Box 1325 Asheville, N.C. 28802 (828)-251-1900 (828)-251-1945 November 1, 2018 Landon Davidson NCDENR Asheville Regional Office 2090 U.S. 70 Highway Swannanoa, NC 28778-8211 Re: Notice of Violation NOV-2018-LV-0755 WQ0029233 Bear Lake Reserve Mr. Davidson This letter is in response to your 10-25-18 letter to Bear Lake Reserve attached. We did exceed daily permit limits for fecal coliform for daily maximums with 40 mg/L on July 12, 2018 and 64 mg/L on July 19, 2018 which resulted in a monthly average exceedance as well of 50.6 mg/L with 25 mg/L limit. As a result we cleaned the UV lights and August results within permit limits. The TSS did exceed the monthly average of 5 mg/L with a 7.6 mg/L. Cleaning the UV lights might have helped the TSS results as well. The low numbers are hard to detect visually by the operator and did not reflect in turbidity readings. The missing TKN, TN, and TP readings are a result of a minor permit modification to the property boundary in July. The owner did forward the new permit to use in mid-July and did not notice the additional testing requirements when reviewed since it was issued for changes to the property boundary. No attention was described in the first two pages of the permit where any changes are usually outlined. With receipt of this NOV we have started sampling for TKN, TN, and TP which will be included in the NDMR starting October 2018. TKN, TN, TP will be in violation for August and September 2018 as a result. No water was irrigated or sent to irrigation holding tank in July 2018. All effluent was recycled to the upset tank and processed again. Sorry for the inconvenience. If you have any questions please call anytime. Robert Barr Robert Barr
