The proposed project does require a 401 Water Quality Certification but does meet the requirements for General Certification No. 1272 for construction of bulkheads. b. The proposed project involves the dredging of four foot depth when adjoining waters are only two feet deep. With the new excavation to be deeper than the waters to which they drain, the probability of stagnant water and dissolved oxygen depletion occurring in the newly excavated areas is high due to the poor flushing characteristics of such an arrangement. C. The applicant has not provided adequate information concerning the specific location for spoil disposal and adequacy of containment of these spoils to prevent re-entry of the dredged materials into surface waters. It is recommended that the permit not be issued due to the problems cited above. PROJECT SUMMARY: Applicant proposes to dredge existing boat basin to a depth of 41. build a 161X4' dock.with a 121X4' "L" platform and build 390' of bulkhead an average of 5' waterward of NWL and the existing deteriorated bulkhead. This construction will take place on the southside of the basin and along the shoreline in front of the ant's residence. RICHARD CALHOUN BIO REPORT PAGE 2 SITE DESCRIPTION . The applicant's property is a 3 acre tract located along the Currituck Sound, 75 yards north of the end of Halls Harbor Road, Harbinger, Currituck County. The lot consists of' approximately 1.6 acres of woods and 1.4 acres of cleared land (site of the applicant's vacation home). Roughly separating the wooded and cleared tracts is a 180' X 27' boat basin. Presently there exists a single family dwelling, a 16' X 20' storage shed (built over the landward end of the boat basin) and two finger piers (10' X 2' and 8' X 2') extending into the boat basin. The boat basin and shoreline were bulkheaded years ago. The condition of the bulkhead along the shoreline is extremely poor. Only remnants of the bulkhead exist along the shoreline of the wooded tract. The NWL in this area stands approximately 20' landward of the bulkheads remaining pilings. Though the bulkhead along the shore of the cleared tract still functions, erosion has taken place behind it. The NWL stands as far back as 8' landward of the existing bulkhead in several eroded pockets. The boat basin has silted in over time. It's present depth averages 15". Eurasian water milfoil and Widgeon grass (Ruppia maritima) are abundant in the basin. The elevation of the site is approximately 3' above mean high water. The soil in this area is sandy. Vegetation on the cleared tract is primarily lawn grass with a scattering of Prickly Pear (Opuntia sp.). In the more severely eroded pockets are cat-tails (Typha sp.) and Broomsedge (Andropogan virginicurs). One low spreading Juniper (Junipersus sp.) and several Willow (Salix sp.) make up the remaining shoreline vegetation on the project tract. The wooded tract is dominated by mature stand of Loblolly pine (Pinus taeda). The applicant proposes to construct 390 ' of bulkhead 5' waterward of the existing bulkhead along the boat basin and south of the cleared tract. In addition, he seeks approval to dredge a 10' wide channel the length of the basin (180'), extending 20' into the sound. He proposes to build a 16' X 4' pier with a 12' X 4' "L" platform into the sound. The proposed project will excavate approximately 296 cubic yards of material from the boat basin. The applicant desires to put this material on two upland sites located on the cleared tract of lands and to fill in behind the proposed bulkhead. Submitted by: Richard L. 'of which will come out of estuarine waters. Bulkheading will result in the filling of 1035 sq. ft. of shallow water habitat in the basin and 915 sq. ft. landward of the existing deteriorated bulkhead.
