Attached is your letter requesting additional information on my shed project. As a
reminder my project is to build an 8'x10' storage shed that partially extends into the 50
foot buffer, for reason that setback restrictions on my other fixtures on the land (camper
and deck} require separation that does not leave enough room to the riparian buffer. The
land had no trees/bushes on it when Ipurchased-only Bass, and I would like to have my
shed extend Eft into the buffer. Total buffer impact is Eft by 8ft, for a total of less than
SOsgft.
Item 1, Buffer mitigation: For buffer mitigation I would like to plant trees of type
maple, cherry, oak, dogwood, or bald cypress. I intended to consult with Amy Chapman
to understand the number of trees that would account for my mitigation requirement. ~~ .`.

Item 2, Stormwater Manasement: I would like to create a rain garden around the shed
that will trap runoff from the roof and allow it to absorb into the ground. The rain garden
will include plants selected to absorb any additional water.
I had imposed on Amy and other members of the DWQ staff to educate me on
requirements. Though this is not a large project, I will continue to ask your assistance to
ensure I comply with your requirements. If there is any additional information I need to
provide, I understand you may be required to contact me by letter, but I am very willing
to take phone calls if it suits. My cell is 919-271-6203. Though I frequently can't
answer immediately, I do return calls quickly.

On January 5, 2007, the Division of Water Quality (DWQ) 401 Oversight/Express Permitting Unit
received your minor variance application dated January 2, 2007, regarding your request for a Minor
Variance from the Tar Pamlico Buffer Rules (15A NCAC 2B .0259) for the subject property. The DWQ
is required to prepare a "preliminary finding" /"finding of fact" as to whether the variance request meets
the requirements of 15A NCAC 02B .0259(9)(a). The DWQ may attach conditions to a variance approval
that support the purpose, spirit and intent of the riparian buffer protection program. Conditions usually
include storrrtwater management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request.
Therefore, unless additional information is provided as described below, we will have to move toward
denial of your request per 15A NCAC 2B .0259 and will place this project on hold as incomplete until we
receive this additional information.
Additional Information Requested:
1. Buffer Miti ag tion-Mitigation will be required as a condition if you choose to proceed with either
the Minor or 1Vlajor Variance. If you choose to proceed with a variance, then please provide a
buffer mitigation plan pursuant to 15A NCAC 02B .0242.
2. Stormwater Mana ement- Stormwater Management will be required as a condition if you choose
to proceed with either the Minor or Major Variance. Please provide a detailed stormwater
management plan depicting how you intend to treat the stormwater running off the proposed
impervious surfaces.
