Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Freestanding Mooring 1) This permit authorizes only the mooring buoy and uses located in or over the water that are expressly and specifically set forth in this permit. No other structure, whether floating or stationary, shall become a permanent part of this mooring without permit modification. No non-water dependent or commercial uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) To prevent the mooring and the attached vessel from becoming a hazard to navigation, the mooring buoy shall be located such that the arc of the swing, including the vessel to be moored, do not exceed one-fourth the width of the waterbody. In this case, one-fourth equals ±1056 feet. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Stephan Horvath ADDITIONAL CONDITIONS Permit #90-05 Page 2 of 3 3) Freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and NC Wildlife Resources Commission requirements and the required marking maintained for the life of the mooring. 4) Freestanding moorings shall bear the owner's name, state vessel registration and/or the U.S. Customs Documentation numbers. Required identification shall be legible for the life of the mooring. 5) The type of material used to anchor the mooring buoy shall be non-polluting and of sufficient weight and design to safely anchor the buoy and vessel. 6) If the use of any freestanding mooring is discontinued for a period of 12 month or more, it shall be removed by the permittee. 7) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharge at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at, or adjacent to the authorized work. 9) The authorized mooring and associated vessel shall not cause an unacceptable interference with navigation. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions'of this permit. The permittee shall not be relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 11) This permit shall-not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. General NOTE: The permittee is cautioned that this permit does not authorize the placement of tie pilings. NOTE: This permit does not eliminate the need to obtain any state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3490 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or LAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. Stephan Horvath Sandy Landing Subdivision Beaufort County Project setting The project site is located at 2940 Sandy Landing Road (lot #5) in the Sandy Landing Subdivision off SR 1945 on South Creek near the Town of Aurora in Beaufort County, North Carolina. The property is bulkheaded with a house on the lot and has ±100' of shoreline. The site is vegetated with pines, several hardwoods, shrubs, and maintained lawn grass. The property is ±10 feet above the normal water level. The adjacent property on the downstream (east side) is a developed lot with a pier and bulkhead and it is vegetated similarly to the applicant's. The upstream (west side) adjacent property has a bulkhead but is otherwise undeveloped. This property is vegetated with pines, hardwoods, shrubs, vines, and some upland grasses. South Creek at this site is classified as SA-NSW by the Environmental Management Commission. South Creek is not open to shell fishing. South Creek is classified as a Special Secondary Nursery Area by the Division of Marine Fisheries. Project description The applicant proposes to install a mooring buoy ±750'offshore of the existing bulkhead. A fluke anchor (similar to Danforth type) is proposed with a 38' chain, a 25' lead line and a 37' sailboat for a total of 100' creating a swing radius of 200'. With a 100' shoreline, the swing radius will project 50' onto the adjacent riparian property owners, who have been notified of the proposal. South Creels is ±4,224' wide at the project location. Existing water depth at the proposed mooring buoy location is ±7' below the normal water level. Anticipated impacts The project as proposed will result in an area of swing of ±31,400 ft' on South Creek. The project as proposed will result in localized turbidity as a result of the construction activities. David W.
