In response to the stated concern with item #5, and prior to State's acknowledgement of the City's delegated local
jurisdiction,over this project, we will provide a grading plan to the City of Graham and their review staff for the entire
site at 1"=40' in order to comply with item 5 concerns as required as soon as possible.

As Josh's comment #5 notes, there is concern that the project is proposing impacts to buffers that may not be
allowable. It would be inappropriate for me to issue a 401 approval when the plans that have been provided to DWR
and to the City indicate that the project, as designed, may not comply with the Jordan Lake Buffer Rules.

Please find attached my comments about the 1-40 Drive -In on behalf of the City of Graham. This review was only for
the riparian buffer permitting and did not include any other items on the plan. The review comments as well as the
redline comments on the drawings are included. My understanding is that Glynn has previously provided more
comprehensive TRC comments already.
