Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Upland Re -Development 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the re -development of the above referenced property, including the homesites, driveways, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any other work or development proposed in an Area of Environmental Concern (AEC), including but not limited to the Coastal and Estuarine Shoreline AECs and located within the applicant's property, shall require a review and authorization from the Division of Coastal Management prior to work commencing. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 123-18 Page 2 of 3 ADDITIONAL CONDITIONS 2) This permit does not authorize any new impervious surfaces within 30 feet of the normal high water line. Stormwater Management 3) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 4) The Division of Energy, Mineral and Land Resources (DEMLR) approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8 18 100 1, which was issued on 10/23/18. Any violation of the permit approved by the DEMLR will be considered a violation of this LAMA permit. Sedimentation and Erosion Control NOTE: An Erosion and Sedimentation Control Plan may be required for this project. If required, this plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environmental Quality, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 5) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. General 6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parity without the written approval of the Division of Coastal Management. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) This permit does not authorize the excavation or filling of any vegetated wetlands or open water areas. 9) No development activities authorized under this permit shall take place until documentation of the completion of the purchase of the property by the permittee is provided to DCM. 10) Should the permittee's Offer to Purchase contract be terminated or should the purchase of the property by the permittee otherwise not take place, this permit shall be revoked unless this permit is legally transferred in accordance with Title 15A NCAC 07J .0406. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Hyde Investors, LLC. Permit No. 123-18 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. SAW -2018-02052. NOTE: The N.C. Division of Water Resources determined the proposed project did not involve open water development or non -coastal wetlands therefore did not require General Water Quality Certification and assigned the project DWR Project No. 2018-1475. NOTE: Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water line. NOTE: An Express Permit application processing fee of $2,000 was received for this project.
