The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No Exposure
Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal and signed
certification of no exposure at the above referenced facility as well as observations made by Brandon Wise
with the Winston-Salem Regional Office on August 27, 2018, the Division is not granting your conditional
exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by reference in
North Carolina regulations.
Please note the following reasons for denial of the application:
- Totes and drums are stored outside in an area exposed to the elements.
- No containment surrounding area where drums, totes, and other containers are stored.
A no exposure permit can be obtained if these conditions are fixed, until then the site is expected to continue
monitoring and maintenance based on a NPDES permit, if a permit is not acquired stormwater discharges
are considered a non -permitted discharge. Should you request a no exposure permit, some sort of cover for
the storage should be built or should be stored inside the facility. If you have any questions or need further
