APPROVAL OF MODIFICATION OF STORM WATER MANAGEMENT PLAN
Dear Mr. Barron:
The Division of Water Quality (DWQ) has reviewed the December 8, 2006 Modification Request to the
Storm Water Management Plan approved by DWQ on August 7, 2006. You have requested to change the
spillway on Pond No. 1 from concrete to an earthen spillway with a reinforced channel lining. Due to its
location within the project, DWQ understands that there will not be dam safety concerns associated with
this modification. Furthermore, the spillway is in approximately the same location as the original
spillway, and all other parameters have not been changed. Therefore, DWQ will approve of this
structural change to Stormwater Pond No. 1. All other structural stormwater BMPs approved by DWQ
must be constructed as originally approved.
This Modified Stormwater Management Plan will partially satisfy the stormwater conditions required by
the Individual Water Quality Certification issued on May 9, 2006.
You are required to meet the following conditions:
The storm water treatment system, which includes the extended detention pond, preformed scour
holes, and forested filter strips, as approved by this Office, and the drainage patterns depicted on
the plan sheets, must be maintained in perpetuity. No changes to the structural storm water
practices shall be made without written authorization from the Division of Water Quality. The
storm water easements shall allow for the ability to maintain the structures, perform corrective
actions, and shall provide protection of the structures from potential alternations by future
property owners.
2. You must submit three (3) copies of an executed Declaration of Covenants and Restrictions-
Riparian Areas document within thirty (30) days of recording with the Register of Deeds,
Chatham County, North Carolina.
3. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing
at the letterhead address within ten (10) days of the commencement of construction.

Please reference the previous DWQ Stormwater Management Approval dated 08/07/2006 (DWQ # 05-0732v2) and
our conversation on December 6, 2006, regarding the proposed modification of the spillway on pond #1 of the Briar
Chapel s/d. The spillway is proposed to be changed from a concrete spillway to an earthen spillway with re-enforced
channel lining. The client is proposing to change the concrete spillway to an earthen spillway due to costs, structural
integrity, and aesthetics. The spillway is in approximately the same location and will stay outside of the buffer, and
have the same forested filter strip to outlet into. There are no other structural changes to the pond drainage area
etc, it is a change in the spillway design. This submittal is Phase 1- MOD request Pond 1 and will be for (1)
stormwater management facilities. Attached is the original DWQ Stormwater Permit (DWQ # 05-0732v2) USGS
quad, Chatham County Soils Survey Project Vicinity Map w/ Pond 1 Location Approved Spillway Proposed Spillway
Wet Detension Supplement, and Maintenance Agreement.
The proposed proiect consist of constructing a residential community and mixed-use community with multi-familv
and single-family housing. The proiect will include roads sewer line a force main stormwater collection and
amenities such as a pool and clubhouse Stormwater management facilites will not impact waters of the U.S..
Traditional equipment will be used such as front-end loaders graders and earth movers ( Attached: Vicinty Map w/

2006 and subsequent revisions received August 4, 2006 prepared by your engineer, Mr, Jercmy Firch,
P.E., of John R. McAdams Company, Inc. This Plan partially satishaes the stormwater conditions required
by the Individual Water Quality Certification issued on May 9, 2006. You are required to meet the
following conditions:
1. The storm water treatment system, which includes the extended detention pond, preformed scour
holes, and forested filter strips, as approved by this Office, and the drainage patterns depicted on

specifications for stonnwater management facilities that are appropriate for surface waters
classified as "Nutrient Sensitive Waters" (NSW). As such., they shall be designed to remove
nitrogen and remove at least 85% TSS.
4. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing

Footnotes:
I When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
2 In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and sliall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 4.5 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads +S feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through

Please reference the previous DWQ Stormwater Management Approval dated 08/07/2006 (DWQ # 05-0732v2) and
our conversation on December 6. 2006, regarding the proposed modification of the spillway on pond #1 of the Briar
Chapel s/d. The spillway is proposed to be changed from a concrete spillway to an earthen spillway with re-enforced
channel lining. The client is proposing to change the concrete spillway to an earthen spillway due to costs, structural
integrity, and aesthetics. The spillway is in approximately the same location and will stay outside of the buffer, and

have the same forested filter strip to outlet into. There are no other structural changes to the pond, drainage area,
etc, it is a change in the spillway design. This submittal is Phase 1- MOD request Pond 1 and will be for (1)
stormwater management facilities. Attached is the original DWQ Stormwater Permit (DWQ # 05-0732v2), USGS
quad, Chatham County Soils Survey, Project Vicinity Map w/ Pond 1 Location, Approved Spillway, Proposed Spillway,
Wet Detension Supplement, and Maintenance Agreement.
The proposed project consist of constructing a residential community and mixed-use community with multi-family
and single-family housing. The project will include roads, sewer line, a force main, stormwater collection, and
amenities such as a pool and clubhouse. Stormwater management facilites will not impact waters of the U.S..
Traditional equipment will be used such as front-end loaders, graders, and earth movers. ( Attached: Vicinty Map w/

The Division of Water Quality (DWQ) has reviewed the Storm Water Management Plan dated July 24,
2006 and subsequent revisions received August 4, 2006 prepared by your engineer, Mr. Jeremy Finch,
P.,E., of John R. McAdams Company, inc. This Plan partially satisfies the stormwater conditions required
by the Individual Water Quality Certification issued on May 9, 2006. You ate required to meet the
following conditions:
The storm water treatment system, which includes the extended detention pond, preformed scour
holes, and forested filter strips, as approved by this Office, and the drainage patterns depicted on
the plan sheets, must be maintained in perpetuity. No changes to the structural storm water
practices shall be made without written authorization from the Division of Water Quality. The
stoma water easements shall allow for the ability to maintain the structures, perform corrective
actions, and shall provide protection of the structures from potential' alternations by future
property owners.
2. You must submit tluee (3) copies of an executed Declaration of Covenants and Restrictions—
Riparian Areas document within thirty (30) days of recording with the Register of Deeds,
Chatham County, North Carolina.
3. You must submit the remainder of the stormwater management plans for Phase I within the next
sixty (60) days for approval by DWQ. This final stormwater management plan. (including a
signed and notarized Operation and Maintenance Agreement) will include plans and
specification for stormwater management facilities that are appropriate for surface waters
classified as "Nutrient Sensitive Waters" (NSW). As such, they shall be designed to remove
nitrogen and remove at least 85%TSS,
4. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing
at the l ctterhead address within ten (10) days of the commencement of construction.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 4 - S feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads q•S feet in the forebay, the sediment shall be removed.

Hey, yes end of the day. Per our conversation on December 6, 2006, please reference the previous DWQ
Stormwater Management Approval dated 08/07/2006 (DWQ # 05-0732v2) , regarding the proposed modification
of the spillway on pond #1 of the Briar Chapel s/d. The spillway is proposed to be changed from a concrete
spillway to an earthen spillway with re-enforced channel lining. The client is proposing to change the concrete
spillway to an earthen spillway due to costs, structural integrity, and aesthetics. The spillway is in approximately
the same location and will stay outside of the buffer, and have the same forested filter strip to outlet into. There
are no other structural changes to the pond, drainage area, etc, it is a change in the spillway design.
I will bring 3 hard copies by at 8am and a check for $500. Thank You for your attention and patience on this
project.

Attached are 2 exhibits: a pdf exhibit of the approved WQ Pond #1 and a pdf exhibit of the proposed
revisions to WQ Pond #1. Below is a summary of what is taking place:
The approved spillway for WQ Pond #1 consisted of 30' concrete weir spillway structure (crest
elevation = 413.60). This concrete structure served as the principal spillway outlet for the pond. The
1" runoff volume was captured by the pond and drawn down in 2-5 days through an orifice pipe that
discharged into a preformed scour hole/level spreader. The proposed revisions to WQ Pond #1
resulted due to the desire by the client to reduce the cost of the principal spillway. The proposed
revisions consist of removing the 30' concrete weir spillway structure and grading out the spillway
area to be an earth spillway w/ a reinforced channel lining. The length of the spillway will increase to
50' due to grading out of the area, but the weir crest elevation will remain at the 413.60. The earth
spillway will also serve as the principal spillway outlet for the pond, and the F runoff volume will be
drawn down in 2-5 days through the same orifice pipe that then discharges into the preformed scour
hole/level spreader. The design hydrology for the pond (i.e. drainage area, impervious, etc.) will not
change from the approved design hydrology. However, the previously submitted and approved water
quality calculations (i.e. 1" runoff volume, forebay volume, required normal pool surface area,
drawdown time, etc.) will change a negligible amount due to the revised pond grading, but all outlet
pipe sizes, inverts will remain the same. The pond is virtually the same as the approved design except
we now have an earth principal spillway rather than a concrete principal spillway.

The Division of Water Quality (.DWQ) has reviewed the Storm Water Management Plan dated July 24,
2006 and subsequent revisions received August 4, 2006 prepared by your engineer, Mr. Jeremy Fitteh,
P.E., of John R. McAdams Company, Inc. This Platt partially satisfies the stormwater conditions required
by the Individual Water Quality Certification issued on May 9, 2006. You are required to meet the
following conditions:
The storm water treatment system, which includes the extended detention pond, preformed scour
holes, and forested filter strips, as approved by this Office, and the drainage patterns depicted on
the plan sheets, must be maintained in perpetuity. No changes to the structural storm water
practices shall be made witbout written authorization from the Division of Water Quality. The
storm. water casements shall allow for the ability to maintain the structures, perform corrective
actions, and shall provide protection of the structures from potential alternations by future
property owners, ,
7. You must submit tluee (3) copies of an executed Declaration of Covenants and Restrictions-
Riparian Areas document within thirty (30) days of recording with the Register of Deeds,
Chatham County, North Carolina.
3. You must submit the remainder of the stormwater mana9cr cnt plans for Phase I within the next
sixty (60) days for approval by DWQ. This final stormwater management plats. (including a
signed and notarized Operation and Maintenance Agreement) will include plans and
spccircations for stormwater management facilities that are appropriate for surface waters
classified as "Nutrient Sensitive Waters" (NSW). As such., they shall be designed to remove
nitrogen and remove at least 85% TSS.
4. The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing
at the ici:tencead address within ten (10) days of the commencement of constntction.

I When using the Division SA/DA tables, the correct SA/DA ratio for permanent pool sizing should be computed based upon the
actual impervious % and permanent pool depth. Linear interpolation should be employed to determine the correct value for non-
standard table entries.
2 In the 20 coastal counties, the requirement for a vegetative filter may be waived if the wet detention basin is designed to provide
90% TSS removal. The NCDENR BMP manual provides design tables for both 85% TSS removal and 90% TSS removal.
II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H. 1008.

The permanent pool depth is between 3 and 6 feet (required minimum of 3 feet).
The forebay volume is approximately equal to 20% of the basin volume.
The temporary pool controls runoff from the design storm event.
The temporary pool draws down in 2 to 5 days.
If required, a 30-foot vegetative filter is provided at the outlet (include non-erosive flow
calculations)
The basin length to width ratio is greater than 3:1.

III. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads 4.5 feet in the main pond, the sediment shall be removed.
When the pennanent pool depth reads +5 feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.
