Enclosed with this letter is a copy of the draft NPDES permit renewal for your facility. Please
review this draft carefully to ensure thorough understanding of the requirements and conditions it
contains. There are several changes from the existing permit, including the following:
• Parameter codes have been added in the effluent monitoring sheets Sections A. (1.) and A.
(2.).
• A footnote has been added to the 4.0 MGD effluent monitoring sheet [Section A. (1.)],
requiring the facility to report annual average flow on the December Discharge Monitoring
Report, and to notify the Division once the annual average flow requires a move to the 6.0
MGD flow tier. See Section A. (1.), Footnote 3.
• Limits for Ammonia-Nitrogen (NH3-N) have been reduced based on North Carolina
ammonia-nitrogen criteria of 1.0 mg/L (summer) and 1.8 mg/L (winter). Changes are
tabulated below:

To allow time and actions toward meeting the proposed NH3-N limits,a 2-year compliance
schedule has been added to the permit with annual milestones;see Section A. (5.). Existing `
limits are retained as interim NH3-N limits in both effluent sheets [Sections A. (1.) and A.
(2.)] for the period of the compliance schedule,referred to in Footnote 5 of Section A. (1.) 4
and Footnote 4 in Section A. (2.).
• Instream (upstream and downstream) monitoring of Conductivity has been added to the
permit for all flow tiers, based on data review and the presence of industrial users
discharging to the facility. A review of instream data collected by the Yadkin-Pee Dee
River Basin Association (YPDRBA) from January 2013 through December 2016, and
compared with concurrent effluent data submitted by the Permittee, found that the effluent
appeared to be impacting the instream conductivity as downstream concentrations are
higher than those upstream, and effluent concentrations are higher than both. Instream
monitoring will be waived as long as the Permittee remains a member of the YPDRBA
monitoring coalition.
• The NC 2007-2014 Water Quality Standard(WQS)Triennial Review was approved by the
NC Environmental Management Committee (EMC) on November 13, 2014. The US EPA
subsequently approved the WQS revisions on April 6,2016 with some exceptions.The NC
Division of Water Resources NPDES Permitting Unit is required to implement the new
dissolved metal standards in all permits public noticed after April 6, 2016. The new
standards for most metals include acute standards. Further, the freshwater standards for
several metals are expressed as the dissolved form of the metals, and seven metals have
hardness-dependent equations. As a result, the NPDES Permitting Unit will need site-
specific effluent hardness data and instream hardness data, upstream of the discharge, for
each facility monitoring these metals in order to calculate permit limitations. Effluent and
upstream hardness sampling has been added to this permit at a monitoring frequency of
quarterly. See Sections A. (1.) and A. (2.) Effluent Limitations and Monitoring
Requirements for effluent sampling requirements.
• Based on the new water quality standards approved on April 6, 2016 for dissolved metals,
the following limits for Total Copper have been added to your permit:

Results of a reasonable potential analysis (RPA) on submitted data indicated a reasonable
potential to exceed the instream WQS. To allow time and actions toward meeting the new
Total Copper limits,a 3-year compliance schedule has been added to the permit with annual
milestones; see Section A. (6.). Interim monthly Copper monitoring was added to both
effluent sheets [Sections A. (1.) and A. (2.)] for the period of the compliance schedule,
referred to in Footnote 10 of Section A. (1.) and Footnote 7 in Section A. (2.).

• Total Phenols limits and monitoring requirements have been removed from the permit.
Results of an RPA on submitted effluent data found no reasonable potential to exceed the
instream WQS, as all data were below detection at< 50 µg/L.
• The Permittee reported Total Lead and Total Selenium at less than detection,with detection
levels < 3 µg/L and < 5 µg/L, respectively, in the three Effluent Pollutant Scans and the
Discharge Monitoring Results with one non-detect at < 10 µg/L for both parameters on
April 11,2017.The Permittee's allowable discharge concentrations are 12.7 µg/L for Total
Lead and 11.0 µg/L for Total Selenium at 4.0 MGD. DWR's laboratory identifies the
Practical Quantification Limits (PQLs) for Total Lead and Total Selenium as 2.0 µg/L and
1.0 µg/L, respectively. In accordance with 15A NCAC 2B .0500, all data generated for
Total Lead and Total Selenium shall be reported to the lower reporting level of the
procedure. The Permittee should test for Total Lead and Total Selenium down to the
recommended PQL. No limits or monitoring requirements for Total Cadmium or Total
Lead have been added to the permit.
• Effluent mercury was reviewed from February 2014 through January 2018. The Permittee
tested for Total Mercury using EPA test Method 1631E throughout this period. In
accordance with the 2012 Mercury TMDL NPDES Guidance,the Permittee needs to show
annual average effluent concentrations below the water Quality Based Effluent Limitation
(WQBEL) of 26.5 ng/L at 4.0 MGD and 21.7 ng/L at 6.0 MGD, and no exceedance of the
Technology Based Effluent Limitation (TEBL) of 47 ng/L. A review of the data at both
flow tiers showed that the annual averages were below the WQBEL and all data were below
the TBEL. Therefore, no mercury limitation is required, and the mercury limits of 27 ng/L
at 4.0 MGD and 22 ng/L at 6.0 MGD have been removed from the permit.
Forty-two (42) out of 48 low-level effluent mercury samples were over 1 ng/L. Because
your facility is greater than 2 MGD and discharges quantifiable levels of mercury(i.e.,> 1
ng/L), a Mercury Minimization Plan (MMP) requirement has been added to this permit
renewal at both tiers [see Section A. (8)]. Please note that the Permittee shall develop and
implement a MMP during this permit term. The MMP shall be developed within 180 days
of the NPDES Permit Effective Date, and shall be available for inspection on-site. A
sample MMP was developed through a stakeholder review process and has been placed on
the Division website for guidance (https://deq.nc.gov/about/divisions/water-
resources/water-resources-permits/wastewater-branch/npdes-wastewater-permits, under
NC Model Mercury Minimization Plan),

• Effluent Pollutant Scans shall be sampled in three years within the permit term per 40 CFR
122. The years Effluent Pollutant Scans shall be sampled are 2020, 2021 and 2022. In
addition, at the end of the Special Condition, 2nd species Toxicity Testing Requirements
for municipal permit renewals per Federal Regulations [40 CFR 122.21(j)(5)] have been
added. See Section A. (4.).
• A nutrient reopener special condition has been inserted to the permit to notify you that
DWR may reopen the permit to implement nutrient requirements in accordance with any

future TMDL and/or nutrient management strategy for High Rock Lake; see Section A.
(7.).
• Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports. The final NPDES Electronic Reporting Rule was adopted
and became effective on December 21,2015.The requirement to begin reporting discharge
monitoring data electronically using the NC DWR's Electronic Discharge Monitoring
Report (eDMR) internet application has been added to your final NPDES permit [see
Section A. (9.)].

Concurrent with this notification the Division is publishing a notice in a newspaper having
circulation in the general Iredell County area, soliciting public comments on this draft permit.

- certified laboratory\(including field certified),even if these values fall below 50 pg/L.
7. Total Nitrogen = TKN + NO3-I'.T•+ NO2-N, where TKN is Total Kjeldahl Nitrogen, NO3-N is Nitrate
Nitrogen,and NON is Nitrite Nitrogen.
8. Whole EffluentoTo city''will be monitored using the Pass/Fail Chronic Toxicity test with Ceriodaphnia
dubia at 45%effluent. Samples shall be taken in January,April,July, and October; see Section A. (3.).
9. Effluent Total Hardness sampling should be performed in conjunction with metals sampling.
10. The facility shall follow the Copper compliance schedule detailed in Section A. (6.). The Permittee shall
achieve compliance with these limits within three years of the permit effective date. Copper shall be
monitored monthly until the new limits become effective.
11. The Permittee shall preform three Effluent Pollutant Scans during the term of this permit; see Section A. (4.).
12. The Permittee shall sample instream hardness upstream of the facility's discharge. The sample shall be
representative of the hardness in the receiving stream.

A. (3.) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) [15A NCAC 02B.0200 et seq.]
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 45% at 4 MGD, and 55% at 6 MGD.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised- December 2010) or subsequent versions. The tests w91--be performed during the months of
January, April, July and October. These months signify the first month of each three-month toxicity
testing quarter assigned to the facility. Effluent sampling/for this testing must be obtained during
representative effluent discharge and shall be performed at,the NPDES permitted final effluent discharge
below all treatment processes. < '
If the test procedure performed as the first test of any single quarter results in a failure or ChV
below the permit limit, then multiple-concentration testing shall be performed at a minimum, in
each of the two following months as described m "North-Carolina Phase II Chronic Whole

A. (7.) NUTRIENT REOPENER FOR HIGH ROCK LAKE [NCGS 143-215.1 (b)]
Pursuant to N.C. General Statute Section 143-215.1 and the implementing rules found in Title 15A of
the North Carolina Administrative Code, Subchapter 2H, specifically, 15A NCAC 2H.0112(b)(1) and
2H.0114(a), and Part II, Sections B.(12.) and B.(13.) of this permit, the Division Director may reopen
this permit to implement nutrient requirements in accordance with any future TMDL, nutrient
management strategy, and/or nutrient criteria for High Rock Lake.

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in ani�area where less than 10 percent of the households have broadband
access, then a temporary'vaiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring .data"may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or

initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity
(EPA or the state authorized by EPA to implement the NPDES program) that is the designated entity
for receiving electronic NPDES data [see 40 CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic reporting tool for
each type of electronic submission and for each state. Instructions on how'.to'access and use the

electronic reporting,waiver, a permittee must first submit an electronic reporting waiver request to
the Division. Requests'for temporary eleetronrc"reporting waivers must be submitted in writing to the
Division for written approval at least sixty (60),days prior to the date the facility would be required
under this permit to begin submittingmonitoring data and reports. The duration of a temporary
waiver shall not exceed 5 years and shall thereupon expire. At such time,monitoring data and reports
shall be submitted electronically to the Division unless the Permittee re-applies for and is granted a
new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers
are not transferrable. Only permittees with an approved reporting waiver request may submit
monitoring data and'reports on paper to the Division for the period that the approved reporting
waiver request is effective.
