Dear Alan:
We are writing pursuant to Condition 7 of the above referenced 401 Water Quality Certification
which requires submission of an annual monitoring report each year on June 1, beginning on
June 1, 2006.
Our client has not commenced work on the permitted project as we have not received the final
404 Permit from the U.S. Army Corps of Engineers. Therefore, our client has not implemented
monitoring of the wetland creation areas pursuant to Condition 7. Once we receive the
404 Permit, our client will begin work pursuant to the conditions of both the 401 Certification
and the 404 Perrn it-
