As proposed the project does not require a 401 permit, but if any future dredging is proposed the applicant ::-ill be required to do a shellfish survey and Submerged Aquatic Vegetation (SAV) survey. This Office also has concerns about the potential turbidity violations that will occur when the boats are operating in shallow waters. 15A NC AC 02B.0221 (2) States: Conditions Related To Best Usage. This permit, issued on August 24, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the 6 ft. x 605 ft. pier as measured from the landward edge of the coastal wetlands, terminating in an 8 ft. x 16 ft. platform, all as expressly and specifically set forth in the permit application and attached workplan drawing. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) All portions of the access pier located over coastal wetlands shall not exceed a width of 6 ft. and shall be slatted, wooden and elevated. Any portion of the access pier located over coastal wetlands shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuimz date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work shall cease when the permit expires on December 31, 2009 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Mana-ement Pro-ram. Jenny ADDITIONAL CONDITIONS Permit # 136-06 Page 2of3 3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. This corridor is determined by drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel or deep water line that intersects with the shore at the point where the upland property line meets the water's edge. 4) In order to ensure compliance with Condition No. 3 of this permit, an as-built survey showing the distance to the neighboring riparian corridors and the dimensions and location of the constructed pier and all associated structures shall be performed on the facility, and copies of the survey shall be provided to the Division of Coastal Management, within 60 days of completion of construction. C I_ NOTE: Failure to provide the survey required in Condition No. 4 may result in a violation of this permit. 5) No attempt shall be made by the permittee to prevent the full and free use by the public'of all navigable waters at or adjacent to the authorized work. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury that may be caused from existing or future operations undertaken by the United States in the public interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard. through regulation or otherwise, on the authorized facilities. At it minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal. relocation. or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby. without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 10) No vegetated wetlands or open waters areas shall be excavated or filled, even temporarily. Field Investigation Report: Raymond Jenny Page 02 9. Narrative Description: The project site is located on the northeast side of Harker's Island, adjacent to Eastmouth Bay, facing Brown's Island. This is a residential property located in a primarily residential area. The subject property is approximately 2.2 acres in size, and ranges from 0' to +7' msl in elevation. The southernmost portion of the property is upland, with the remainder characterized as Section 404 Wetlands/Coastal Marsh. The nhw line forms the interface between the high and low marsh on the property, with a definite elevation and species change demarcating the upland area. The north shore of Harker's Island is riddled with mosquito ditches, and this property is no exception. There is a narrow shore-parallel ditch connecting to a shore-perpendicular ditch that extends along the western property line northward into the bay. Another shore perpendicular ditch exists just beyond the eastern property line. The coastal marsh along the northern shoreline of Harker's Island is predominantly SS artin_a alterniflora, and this site is no exception. This low marsh is approximately ±440' wide, interrupted by the shore-parallel ditch, and another ±110' of high marsh. The high marsh on this property is colonized primarily with Distichlis spicata, Spartina patens, and Borrichia frutescens. Along the sides of the mosquito ditches, the low marsh is interrupted with hummocks of remnant spoil from the original ditch creation. These hummocks have been colonized with the high marsh species of Borrichia frutescens and Juncus roemerianus and shrub/scrub species including cedar, wax myrtle, and yaupon holly. The substrate of the Eastmouth Bay is sandy, and supports submerged aquatic vegetation, though none is apparent within the riparian corridors of this property. The substrate of the ditches is much siltier in nature. According to NOAA charts, the tidal amplitude in this area is approximately 1.6'. The high ground of the property is typically lawn grass and pennywort, with scattered pines, wax myrtles, and oak. Soils in this area are primarily Leon poorly drained sands, and Carteret wet sand. Eastmouth Bay is not a designated Primary Nursery Area by the NC DMF. The waters of the bay carry a NC DWQ Water Quality Classification of SA, and the area is open to the taking of shellfish for consumption by the NC DEH. The Carteret County Land Use Plan classifies this area of Harker's Island as Limited Transition, with all AEC's classified as Conservation. The shoreline width of this property is 114'. 10. Project Description: The applicant proposes to construct a private pier beginning at the delineated Section 404 Wetlands/Coastal Marsh line. The 6' wide pier would extend approximately 110' across the described high marsh system, cross the shore- parallel mosquito ditch, and extend approximately 450' across low marsh. The pier would then continue into Eastmouth Bay for a distance of 45', connecting to an "L" Head dock extending to the west, with dimensions of 8' x 16'. All portions of the structure will be elevated a minimum of 3' above marsh substrate. The proposed pier would terminate in -.9' of water at nlw, with the intent of allowing for the dockage of a single skiff sized boat. The waters of Eastmouth Bay are approximately 1600' across at this location, and all parts of the structure will be located >_15' from each riparian corridor. There are no mooring pilings or boatlifts associated with this structure. 11. Anticipated Impacts: This project necessitates review under the Major Permit process because the distance the pier extends from the nhw contour exceeds 400 linear feet. The proposed structure will cause the shading of approximately 2700 sf of low marsh, 660 sf of high marsh, and incorporate 398 sf of open water. Temporary turbidity impacts can be expected during construction. No impacts to navigation should occur, as the proposal will terminate 53' into the 1600' body of water. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross-sectional drawings) drawn to scale in black ink on an 8 1/2' by I1" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Form DCM-MP-1 site.
