Explain the purpose of the proposed work: The project is intended to meet the growing demand for residential housing in Wilmington. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. The onsite wetlands were field approved by Ms. Jennifer Frye with the US Army Corps of Engineers on March 23, 2006 (AID#200600820. A copy of the signed wetland survey has been provided as Appendix 1. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. There is no future development associated with the proposed project. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. The permanent wetland impacts will occur from the construction of the westernmost apartment building and required parking. In order to minimize wetland impacts, a retaining wall will be constructed to stabilize lot fill rather than using backslopes to return fill to existing grade. The temporary impacts have been assessed to a 25 foot wide construction corridor along the retaining wall. This construction corridor allows for temporary impacts from equipment needed to construct the retaining wall. Upon completion of the retaining wall, the temporary impact area will returned to original grade and seeded with a wetland seed mix as is discussed in the proposed mitigation plan. 2. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. See Appendix 2 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater. wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream - Work in North Carolina, available at http://l12o.enr.state.iic.us/ncwetlands/strmgide.litml. 1. APPENDIX 2 - Avoidance and Minimization The proposed project has avoided and minimized impacts to wetlands to the greatest extent possible. The original site plan proposed two apartment buildings with split parking, as well as a wet detention pond. The original site plan would have resulted in 0.47 acres of wetland impacts. The revisions to the site plan include reconfiguring the building and parking layout, as well as the design of an underground infiltration system for stormwater treatment. The current site plan proposes 0.30 acres of wetland impacts, resulting in an overall minimization of 0.17 acres of wetland impact. The project has also been designed to utilize a retaining wall to stabilize lot-fill. The alternative to a retaining wall would be using backslopes to transition lot fill to original grade. The proposed project will require :L 9.0 feet of lot fill in the western portion. The maximum backslope allowed by the City of Wilmington is a 3:1 slope. Therefore, the backslopes would encroach an additional 27 feet into onsite wetlands in order to transition fill to natural grade. The use of backslopes would result in an additional 0.14 acres of wetland impact. The proposed project has also avoided and minimized wetland impacts through the design of the stormwater management system. The original site plan proposed a wet detention pond. The current site plan proposes an underground infiltration system designed under the parking lot. Due to the small size of the project site, the use of a wet detention pond would have resulted in additional wetland impacts. The use of infiltration to treat stormwater allows for a feasible project design, while minimizing wetland impacts. Wetland impacts have also been minimized by restricting fill encroachment to the outer edges of the onsite wetlands. By restricting impacts to the wetland edges, the long term viability and hydrologic regime of both onsite and offsite wetlands will not be affected by the proposed development. To provide assurance against future impacts to onsite wetlands, a "Deed Restriction" will be recorded with New Hanover County to inform future buyers of the property that there are wetlands on the property, see attached. The proposed site plan has been revised to avoid wetland impacts to the greatest extent possible, while still maintaining an economically feasible project. The small size of project site limits design options. Therefore, the proposed project meets the avoidance and minimization criteria. The project proposed 0.17 acres of permanent impacts to wetlands as a result of site fill. The project also proposes 0.13 acres of temporary wetland impacts. The temporary wetland impacts will result from the 25' construction corridor along the length of the retaining wall. This 25' corridor is necessary for equipment access during construction of the retaining wall. The proposed mitigation plan consists of the following: Temporary Impacts - The mitigation for 0.13 acres of temporary impacts within the 25' construction corridor will consist of grading the area, should any rutting occur, and the application of 1.0 lbs of a specialty Wetland Seed Mix (rated at 0.5 lbs per 1,000 sq ft). The vegetative composition of the wetland seed mix has been attached to this Appendix. Permanent Impacts - Mitigation for the 0.17 acres of permanent wetland impacts will consist of both onsite and offsite mitigation. The onsite mitigation will consist of minor wetland enhancement. Currently, the onsite wetlands are infested with Chinese privet (Ligustrum sinense), which has almost completely choked out all native vegetation. There is also a significant amount debris (concrete, scrap metal, etc.) within the onsite wetlands. The onsite mitigation will consist of a one-time mowing event within the onsite wetlands and removal of all debris. The mowing of the wetlands will temporarily removed the undesirable vegetation (i.e. Chinese privet) and allow for natural recruitment of desirable wetland species. The mowing will also facilitate the removal of the debris from the wetlands. All vegetation less than f6.0" DBH will mowed. All trees greater than 6.0" DBH will remain undisturbed. The offsite mitigation will consist of the purchase of 0.25 acres of wetlands from the Ecosystem Enhancement Program (EEP). The Letter of Acceptance from EEP has been included with Appendix 3.
