unnamed tributaries to Roaring �ranch as part of their proj ect to improve SI�
13 3 9(Roaring Branch �Zoad), Ashe County, North Carolina.
The No�th Carolina I�epartment of Transportation (NCDOT) has submitted an application to
obtain a Section 404 Permit from the IJ.S. Army Corps of Engineers (USACE) and a 401 Water
Quality Certification from the NC Division of Water Resources (NCDWR). Staff biologists with
the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the information
provided. These comments are provided in accordance vvith the provisions of the state and
federal Environmental Policy Acts (G. S. 113A-1 through 113 -10; 1 NCAC 25 and 42 LT. S.C.
4332(2)(c), respectively), the Clean Water Act of 1977 (33 �J.S.C. 466 et seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended9 16 LJ.S.C. 661-667d), as applicableo
The NCDOT proposes to replace and extend six pipe culvert crossings of SI�. 13 3 9(I�oaring
Branch Road) and add one crossing, carrying unnamed tributaries to I�oaring �ranch (Class C;
Outstanding Resource Waters), as part of the road paving proj ect. T`he proj ect will permanently
impact 125 linear feet (l� of stream for the pipe extensions and 701f for riprap stabilization.
Temporarily impacts tota140 lf for dewatering the work area of one crossing.

should not be modlfied by widening the channel or changing the depth of the waterway.
