River Buffer Protection Rules (15A NCAC 2B .0233) with Additional Conditions
Dear Mr. O'Donnell:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill within or otherwise impact 280 linear feet of intermittent stream and 0.00 square feet
(ft) of Zone 1 Neuse River protected riparian buffer and 0.00 square feet (ft) of Zone 2 Neuse
River protected riparian buffer for the purpose of performing stream restoration on the Long
Branch stream at the subject property, as described within your application Dated May 15, 2006,
and received by the N.C. Division of Water Quality (DWQ) on May 15, 2006, with additional
information received on May 30, 2006. After reviewing your application, we have decided that
the impacts are covered by General Water Quality Certification Number(s) 3495 (GC3495). The
Certification(s) allows you to use Nationwide Permit(s) NW27 when issued by the US Army
Corps of Engineers (USACE). This letter shall also act as your approved Authorization
Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition,
you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, and Non-discharge regulations. Also, this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

The Additional Conditions of the Certification are:
1. Impacts Approved
The following impacts are hereby approved as long as all of the other specific and general
conditions of this Certification (or Isolated Wetland Permit) are met. No other impacts are
approved including incidental impacts:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre-Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.
4. Diffuse Flow
All constructed storm,%vater conveyance outlets shall be directed and maintained as diffuse
flow at non-erosive velocities through the protected stream buffers such that it will not re-
concentrate before discharging into a stream as identified within 15A NCAC 2B .0233 (5). If
this is not possible, it may be necessary to provide stormwater facilities that are considered to
remove nitrogen. This may require additional approval from this Office.

5. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within
these boundaries approved under this authorization shall be clearly marked with orange
warning fencing (or similar high visibility material) for the areas that have been approved to
infringe within the buffer, wetland or water prior to any land disturbing activities to ensure
compliance with 15A NCAC 2B 33 and GC 3402.
6. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. If placement of sediment and erosion control devices in
wetlands and waters is unavoidable, they shall be removed and the natural grade restored
within six months of the date that the Division of Land Resources has released the project.
7. Stream Restoration with Approved Plans
The stream and buffer restoration must be constructed, maintained, and monitored according
to the approved plans in the application and modifications to the application. Any repairs or
adjustments to the site must be made according to the approved plans or must receive written
approval from this Office to make the repairs or adjustments.
Riparian zone restoration is required as a condition of this Certification. Replanting of
vegetation within disturbed areas located within 30 feet of the stream associated with stream
restoration must be done in an "in kind" manner immediately following construction.
(Example: Disturbed areas with pre-existing grassed lawns must be replanted with grass.
Disturbed areas with pre-existing trees or woody vegetation must be replanted with trees and
woody vegetation. Disturbed areas with pre-existing forest vegetation must be replanted with
forest vegetation including at least two different native hardwood tree species at a density
sufficient to provide 320 trees per acre at maturity. This density can usually be achieved by
planting approximately 436 (10 x 10 spacing) to 681 (8 x 8 spacing) trees per acre.)
8. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-
1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60

days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Dear Mr, Steven Stokes:
This letter is in response to your letter of response dated July 7`", 2006 regarding the Notice of Violation, which was
sent to Mr. Paul Holloway on March 26`s, 2006 at 128 Dogwood Lane. The Notice of'Violatiou referenced above
was issued to Mr. Holloway for the intentional backfilling of the stream bank located at the address located at 128
Dogwood Lane (PIN 4 1831827565).
It is the decision of the Raleigh Regional Office (Surface Water Protection Unit) that in order to come back into
compliance that the current unauthorized fill material be removed from the stream bank, deposited on high ground
and stabilized. The fill material tbzt had been place within the channel of the stream must be removed by hand.
Therefore, the Raleigh Regional Office (Surface Water Protection Unit) has found your restoration plan to be
acceptable.
This letter does not relieve you from acquiring any other federal, state or local permits that may be required for your
proposed restoration project.

Dear Mr. O'Donnell:
On May 15, 2006, the Division of Water Quality (DWQ) received your after-the-fact application
dated May 15, 2006, to impact 280 linear feet of stream and an undisclosed amount of Zone 1
and Zone 2 Neuse River basin protected riparian buffers to perform a stream restoration at the
subject property. On May 30, 2006, the DWQ received additional information from you,
however, the DWQ has determined that your application remains incomplete and/or provided
inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected wetlands and/or streams on the subject
property. Therefore, unless we receive five copies of the additional information requested
below, we will have to move toward denial of your application as required by 15A NCAC 2H
.0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. There are two outstanding Notice(s) of Violation (NOV) for this site. A NOV was issued
by the DWQ Raleigh Regional Office on March 14, 2006, and another NOV was issued
by the DWQ Raleigh Regional Office on May 26, 2006. These NOVs must be resolved
before we can process your PCN application for this site. Please contact Mike Horan at
the DWQ Raleigh Regional Office to. resolve these NOVs. Once these NOVs have been
resolved to the. satisfaction of the DWQ Raleigh Regional Office, please forward the
specifics of the resolution to the DWQ Central Office.
Please contact the DWQ within three weeks of the date of this letter to verify that you have
received this letter and that you remain interested in continuing to pursue permitting of your

This looks like something we need to coordinate with Danny or Myrl. Some of the
items listed as required in the NOV are not submitted as part of this packet and I
don't know if that's the applicant being sloppy, or that someone else has the info
we need. Things such as to where will be the debris be removed to and a planting
plan that returns more than grass to zone 1 buffer areas (ie, tree replanting).
The NOV also states specifically that the debris will be removed by hand (no
mechanized equipment), but the application calls for the use of a rubber-track hoe.
Having tried to remove stumps by hand before, they can be nearly impossible if in
the wrong place, but the applicant needs to do a better job explaining why they are
using mechanical equipment when specifically told not to and how they expect to get
it close enough to the stream to be useful without making a bigger mess, including
destroying additional buffer.
There was also no discussion about what was going to be done to get the stream back
into its original channel. The pump-around for the current (to be abandoned)
channel shows water being routed by a hose and I haven't been able to find anything
that assures me that the water will chose to go back to the old/proposed channel
once this debris removal is done.
Maybe they have already addressed these somewhere, but I didn't see in the
application and we need it to be able to have confidence that this restoration is
going to work.

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are

9. Describe the existing conditions on the site and general land use in the vicinity of the project
at the time of this application: The west side of the project stream is in a residential
subdivision and the east side is wooded.
10. Describe the overall project in detail, including the type of equipment to be used: Rubber
tracked track hoe and dump truck.
11. Explain the purpose of the proposed work: Remove accumulated sediment from 170 ft of
stream channel and remove 10' of fill composed of wood chips, stumps etc. on a 110 ft
section downstream. Additionally, the flow will be put back in the original stable channel
disrupted by the filling by placing 2-5'x 10' channel blocks in the upstream and downstream
section of the channel formed under the fill.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. Each impact must be
listed separately in the tables below (e.g., culvert installation should be listed separately from
riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts,
permanent and temporary, must be listed, and must be labeled and clearly identifiable on an

accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial)
should- be shown on a delineation map, whether or not impacts are proposed to these systems.
Wetland and stream evaluation and delineation forms should be included as appropriate.
Photographs may be included at the applicant's discretion. If this proposed impact is strictly for
wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.
Provide a written description of the proposed impacts: Remove accumulated sediment
(from 10" to 47" starting at the upstream end) from 170' of stream channel remove debris
fill of wood chips, stumps, etc. on the adjacent 110' downstream section and reopen the
original channel prior to the fill activities. The fill was apparently being _placed periodically
by the landowner to compensate him for the land lost during the 1999 hurricane This fill has
blocked the channel and caused aggradation immediately upstream Additionally, the fill has
caused the stream to abandon its original channel and begin flowing under the fill Two
approximately 5 x 10' channel blocks will be placed at the upstream and downstream ends of
the side channel once the fill is removed to allow the water to again flow into the original
channel. This project will temporarily impact 280' of channel
2. Individually list wetland impacts. Types of impacts include, but are not limited to
mechanized clearing, grading, fill, excavation, flooding, ditching/drainage, etc. For dams,

Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
This project is being undertaken to correct a NCDWQ notice of violation. (See attached
NCDWO letter from Merl Nisely, Environmental Spec. III dated March 14, 2006 at 130
Dogwood Lane).
i VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

On January 3, 2006, Mr. Michael Horan and Mr. Myrl Nisley from the Raleigh Regional Office
(Surface Water Protection Unit with the Division of Water Quality) conducted a site inspection in response to
an anonymous complaint. The site inspection took place at the location of 130 Dogwood Lane in Wake Forest,
in Wake County. The site visit revealed that the recent cutting of trees within the Neuse River Buffer, fill for
streambank stabilization and un-authorized fill within waters of the State and the US has constituted a Notice of
Violation.
During the on -site inspection Mr. Michael Horan and Mr. Myrl Nisley, took photographs, made visual
observations and noted unauthorized impacts to streams and riparian (streamside) buffers, located on the subject
tract.
The subject site inspections revealed violations and/or merit additional information requests for the
following items: 1) Removal of Use 2) Neuse River Buffer
Item I. Preclusion of Best Usage
A DWQ site visit dated January 3, 2006, confirmed that unauthorized fill has entered into the.unnamed
tributary to Richland Creek. The recent activity has resulted in the filling approximately 60 linear feet of the
stream floor bed with large woody debris, and the placement wooded debris along the stream banks.(15A
NCAC 2B.0211 (2) explains the conditions related to best usage).
Item II. Neuse River Riparian Buffers
The Neuse River Basin is a river basin that is subject to riparian (streamside) buffer rules. The purposes
of these rules are to protect and preserve riparian buffers in the Neuse River Basin. That is, these rules help to
maintain the nutrient removal functions of the streamside areas necessary to protect surface waters.
Specifically, this Rule applies to the 50-foot wide riparian buffer directly adjacent to surface waters
(intermittent streams, perennial streams, lakes, ponds, and estuaries). Further, the protected riparian buffer has
two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetatec}vo;ihCarolir
area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B.0233, and (b) ZonalVattu'i1!lb

The site visit and file review confirmed that no Pre-Construction Notification was received for this project
and that riparian buffer impacts associated with clearing of vegetation, grading and grubbing were not
authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or
authorization had been issued for these impacts to the riparian zone. As a result, the following riparian buffer
rule violations are noted:
Neuse River Buffer Rule15A NCAC 2B .0233 Deposition of fill, grading, grubbing and the respective
clearing of vegetation has occurred in the riparian zone, (a violation of the requirement that Zone 1 and Zone 2
consist of a stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of
the Rule). No variance or Practical Alternative Request was received prior to the Riparian Zone impacts.
This Office requires that violations, as detailed above, be abated immediately. These violations and any
future violations could be subject to civil penalty assessments of up to $25,000.00 per day for each violation.
This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your
response should address the following items:
1. Please explain when construction (grading and clearing) began at the site.
2. Please provide a site plan (showing existing lot layout) at a scale of no more thanl inch= 50 feet.
3. Please depict stream and Neuse River Riparian Buffer on site plan.
4. Please depict areas of impact to stream and Neuse River Riparian Buffer. Stream should be measured
in linear feet and the Riparian Buffer should be measured in square footage.

With respect to your restoration plan the following components will be required as a minimum:

will be removed from both streambank, streamside riparian buffer and from the stream itself. This information
should be depicted on a map you provide.
• The wooded debris is to be removed by hand (using mechanized equipment is not allowed) and should be
placed in uplands outside of any riparian zone and floodplain. Please indicate in your response a schedule with
dates detailing when this will be accomplished.

a.) Riparian zone planting: A planting plan must be developed and implemented in order to ensure that
at least two native tree species be planted at a density sufficient to provide 320 trees per acre at
maturity. This density is usually achieved by planting approximately 436 trees/acre on a 10 x 10 ft.
grid or 681 trees/acre on a 8 x 8 ft. grid. Please see the. Guidelines for Riparian Buffer Restoration
(January 2001) for assistance in developing your plan (http://www.nceep.net/pages/links.htm). This
plan must include the types of native woody vegetation selected, methodology of planting, and a
site map indicating the location of the replanting efforts. The rule requires that Zone 1 of the buffer
consist of undisturbed forest vegetation. The rules allow for Zone 2 to be managed vegetation.
In addition, DWQ requests that at least 20% of the trees planted be balled and burlapped, 1.5 - 2.0-
inch caliper nursery stock, to provide variation in the size of the trees in the restoration area.
b.) Your plan should include provisions for periodic monitoring of the riparian zone to ensure that the
vegetation is established and no gullies or rills have formed
c.) Please indicate in your response a detailed schedule with dates explaining when the restoration will
be accomplished. As a part of this schedule you should detail/include a three-year monitoring plan.

On January 3, 2006, Mr. Michael Horan and Mr. Myrl Nisley from the Raleigh Regional Office
(Surface Water Protection Unit with the Division of Water Quality) conducted a site inspection in response to
an anonymous complaint. The site inspection took place at the location of 130 Dogwood Lane in Wake Forest,
in Wake County. The site visit revealed that the recent cutting of trees within the Neuse River Buffer, fill for
streambank stabilization and un-authorized fill within waters of the State and the US has constituted a Notice of
Violation.
During the on -site inspection Mr. Michael Horan and Mr. Myrl Nisley, took photographs, made visual
observations and noted unauthorized impacts to streams and riparian (streamside) buffers, located on the subject
tract.
The subject site inspections revealed violations and/or merit additional information requests for the
following items: 1) ReTnoval of Use 2) Neuse River Buffer
Item I. Preclusion of Best Usage
A DWQ site visit dated January 3, 2006, confirmed that unauthorized fill has entered into the unnamed
tributary to Richland Creek. The recent activity has resulted in the filling approximately 60 linear feet of the
stream floor bed with large woody debris, and the placement wooded debris along the stream banks.(15A
NCAC 2B.0211 (2) explains the conditions related to best usage).
Item II. Neuse River Riparian Buffers
The Neuse River Basin is a river basin that is subject to riparian (streamside) buffer rules. The purposes
of these rules are to protect and preserve riparian buffers in the Neuse River Basin. That is, these rules help to
maintain the nutrient removal functions of the streamside areas necessary to protect surface waters.
Specifically, this Rule applies to the 50-foot wide riparian buffer directly adjacent to surface waters
(intermittent streams, perennial streams, lakes, ponds, and estuaries). Further, the protected riparian buffer has
two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetates ??°°,;;ettttttCa
area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B.0233, and (b) ZoneNattlr,

2 [the outer 20 feet, landward from the outer 30 foot edge of zone 1] shall consist of stable vegetated area that is
undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 213.0233.
The site visit and file review confirmed that no Pre-Construction Notification was received for this project
and that riparian buffer impacts associated with clearing of vegetation, grading and grubbing were not
authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or
authorization had been issued for these impacts to the riparian zone. As a result, the following riparian buffer
rule violations are noted:
Neuse River Buffer Rule15A NCAC 2B.0233 Deposition of fill, grading, grubbing and the respective
clearing of vegetation has occurred in the riparian zone, (a violation of the requirement that Zone 1 and Zone 2
consist of a stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of
the Rule). No variance or Practical Alternative Request was received prior to the Riparian Zone impacts.
This Office requires that violations, as detailed above, be abated immediately. These violations and any
future violations could be subject to civil penalty assessments of up to $25,000.00 per day for each violation.
This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your
response should address the following items:
1. Please explain when construction (grading and clearing) began at the site.
2. Please provide a site plan (showing existing lot layout) at a scale of no more than 1 inch= 50 feet.
3. Please depict stream and Neuse River Riparian Buffer on site plan.
4. Please depict areas of impact to stream and Neuse River Riparian Buffer. Stream should be measured
in linear feet and the Riparian Buffer should be measured in square footage.
5. Please indicate what areas are to have the wooded debris removed and provide a planting plan for the
impacted area
6. Please explain why appropriate 401 Water Quality Certification and a 404 Permits were not secured.
With respect to your restoration plan the following components will be required as a minimum:
• Please provide a restoration plan detailing where the wooded debris is presently located and how material
will be removed from both streambank, streamside riparian buffer and from the stream itself. This information
should be depicted on a map you provide.
• The wooded debris is to be removed by hand (using mechanized equipment is not allowed) and should be
placed in uplands outside of any riparian zone and floodplain. Please indicate in your response a schedule with
dates detailing when this will be accomplished.
Thank you for your attention to this matter. This Office requires that violations, as detailed above, be
abated immediately. These violations and any future violations could be subject to civil penalty assessments of
up to $25,000.00 per day for each violation. This Office requests that you respond to this letter, in writing,

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

at the time of this application: The west side of the project stream is in a residential
subdivision and the east side is wooded.

tracked track hoe and dump truck.

stream channel and remove 10' of fill composed of wood chips stumps etc on a 110 ft
section downstream. Additionally the flow will be put back in the original stable channel
disrupted by the filling by placing 2-5'x 10' channel blocks in the upstream and downstream
section of the channel formed under the fill.

wetland or stream mitigation, list and describe the impact in Section VIII below. If additional

(from 10" to 47" starting at the upstream end) from 170' of stream channel remove debris
fill of wood chips, stumps, etc. on the adjacent 110' downstream section and reopen the
original channel prior to the fill activities The fill was apparently being placed periodically
by the landowner to compensate him for the land lost during the 1999 hurricane This fill has
blocked the channel and caused aggradation immediately upstream Additionally the fill has
caused the stream to abandon its original channel and begin flowing under the fill Two

Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts

This project is being undertaken to correct a NCDWQ notice of violation (See attached
NCDWQ letter from Myrl Nisely Environmental Spec III dated March 14, 2006 at 130
Dogwood Lane).
,VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

On January 3, 2006, Mr. Michael Horan and Mr. Myrl Nisley from the Raleigh Regional Office
(Surface Water Protection Unit with the Division of Water Quality) conducted a site inspection in response to
an anonymous complaint. The site inspection took place at the location of 130 Dogwood Lane in Wake Forest,
in Wake County. The site visit revealed that the recent cutting of trees within the Neuse River Buffer, fill for
streambank stabilization and un-authorized fill within waters of the State and the US has constituted a Notice of
Violation.
During the on -site inspection Mr. Michael Horan and Mr. Myrl Nisley, took photographs, made visual
observations and noted unauthorized impacts to streams and riparian (streamside) buffers, located on the subject
tract.
The subject site inspections revealed violations and/or merit additional information requests for the
following items: 1) Removal of Use 2) Neuse River Buffer
Item I. Preclusion of Best Usage
A DWQ site visit dated January 3, 2006, confirmed that unauthorized fill has entered into the. unnamed
tributary to Richland Creek. The recent activity has resulted in the filling approximately 60 linear feet of the
stream floor bed with large woody debris, and the placement wooded debris along the stream banks.(15A
NCAC 2B.0211 (2) explains the conditions related to best usage).
Item II. Neuse River Riparian Buffers
The Neuse River Basin is a river basin that is subject to riparian (streamside) buffer rules. The purposes
of these rules are to protect and preserve riparian buffers in the Neuse River Basin. That is, these rules help to
maintain the nutrient removal functions of the streamside areas necessary to protect surface waters.
Specifically, this Rule applies to the 50-foot wide riparian buffer directly adjacent to surface waters
(intermittent streams, perennial streams, lakes, ponds, and estuaries). Further, the protected riparian buffer has
two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetatectqo"ihCarot;n
area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B.0233, and (b) Zone?l?aturai

undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B.0233.
The site visit and file review confirmed that no Pre-Construction Notification was received for this project
and that riparian buffer impacts associated with clearing of vegetation, grading and grubbing were not
authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or
authorization had been issued for these impacts to the riparian zone. As a result, the following riparian buffer
rule violations are noted:
Neuse River Buffer Rule15A NCAC 2B.0233 Deposition of fill, grading, grubbing and the respective
clearing of vegetation has occurred in the riparian zone, (a violation of the requirement that Zone 1 and Zone 2
consist of a stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of
the Rule). No variance or Practical Alternative Request was received prior to the Riparian Zone impacts.
This Office requires that violations, as detailed above, be abated immediately. These violations and any
future violations could be subject to civil penalty assessments of up to $25,000.00 per day for each violation.
This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your
response should address the following items:
1. Please explain when construction (grading and clearing) began at the site.
2. Please provide a site plan (showing existing lot layout) at a scale of no more thanl inch= 50 feet.
3. Please depict stream and Neuse River Riparian Buffer on site plan.
4. Please depict areas of impact to stream and Neuse River Riparian Buffer. Stream should be measured
in linear feet and the Riparian Buffer should be measured in square footage.
5. Please indicate what areas are to have the wooded debris removed and provide a planting plan for the
impacted area
6. Please explain why appropriate 401 Water Quality Certificdtion and a 404 Permits were not secured.
With respect to your restoration plan the following components will be required as a minimum:
Please provide a restoration plan detailing where the wooded debris is presently located and how material
will be removed from both streambank, streamside riparian buffer and from the stream itself. This information
should be depicted on a map you provide.
• The wooded debris is to be removed by hand (using mechanized equipment is not allowed) and should be
placed in uplands outside of any riparian zone and floodplain. Please indicate in your response a schedule with
dates detailing when this will be accomplished.
Thank you for your attention to this matter. This Office requires that violations, as detailed above, be
abated immediately. These violations and any future violations could be subject to civil penalty assessments of
up to $25,000.00 per day for each violation. This Office requests that you respond to this letter, in writing,

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

at the time of this application: The west side of the project stream is in a residential
subdivision and the east side is wooded.
10. Describe the overall project in detail, including the type of equipment to be used: Rubber
tracked track hoe and dump truck.
11. Explain the purpose of the proposed work: Remove accumulated sediment from 170 ft of
stream channel and remove 10' of fill composed of wood chips stumps etc on a 110 ft
section downstream. Additionally the flow will be put back in the original stable channel
disrupted by the filling by placing 2-5'x 10' channel blocks in the upstream and downstream
section of the channel formed under the fill.

VI. Proposed Impacts to Waters of the United States/Waters of the State

wetland or stream mitigation, list and describe the impact in Section VIII below. If additional
space is needed for listing or description, please attach a separate sheet.
1. Provide a written description of the proposed impacts: Remove accumulated sediment
(from 10" to 47" starting at the upstream end) from 170' of stream channel remove debris
fill of wood chips, stumps, etc. on the adjacent 110' downstream section and reopen the
original channel prior to the fill activities. The fill was apparently being placed periodically
by the landowner to compensate him for the land lost during the 1999 hurricane This fill has
blocked the channel and caused aggradation immediately upstream. Additionally, the fill has
caused the stream to abandon its original channel and begin flowing under the fill Two
approximately 5 x 10' channel blocks will be placed at the upstream and downstream ends of
the side channel once the fill is removed to allow the water to again flow into the original
channel. This project will temporarily impact 280' of channel

Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
This project is being undertaken to correct a NCDWQ notice of violation. (See attached
NCDWQ letter from Merl NiselL Environmental Spec. III dated March 14, 2006 at 130
Dogwood Lane).
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete.
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
Draft Technical Guide for Stream Work in North Carolina, available at
hqp://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

On January 3, 2006, Mr. Michael Horan and Mr. Myrl Nisley from the Raleigh Regional Office
(Surface Water Protection Unit with the Division of Water Quality) conducted a site inspection in response to
an anonymous complaint. The site inspection took place at the location of 130 Dogwood Lane in Wake Forest,
in Wake County. The site visit revealed that the recent cutting of trees within the Neuse River Buffer, fill for
streambank stabilization and un-authorized fill within waters of the State and the US has constituted a Notice of
Violation.
During the on -site inspection Mr. Michael Horan and Mr. Myrl Nisley, took photographs, made visual
observations and noted unauthorized impacts to streams and riparian (streamside) buffers, located on the subject
tract.
The subject site inspections revealed violations and/or merit additional information requests for the
following items: 1) Removal of Use 2) Neuse River Buffer
Item I. Preclusion of Best Usage
A DWQ site visit dated January 3, 2006, confirmed that unauthorized fill has entered into the.unnamed
tributary to Richland Creek. The recent activity has resulted in the filling approximately 60 linear feet of the
stream floor bed with large woody debris, and the placement wooded debris along the stream banks.(15A
NCAC 2B.0211 (2) explains the conditions related to best usage).
Item II. Neuse River Riparian Buffers
The Neuse River Basin is a river basin that is subject to riparian (streamside) buffer rules. The purposes
of these rules are to protect and preserve riparian buffers in the Neuse River Basin. That is, these rules help to
maintain the nutrient removal functions of the streamside areas necessary to protect surface waters.
Specifically, this Rule applies to the 50-foot wide riparian buffer directly adjacent to surface waters
(intermittent streams, perennial streams, lakes, ponds, and estuaries). Further, the protected riparian buffer has
two zones as follows: (a) Zone 1 [measured from stream bank landward for 30 feet] shall consist of a vegetateclivo''thCaroli
area that is undisturbed except for uses provided for in Subparagraph (6) of 15A NCAC 2B.0233, and (b) Zone?l?at![tal!

undisturbed except for activities and uses provided for in Subparagraphs (4) and (6) of 15A NCAC 2B.0233.
The site visit and file review confirmed that no Pre-Construction Notification was received for this project
and that riparian buffer impacts associated with clearing of vegetation, grading and grubbing were not
authorized by DWQ. Specifically, no request, or a DWQ practical alternative determination, variance or
authorization had been issued for these impacts to the riparian zone. As a result, the following riparian buffer
rule violations are noted:
Neuse River Buffer Rule15A NCAC 2B.0233 Deposition of fill, grading, grubbing and the respective
clearing of vegetation has occurred in the riparian zone, (a violation of the requirement that Zone 1 and Zone 2
consist of a stable, vegetated area that is undisturbed except for activities and uses provided for in Item (6) of
the Rule). No variance or Practical Alternative Request was received prior to the Riparian Zone impacts.
This Office requires that violations, as detailed above, be abated immediately. These violations and any
future violations could be subject to civil penalty assessments of up to $25,000.00 per day for each violation.
This Office requests that you respond to this letter, in writing, within 20 days of receipt of this Notice. Your
response should address the following items:
1. Please explain when construction (grading and clearing) began at the site.
2. Please provide a site plan (showing existing lot layout) at a scale of no more thanl inch= 50 feet.
3. Please depict stream and Neuse River Riparian Buffer on site plan.
4. Please depict areas of impact to stream and Neuse River Riparian Buffer. Stream should be measured
in linear feet and the Riparian Buffer should be measured in square footage.
5. Please indicate what areas are to have the wooded debris removed and provide a planting plan for the
impacted area
6. Please explain why appropriate 401 Water Quality Certification and a 404 Permits were not secured.
With respect to your restoration plan the following components will be required as a minimum:
• Please provide a restoration plan detailing where the wooded debris is presently located and how material
will be removed from both streambank, streamside riparian buffer and from the stream itself. This information
should be depicted on a map you provide.
The wooded debris is to be removed by hand (using mechanized equipment is not allowed) and should be
placed in uplands outside of any riparian zone and floodplain. Please indicate in your response a schedule with
dates detailing when this will be accomplished.
Thank you for your attention to this matter. This Office requires that violations, as detailed above, be
abated immediately. These violations and any future violations could be subject to civil penalty assessments of
up to $25,000.00 per day for each violation. This Office requests that you respond to this letter, in writing,
