We are in receipt of your letter dated December 14, 2006 requesting additional
information concerning the above referenced project. Upon receipt of your letter we
called the office and spoke directly with Amy Chapman. We explained the situation of
the existing system and she instructed us to respond with a letter stating all the issues
involved with this project.
In response to your comment regarding the location of the stormwater pipe we have the
following information:
There is an existing 18" pipe at the location of the new 54" outlet pipe. This
location was chosen for the outlet of the drainage system because there was an
exiting outlet at this location. When we discussed this outlet with Kyle Barnes
from the Washington Regional office he agreed with the outlet location and did
not forsee any permitting issues since there was an existing outlet. The existing
outlets for the drainage system, two 24" pipes, would have to be removed and
replaced with one 60" pipe to carry the design storm. The problem with this
design alternative is the existing pipes are within ten feet of two building
structures. Both structures are residential houses or garage/ apartment buildings.
It is questionable as to whether new pipes can be constructed in this area without
having to remove the structures due to the depth of the drainage lines and the
closeness of the foundations of the buildings. Given this situation routing the
water to the location of the existing 18" outlet seemed the best alternative.
The purpose of the drainage project is to eliminate existing drainage pipes from
under existing houses. In several locations the city has determined there are
existing storm drainage pipes running under existing residential structures. It is
the intent of this project to remove these pipes and in doing so the size of the
pipes was investigated to ensure the design storm event could pass through the
system without creating standing water on the roadways.

• This project is being constructed to improve drainage in the neighbourhood.
During heavy rain events the neighbours have reported standing water in the
roadways creating hazardous driving conditions and in some cases impassable
streets. If the drainage outlet invert is changed to outlet prior to the creek the
pipe sizes of the system will increase due to the decrease in available head to
push the water through the system which will result in larger pipe sizes and
increased project cost.
• Because this subdivision is already 100% developed there are no areas for
providing pre-treatment to the stormwater prior to entering the drainage system.
• Also because of the location of the existing sewer outfall along the creek, GUC
would have to be made aware of any changes in this location of the outlet. In past
discussions they have been adamant about the location of the outlet of the storm
drainage pipe being past the existing sewer main.
We have also enclosed the US Army Corps of Engineers NW 13 permit for this
construction activity. Hopefully this information will assist you in making a decision
with regards to this project and the outlet of the storm drainage system. If you have any
questions or additional comments, please let us know.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWPs are scheduled to be modified,
reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the
date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit. If, prior to the
expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid
until the expiration date identified below, provided it complies with all new and/or modified terms and conditions. The District
Engineer may, at any time, exercise his discretionary authority to modify, suspend, or revoke a case specific activity's authorization
under any NWP.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management .
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.
