Box 3009 Bald Head Island, NC 28461-7000 Subject Property: Village Of Bald Head Island Beach Restoration Project REQUEST FOR MORE INFORMATION Dear Mr. Peck: On June 22, 2009, the Division of Water Quality (DWQ) received the Request for Modification of the 401 Water Quality Certification issued on May 7, 2009, to dredge 225.74 acres of offshore shallow bottom area and place beach compatible sand on 110 acres of inter tidal area and near shore shallow bottom below the Mean High Water (MHW) contour and 125.54 acres above the MHW contour, pursuant to the application filed on the 30`h day of March of 2009. The Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC) have determined that the proposed project would occur during the Sea Turtle Nesting Area moratorium. Because of this proposed date for work occurring during this moratorium, the DWQ has determined that significant uses could be removed or degraded by this project. Therefore unless modifications of the proposal are made to alleviate the concerns of DMF, we will recommend moving towards denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: If the project is modified to address the concerns of the Division of Marine Fisheries and the Wildlife Resources Commission and there are no other objections, DWQ will have no objection to the project. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Ian McMillan, 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned.
