A letter of request for an Authorization to Construct was received July 23, 1990 bythe
Division and final plans and specifications for the subject project have been reviewed and found to
be satisfactory. Authorization is hereby granted for the construction of chlorine disinfectionfacilities consisting of chlorine diffusion equipment, an approximately 33,665 gallon contact basin,
and all associated piping, valves, and appurtenances with discharge of treated

NPDES Permit No. NC0021601 issued October 22, 1987, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with he conditions

In the event that the facilities fail to perform satisfactorily, includingthe
nuisance conditions, the Permittee shall take immediate corrective action, including thosereation f as maybe
required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Asheville Regional Office, phone no. (704) 251-6208, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in-placeinspection can be made. Such notification to the regional supervisor shall be made during
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excludingState
Holidays. •

Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility has
been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit,
P.O. Box 27687, Raleigh, NC 27611.
The Permittee shall employ a certified wastewater treatment plant operator to be in
responsible charge of the wastewater treatment facilities. The operator must hold a certificate of the
grade at least equivalent to the classification assigned to the wastewater treatment facilities by the
Certification Commission.
A copy of the approved plans and specifications shall be maintained on file by the Permittee
for the life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6.
The issuance of this Authorization to Construct
o struct does not preclude the Permittee from
complying with any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

Wastewater Treatment Facility

Dear Mr. Wilkison:
The final plans and specifications for the subject project have been
reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of modifications
and additions to expand the existing 0 .8 mgd activated sludge wastewater
treatment plant to a 1 . 294 mgd extended aeration wastewater treatment plant
to consist of a new mechanical bar screen and bypass manual bar screen; an
aerated grit unit; and Parshall flume for flow monitoring; modifications to
the existing aeration basin to consist of 'replacement of the existing fixed
aerators with two (2) 25 hp floating aerators and one (1) 15 hp mixer; a new
aeration basin; a new secondary clarifier; ultraviolet light disinfection
system; modifications to the existing sludge pump station/control building; a
new sludge pump station to consist of dual 995 gpm non-clog vertical return
sludge pumps, one (1) 130 gpm non-clog vertical return sludge feed pump and
dual submersible scum pumps; sludge dewatering system to consist of a 1 .0
meter belt filter sludge press with a liquid emulsion type polymer feed
system, one (1) sludge press wastewater pump and a sludge dewatering building;
conversion of the existing sludge holding tank to an aerobic digester with a
new 15 hp floating aerator, a new concrete-lined sludge holding basin with a
15 hp mixer and a 400 gpm submersible digester sludge pump; in-plant flow
metering and sampling; lab building; and associated yard piping, electrical
work, site work, and appurtenances.

Do not proceed with construction until the Authorization-to-Award
package, EEO, and MBE documentation/certification have been reviewed, and you
are in receipt of our approval if Federal funding is desired for project
construction..
The permittee shall employ an actively State certified wastewater
treatment plant operator to be in responsible charge of the wastewater
treatment facilities. Such operator must hold a valid State Certificate of
the grade at least equivalent to the classification assigned to the wastewater
treatment facilities by the Certification Commission. When a new chief
operator must be obtained to be in responsible charge of the new facilities ,
it is required that this be done by the time the construction of the
facilities is 50% complete.
This Authorization-to-Construct is issued in accordance with Part III,
Paragraph C of NPDES Permit No. NC0021601 issued October 22, 1987, and shall
be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the approved plans, specifications, and
supporting documents; and are in compliance with the conditions and
limitations specified in Permit No. NC0021601 .
The permittee shall have an acceptable sludge analysis and a sludge E.P.
toxicity analysis which have been approved by the Division of Health Services ,
Solid Waste Management Branch prior to the disposal of any sludge from the new
wastewater treatment plant. Copies of the analyses, supporting documents , and
approvals shall be submitted to the Division of Environmental Management ' s
Water Quality Section and the Asheville Regional Office.
The Permittee shall comply with the following groundwater monitoring
requirements :
a. Within 90 days of the issuance of this Authorization to Construct,
three (3) monitor wells, one (1) upgradient and two (2)
downgradient, must be installed to monitor groundwater quality.
The location and construction details for these wells must be by
approval of the Asheville Regional Office, from which a well
construction permit must be obtained.
b. The monitor wells must be sampled initially after construction and
thereafter every March, July, and November for the following
parameters:

Water Levels ' Total Coliforms
TOX (In November only)
The measurement of water level must be made prior to sampling for
the remaining parameters.

The analytical methods used for TOX must be capable of detecting
the total of all halogenated organic compounds present at a
concentration of 5 . 0 parts per billion (ppb ) or greater . Any
individual halogenated organic compound present at a concentration
at or above the method detection limit (MDL ) must be identified ,
quantified , and reported with the sampling results .
The results of the sampling and analysis shall be sent to the N .
C . Division of Environmental Management on Form GW-59 ( Compliance
Monitoring Report Form) .
c . Any additional groundwater quality monitoring , as deemed necessary
by the Department , shall be provided .
During the construction of the proposed additions /modifications , the
permittee shall continue to properly maintain and operate the existing
wastewater treatment facilities at all times , and in such manner , as necessary
to comply with the effluent limits specified in the NPDES permit .
You are reminded that it is mandatory for the project to be constructed
in accordance with the North Carolina Sedimentation Pollution Control Act and ,
when applicable , the North Carolina Dam Safety Act . In addition , the
specifications must clearly state what the contractors responsibilities shall
be in complying with these Acts .
The disposal , selling , or free distribution of wet , dried , composted
sludge or sludge - like materials from wastewater facilities without prior
review and approval by this Division is illegal .
One ( 1 ) set of final approved plans and specifications is to be
forwarded to you , one ( 1 ) set to the Environmental Protection Agency ( EPA) ,
and one ( 1 ) set to the Corps of Engineers .

A letter of request for Authorization to Construct was received March
20, 1984, by the Division and final plans and specifications for the subject
project have been reviewed and found to be satisfactory. Authorization is
hereby granted for the construction of a . 290 MGD settling basin for removal
of filter backwash and sedimentation basin washdown solids and having a compacted
soil liner, multi-level decant stations for clear water discharge, influent
structure, piping, fittings , valves , and appurtenances to serve the Tryon Water
Treatment. Plant.
• This Authorization to Construct is issued in accordance with Part III
paragraph C of NPDES Permit No. NC0021601 issued April 1, 1983, and shall be
subject to revocation unless the wastewater treatment facilities are constructed
in accordance with the conditions and limitations specified in Permit No. NC0021601.
The Permittee must employ a certified wastewater operator in accordance
with Part III paragraph D of the referenced permit.
The sludge generated from these treatment facilities must be disposed
of in accordance with G. S. 143-215. 1 and in a manner approvable by the North
Carolina Division of Environmental Management
In event the facilities fail to perform satisfactorily in meeting it ' s
NPDES permit effluent limits , the Town of Tryon shall take such immediate
corrective action as may be required by this Division, including the construction
of additional wastewater treatment and disposal facilities.
