HomeMy WebLinkAbout20180944 Ver 1_USACE Permit_20181108Regulatory Division Action ID: SAW -2018-01358 DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS 69 DARLINGTON AVENUE WILMINGTON, NORTH CAROLINA 28403-1343 November 8, 2018 Carteret County Attn: Mr. Greg Rudolph, Carteret County Shore Protection Office Post Office Box 4297 Emerald Isle, North Carolina 28594 Dear Mr. Rudolph: Please reference the Carteret County's June 12, 2018 and subsequent October 24, 2018 request, submitted by your agent, Moffatt and Nichol Engineers, to modify the Department of the Army (DA) permit issued on November 8, 2018 to conduct the first nourishment event (Project #1) under the 50 -yr Bogue Banks Master Beach Nourishment Plan during the 2018/2019 dredging window. The plan for Project #1 calls for 945,500 cy of material, dredged from the Current and Old ODMDS, to be placed along 5.1 miles of shoreline in Emerald Isle, Indian Beach, and Salter Path, Carteret County, North Carolina. Upon the review of the County's request, our office has determined that the modification of the November 8, 2018 can be authorized pursuant to Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act provided adherence to all new, modified, and applicable original conditions. This authorized modification is limited to the planned upcoming Project #1 event, and will not be applicable to any subsequent events. The expiration date for this permit modification is December 31, 2021. 1) New Special Conditions: a. All beach fill material will originate from the Old and Current ODMDS and no other sources shall be utilized. No dredging will occur outside of the predetermined boundaries of the ODMDS borrow source and dredging depths will be confined to the depths specified in Special Condition (11) of the original November 8, 2018 Department of the Army authorization. b. All beach fill placement activities will be confined to the locations and amounts specified in the October 24, 2018 and attached plans. c. BOEM will be the lead federal agency for all Section 7 (Endangered Species) and Section 106 (cultural resources) coordination associated with all dredging activities and the transport of material by hopper dredges to the booster pumps. The U.S. Army Corps of Engineers (USAGE) will be the lead federal agency for all Section 7 (Endangered Species) and Section 106 (cultural resources) coordination associated with all beach placement activities occurring above the Mean Low Water. Special Condition (1): All work authorized by this permit must be performed in strict compliance with the attached plans and project description outlined in your October 24, 2018 subsequent request, which are a part of this permit, and specified in the March 4, 2016 BBMBNP. Any modification to these plans must be approved by the U.S. Army Corps of Engineers (USACE) prior to implementation. All Special Conditions, as prescribed in the November 8, 2018 authorization and enclosed for your convenience, remain valid; and as a remainder, Special Condition (16) requires that a pre -construction meeting must be held prior to the proposed work to ensure the dredging engineering contractors fully understand the conditions of the original and modified authorizations.
