In response to the Notice of Violation listed above for the City of Marion's Corpening
Creek Wastewater Treatment Plant, the City'of Marion wishes to request.remission of the
civil penalty of$613.52 for a weekly TSS•violation for August 2018.
In response to the Notice of Violation at the Corpening Creek WWTP for the week of
August 25, our Total Suspended Solids limit was affected by high flow from a short heavy
downpour that occurred on August 21-22. The resulting high flow hydraulically upset the
settling process at the WWTP. WWTP staff immediately adjusted the aeration and flow at
the WWTP to reduce the impact of the brief high flow and brought everything back under
control. However, the WWTP had a'high TSS level on that day, causing the weekly TSS
violation.
The weather in 2018 has bci::f very unusual with several'brief but heavy downpours, a
couple of which, including the one on August 21-22, have caused issues at the WWTP. I
have attached data to show how rainfall that week was spread out among the three major
parts of the City's wastewater system for which rainfall is digitally recorded. As shown in
the attachment, the National Weather Service has confirmed 2018 to be a record year of
rainfall in Marion, with rainfall through October 12 of more than 77 inches, or three feet
more than the average, with over two months of the year,yet to come.
The City full believes that there was no impact on the receiving stream from the violation
in question. The appearance of our effluent was also better than might be indicated by this
violation. The daily results of the BOD-and fecal tests run.during the month show that
everything was running normal and well in compliance at the WWTP, except for this

situation that occurred. I have attached the DMR that indicates that all other parameters at
the WWTP were compliant during the month, except for the violations noted above.
The City's Public Works Department continues to work and make progress to reduce and
eliminate I & I from the wastewater collection system, through regular smoke testing and
repairs, as problems are identified.
The City would respectfully request that a fine not be issued for the August violation, due
to the problem being caused by a short downpour, record rainfall experienced in Marion in
2018, the City's continued efforts to reduce I & I in our wastewater collection system and
the City correcting the violation in question. NCDEQ staff at the Asheville Regional Office
and in Raleigh should be able to attest to the diligent efforts of Public Works Director Brant
Sikes and City staff to identify and eliminate hundreds of sources of I & I in recent years,
an effort that has greatly reduced wastewater flow during heavy rainfall events and which
will continue into the future.
The City of Marion needs every dollar possible to invest in making necessary repairs to the
wastewater collection system, as problems are identified. Money could be much better
invested in making needed repairs than in paying fines.
