The current Wake county tax PIN for the property is 1758-54- 5875. The site covers 132.75 acres on the east side of US 401 and Jonesville Road and is located in the Neuse River Basin. Included with this application are detailed drawings depicting the proposed impacts as well as site layout, drainage, and erosion control construction drawings for the subdivision. Detailed impervious surface calculations, previous regulatory documents, and agent authorization are also included. Site concurrence was held with Ms. Andrea Wade of the US Army Corps of Engineers and a Jurisdictional Determination was issued on May 14, 2003. Site concurrence was held with Ms. Deborah Edwards of the NC Division of Water Quality on January 13, 2003. A NC DWQ Buffer Determination was issued on May 22, 2003. This is the second permit application for this property. The first application was submitted to the USACE and the DWQ on June 29, 2005. Permits were issued by the USACE on July 11, 2005 and by the DWQ on October 11, 2005 (DWQ Project # 05-1210). The first permit application was for impacts associated with the Virginia Water Drive stream crossing on the eastern boundary of the property to connect it to an adjacent subdivision, the Village at Rolesville. This connection was required by the Town of Rolesville according to the Town's Thoroughfare Plan to satisfy interconnectivity and access redundancy requirements for emergency services. The connection also provides the residents of The Village at Rolesville with a crucial second access point to a major artery, US 401. The original intent of the first permit application was that the Town of Rolesville act as the permittee for the crossing, as it provides no benefit to Carlton Point Subdivision and is only required as part of the Town of Rolesville's Thoroughfare Plan to provide community interconnectivity and emergency service access redundancy. It is our understanding that the USACE makes the determination as to whether the Town of Rolesville can be the permittee for the permitted crossing. We are currently conversing with the Town of Rolesville regarding this issue and will keep the USACE and the DWQ appraised of the situation as the matter develops. The first and most significant avoidance measure was the removal of a second connection to the adjacent eastern subdivision. This connection, located at Impact Area #4, would have crossed the same perennial stream impacted by the Virginia Water Drive connection and, due to the depth of the stream drainageway, would have also had a significant impact on that stream. A sanitary sewer connection was still necessary at Impact Area 44. The installation of aerial sanitary sewer crossings at Impact Areas #3 and 4 minimized potential stream impacts at those locations. The impacts at Impact Area #2 are necessary for the widening of Jonesville Road to add a required turning lane and an eight-foot multi-use trail along. The impacts at Impact Area #1 are necessary to provide a second point of access along Jonesville Road. The crossing was oriented perpendicularly to minimize impacts to the stream. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. The land use surrounding this property is residential and undisturbed forest. 10. Describe the overall project in detail, including the type of equipment to be used: The project entails the development of a residential subdivision and the associated infrastructure including: roads, water supply, and sanitary and storm sewers. Equipment used will include, but is not limited to tmckhoe excavators, bulldozers, rollers, asphalt pavers, and other grading and road construction equipment. 11. Explain the purpose of the proposed work: The purpose of the proposed work is to provide the necessary infrastructure to support a residential subdivision of single family homes. IV. Prior Projcct History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. Site visits with Ms. Andrea Wade of the USACE and Ms. Deborah Edwards of the NC DM were conducted and resulted in the issuance of a Jurisdictional Determination on December 9, 2002 (USACE AID# 200320221) and a Neuse River Buffer Determination on May 22, 2003 (DWQ NBRRO #03-110. A PCN application was submitted on June 29, 2005 for impacts associated with a stream crossing on the eastern boundary of the property to connect it to an adjacent subdivision. Future Project Plans Are any future permit requests anticipated for this project? The Applicant does not anticipate any additional permit requests for this property. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Each impact must be listed separately in the tables below (e.g., culvert installation should be listed separately from riprap dissipater pads). Be sure to indicate if an impact is temporary. All proposed impacts, permanent and temporary, must be listed, and must be labeled and clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) should be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, Page 10 of 14 but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at littp:Hli2o.enr.state.nc.us/ncwetiands/strmgide.litml. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. s If mitigation is required, we will approach the NC Ecosystem Enhancement Program' In-Lieu-Fee Program to accept payment to offset mitigation requirements. 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP). Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form. Page 12 of 14 XI. Stormwater (required by DWQ) Describe impervious acreage (existing and proposed) versus total acreage on the site. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. If percent impervious surface exceeds 20%, please provide calculations demonstrating total proposed impervious level. The proposed subdivision would increase the impervious area of the site to 21.47%. The impervious areas result from the creation of approximately 11.26 acres of infrastructure impervious surfaces, consisting of the street, curb and gutter, 5' sidewalk, and an 8' reg enway trail, and approximately 17.2 acres of lot impervious surfaces, based on an estimated 2,500 sgft for house, driveway, front walk, and patio, for a total of approximately 28.7 acres. Stormwater from these areas would flow into the storm drainage system and routed to level spreaders for release as diffuse flow through the Neuse River Buffer. XII. Sewage Disposal (required by DWQ) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Wastewater generated by the proposed subdivision will be treated by the City of Raleigh's wastewater treatment system. XIII. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If this is not possible, it may be necessary to provide stormwater facilities that are considered to remove nitrogen. This may require additional approval from this Office. 7. Culvert Installation Culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re- installed correctly. Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the stream up or down stream of the culvert(s). Existing stream dimensions (including the cross section dimensions, pattern and longitudinal profile) shall be maintained above and below locations of each culvert. Therefore, you must provide plans with adequate details that indicate that the current stability of the stream will be maintained or enhanced. You must receive written approval from this Office for the above plans before the culvert(s) is installed. Culvert(s) must be installed according to approved plans. Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20 percent of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. The establishment of native, woody vegetation and other soft stream bank stabilization techniques must be used where practicable instead of rip rap or other bank hardening methods. If rip-rap is necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of Water Quality. Installation of culverts in wetlands must ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the NC Division of Water Quality upon completion of the project. The following are our responses to your comments: 1. Please provide building envelopes for all lots with stream buffers, especially Lots 103- 105 so we can be certain these lots can be built without buffer impacts. The building envelopes on all lots containing stream buffers are limited to the areas in the lot outside of the stream buffers. There will be no buffer impacts associated with these lots. 2. Compensatory stream mitigation will be required for this project since the total stream impact will now be greater than 150 feet. Mitigation will be required at a 1:1 ratio for the total stream impact (289 feet). Please address how this stream mitigation will be provided. We are currently negotiating with the U.S. Army Corps of Engineers to separate the previous impacts permitted as Virginia Water Drive Connection from the impacts associated with Carlton Point Subdivision. The separation is based upon the insignificance of Virginia Water Drive Connection to Carlton Point Subdivision and Virginia Water Drive Connection being a requirement by the Town of Rolesville. Virginia Water Drive Connection provides no benefit to the future residents of Carlton Point Subdivision, while at the same time causing impacts to protected waters. Carlton Point Subdivision has ample access to major NC Highways without Virginia Water Drive Connection. Virginia Water Drive Connection will not provide residents of Carlton Point Subdivision with access to any commercial or community resources. Virginia Water Drive Connection is solely a requirement placed upon the developer of Carlton Point Subdivision by the Town of Rolesville. The Town of Rolesville has offered to sign the USACE permit as the applicant for the Connection. The separation is based upon the insignificance of Virginia Water Drive Connection to Carlton Point Subdivision and Virginia Water Drive Connection being a requirement by the Town of Rolesville. Virginia Water Drive Connection provides no benetit to the future residents of Carlton Point Subdivision, while at the same time causing impacts to protected waters. Carlton Point Subdivision has ample access to major NC Highways without Virginia Water Drive Connection. Virginia Water Drive Connection will not provide residents of Carlton Point Subdivision with access to any commercial or community resources. Virginia Water Drive Connection is solely a requirement placed upon the developer of Carlton Point Subdivision by the Town of Rolesville. The Town of Rolesville has offered to sign the USACE permit as the applicant for the. Connection. It was determined that the features shown on the Wake County Soil Surveys and on the USGS Rolesville, NC Quad map could potentially be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A: 0213.0233 (NCAC .0233). Feature A is subject from its origin at flag #249 downstream to western property line. Feature B is subject from its origin at flag #415 downstream to southern property line. Feature C is subject throughout property. Feature D is not subject and feature E is subject from its origin at flag # 18 downstream to northern property boundary, this feature remains subject along the northeastern property boundary. This letter only addresses the applicability of the Neuse Buffer Rules. For information relevant to 401 Water Quality Certifications, wetlands and other impacts to "waters of the state", please contact the Central Office at 733-1786.
