CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to William H. Black, Jr. pursuant to an application filed on the
2nd day of February, 1989 to construct two gabion jetties in
Albemarle Sound.
The Application provides adequate assurance that the
discharge of fill material into the waters of Albemarle Sound in
conjunction with the proposed gabion jetties in Chowan County
will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted
in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less are not
considered significant).
2. That the gabion material be clean rock or masonry,
free of toxic pollutants.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.
This the 6th day of July, 1989.

SUBJECT: MAJOR MODIFICATION REQUEST TO CAMA PERMIT #50-85
DATE: May 10, 1989
William H. Black owns a 1 1/2 acre piece of property on SR
1129 with an address of Box 333-B Country Club Drive. On April
29, 1985 Mr. Black received CAMA major permit 450-85 which
authorized the construction of a 100' X 140' enclosed boat basin
in the Albemarle Sound. This basin was to be enclosed with steel
sheet piles. On October 24, 1985, CAMA permit 450-85 was
modified to include the construction of several docks within the
permitted boat basin. On May 30, 1986, CAMA permit 450-85 was
modified a second time to include the excavation of a 960' long
by 50' wide by 4' deep access channel with two 50' long steel
sheet-pile jetties extending out from the boat basin.
To date all construction has been completed except the two
50' jetties extending out from the basin on either side of the
access channel. Mr. Black is requesting to modify CAMA permit
450-85 to allow him to construct the two 50' jetties out of
gabions instead of steel sheet piles as previously permitted.
Mr. Black proposes to construct the gabion jetties by laying
concrete piles on the bottom and then stacking the gabions,
pyramid fashion, on top. The gabions as proposed would extend
no further than 3' above NWL.
The gabions as proposed would cover approximately 1000 sq.
ft. of shallow-water habitat. Some localized, short-termed
turbidity would result during the construction of the jetties.

SUBJECT: MINOR MODIVICATION REQUEST TO CAMA PERMIT 450-85
DATE: May 1, 1989
This office received a request to modify LAMA permit 450-85
issued to William H. Black on 4/29/85, modified on 10/24/85 and
on 5/30/86 and renewed on 12/28/88. This permit authorized
i William H. Black to construct- a boat basin with a steel sheet
pile breakwater enclosing the area. Mr. Black further received
authorization to excavate inside the basin as well as an access
•-bhannel 960' long by 50' wide. Two 50' steel, sheet-pile jetties
were authorized to be constructed on-either side of the channel
out from the basin.
Mr. Black has requested (see attached letter and plat) to
construct the two 50' jetties with gabions instead of the steel
sheet-piles. Mr. Black feels these structures would dissipate
wave energy and provide improved protection for his basin.
This office has no objection to this minor modification and
recommends we modify LAMA permit 450-85 to incorporate this
request: We recommend this modification be subject to the
following conditions:
(1) The proposed gabion jetties will be constructed in strict
compliance with plats received and dated February 2, 1989 in the
Elizabeth City office of the Division of Coastal Management.
r (2) The gabions will be structurally tight and appropriately
affixed to preclude their breakup and/or relocation by wave
energy.
(3) The sandy bottom. will be disturbed only to the minimum
necessary to construct the jetties.
Your prompt attention to this minor modification is
requested as this request was misplaced for several months.

Dear Mr. Griffith:
I would like to request a modification to permit no. 50-85
issued to me for the construction of a boat basin.
The entrance jetties and a minimal amount of dredging in the
entrance channel are the only remaining construction items. It
is the jetties that I would like to change.
Since completing the basin, I have noticed that the
sheetpiling used to construct the enclosed basin tends to reflect
the wave energy and amplify the effects of each successive wave.
It very apparent, in that even the mildest southerly breeze
creates a hard chop in the basin while the surrounding sound is
relatively flat. When weather conditions produce two foot swells
in the sound it is not uncommon to see the bottom of my basin
which is four feet deep.
The modified jetties I am requesting will be constructed
with an open stack of concrete piling laid on the sound bottom to
act as a baffle, absorbing the wave energy. On top of this, I
plan to run one line of gabion baskets to further help dissipate
any incoming waves. As noted in the attached drawing, the
maximum height to-the top of the gabion baskets above normal
water would not exceed three feet.
I feel that the requested modification would be beneficial
to the basin and that the "openness" of the new design should
improve overall water circulation.
Your consideration and timely response to this request is
greatly appreciated.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
MAY 1 ; 1989
The Department of Natural Resources and Community
Development hereby gives public notice as required by. NCGS
113A-119(b) and 143-215 3(a)(1)(c) that WILLIAM H. BLACK, JR. of
Edenton, N.C., filed an application on February 2, 1989, for a
permit from the Division of Coastal Management to develop in an
Area of Environmental Concern and for certification from the
Division of Environmental Management that a discharge of fill
material in project wetlands will not violate applicable water
quality standards.
According to said application, WILLIAM H. BLACK, JR.
proposes to construct two 50' gabion jetties at his property
located on Country Club Drive, Edenton, Chowan County, N.C.
A copy of the entire application and additional information
may be examined (or copies furnished upon request and payment of
reproduction costs) during normal business hours at the office of
David R. Griffin, Division of Coastal Management, located at
Route 6, Box 203, Elizabeth City, N.C., (919) 264-3901, and/or
the office of Deborah Sawyer, Division, of Environmental
Management, NRCD Regional Field Office, Washington, N.C., 27889.
The Division of Environmental Management proposes to take
final action on this water quality certification on or before
June 12, 1989. The issuance of the CAMA Major Development permit
and the Section 401 Certification may deviate from this projected
date depending upon the nature of the comments submitted and
subsequent hearings that may result.
All persons desiring to make comments should do so in
writing to Mr. George T. Everett, Director, Division of Coastal
Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 2, 1989 for consideration in the CAMA permit decision, and
to Mr. Bill Mills, Division of Environmental Management, P.O. Box
27687, Raleigh, N.C., 27611, prior to June 2, 1989 for
consideration in the water quality certification decision. Later
comments on the CAMA application will be accepted and considered
up to the time of permit decision. Project modifications may
occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter
will be provided upon request.
