives your response, your proposal for a
401 Certification will be considered incomplete.
